The Permit to Operate shall expire February 7, 2023. PURPOSE OF SITE VISIT: Complaint follow up inspection. STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None Page 1 of 5 NORTH CAR()LINAD_E Q�� OepaNnent of Envie.nmenbl W.I� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS The following compliance issues in bold require action to address. 1. This facility must only accept waste it is permitted to receive, which is limited to land clearing waste; yard trash; untreated and unpainted wood; uncontaminated soil; inert debris such as unpainted rock, brick, concrete, and concrete block; and asphalt. During the inspection, metal, plastics, painted wood, and other unacceptable wastes were observed specifically along the top tier of the side slopes of the LCID landfill. Within 30 days of this report, remove all unacceptable waste from the LCID landfill and treatment and processing areas. 2. This facility is permitted to receive waste generated within Wake County. 3. Durable, permanent markers that accurately delineate the waste disposal boundary and are easily visible must be installed and maintained. During the inspection, no edge -of -waste markers were visible. Mr. Jarboe said the site had been recently surveyed and that EOW marker would soon be installed. Within 30 days of this report, install markers delineating the waste boundary for the LCID landfill. 4. Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical feet (3:1). Side slopes of the LCID landfill were steeper than 3:1 in many areas, specially the western slope adjacent to the property boundary and the southeastern slope. The southeastern slope had developed a long fissure that might result in the material Bluffing off. Within 30 days of this report and as dry weather permits, regrade the side slopes to not exceed a ratio of three horizontal feet to one vertical foot. 5. Open burning of land clearing waste is prohibited. If a fire occurs, the permittee must provide oral notification to the Section within 24 hours of the occurrence followed by a written report of the details of the fire within 10 working days of the occurrence. During the inspection, potential evidence of a previous fire was observed along the southern slope. Mr. Jarboe stated that there had not been a fire at the LCID landfill since at least April, when he was hired. He could not speak to any fire occurrences prior to that. If a fire occurs in the future, follow the rules outlined above for notifying the Section. 6. Solid waste must be covered with one (1) foot of suitable soil cover at least once per month or when the active area reaches one acre in size, whichever occurs first, or more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown materials, vectors or excessive water infiltration. During the inspection, the top tier of the LCID landfill (side slopes) did not have adequate soil cover. Within 30 day of this report, cover the landfill's side slopes with one foot of soil. 7. Large amounts of LCID waste is being stored for processing on top of the LCID landfill. This is acceptable according to the approved operations plan. 8. Surface water must be diverted away from the operational area and must not be impounded over or in waste. During the inspection, several operational areas had water ponding in and around them and water was impounding over the LCID landfill. Within 30 days of this report, regrade/repair these areas so that surface water is shed from the landfill and does not pond in the operational areas. 9. The side slopes of the LCID landfill are overgrown with woody vegetation. Please mow and remove woody vegetation to allow for a complete inspection of the site. 10. Mr. Jarboe and I discussed the history of this site (see below for more details). Please be aware that there is an old sanitary landfill and demolition landfill underneath the LCID landfill. Any excavation/reclamation of the LCID material from the landfill should be done carefully with this in mind. Page 2 of 5 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA o"'—t0E-!�'m lMi""' Solid Waste Section Site History: The Wall Recycling, LLC (formerly Rowland) LCID landfill received approval by NC Division of Health Services in 1975 as a sanitary landfill operating in an old rock quarry, accepting primarily demolition debris, and some sanitary garbage and other wastes. In 1983, the site was permitted by Wake County as a demolition landscape landfill. In the 1990's, the NC Superfund Section conducted a groundwater assessment of the landfill and subsequently issued a "No Further Action" status for the site around 2001. In May 2002, the facility submitted to Wake County a closure plan for the demolition landfill and registered as a LCID T&P Notification site. The facility remained under the regulatory authority through January 2008, at which time permitting authority reverted to the NC Division of Waste Management. In December 2010, the facility was permitted by DWM as a LCID landfill and treatment and processing facility and has operated as such since that time.
