This letter is to inform you of the status of the Graham County Landfill, permit number
#38-01. Graham County decided on April 8t" of 1994 to close this landfill and soon after
began the closure process.
Since the closing of this site, Graham County has fulfilled its obligation to the best of our
ability and continues to do, so. We have done all. that has been required of us by the US
Forest Service and by NC DEIJNR's Solid Waste Division. This includes capping the
site, seeding, installation of monitoring wells, and the monitoring of those wells. To date,
the results of the monitoring have all been positive with no signs of contamination.
The US Forest Service has approved all of our post closure activities and has requested
nothing further from Graham County. We are under the impression that we would be
required to conduct closure and post closure activities for a period of five years. It has
now been over six years since closure began and we would like to have some
determination made as to whether we have satisfied our obligation or if we will for some
reason have to continue with post closure activities, and if so the length of time that
continuation wouid entaii.
Jim Patterson, with the Solid Waste Division, frequently inspects the site, and we have
responded to any request that he has made to maintain the site satisfactorily. We
understand that the capped area will have to continue to be monitored and maintained to
protect the area from erosion and other natural events that might penetrate the capped
area and result in buried waste being uncovered and unwanted leachate coining to the
surface and causing some contamination.
1 have personally visited the site many times and most recently in early September of this
year. The site is in very good conditio3:� and it is our intent to see that it remains in that
condition.
Please advise me of your opinion in this matter as soon as possible. We need to know of
any required future activities so that we can budget for the costs associated with
additional post closure expenses.
Your office received some communication from Municipal Engineering in late 1995 as to
the results of our closure activities and their consulting reports relative to that activity. I
have contacted them today for copies of those reports so that I can familiarize myself
with their report since I was not here at the time and am unable to locate items here
pertaining to their report.

Re: post -Closure Monitoring Requirements at the Closed Graham County Landfill (permit
#38-01).

This letter is in response to your request by phone on February 29, 2000, to cease post -closure
monitoring at the Graham County landfill.
Dar records show that the subject landfill stopped receiving waste on or before April 1994, in
accordance with federal criteria and state regulations. Upon receipt of certification from the
County that the final cap was installed in accordance with the closure regulations, the Solid
Waste Section issued a closure letter to the County dated January 30, 1996. The cover letter
states in bold that "Please note, that this closure shall become effective upon written notification
by the owner/operator that the facility shall be maintained in compliance with the.post-closure
conditions specified in this letter." In addition, Condition 8(e) in the closure letter states that
"Water quality detection monitoring shall continue for a minimum of five years from the bate of
the Section's receipt of the owner/operator's notification that the facility will be maintained in
compliance with the post -closure conditions specified in this letter. After .five years the Section
will determine if further monitoring is to be required."
To date, the Section has not received a letter from the County stating that the County is in
agreement with the closure conditions. If the County is in agreement with the closure conditions
as stated in the January 30, 1996 letter from the Section, please respond in writing. At that time
the available site data will be evaluated and the Section will make a determination about post -

Dear Mr. Wiggins:
This letter is in response to your letter dated September 28, 2000, requesting
a clarification of the post -closure requirements for the referenced municipal solid
waste landfill.
Our records show that the subject landfill stopped receiving waste in April
of 1994, in accordance with federal criteria and state regulations. Upon receipt of
certification from the County that the final cap was installed in accordance with the
closure regulations, the Solid Waste Section(Section) issued a closure letter to the
County dated December 29, 1995. However; at the request of the County, the
Section reconsidered the post -closure monitoring requirements and on January 30,
1996, reissued the closure letter. This closure letter, superceded the original
closure letter and deleted the requirement of an upgraded water quality monitoring
system.
The cover letter for the closure letter states in bold that "This closure shall
become effective upon written notification by Graham County that the facility shall
be maintained in compliance with the post -closure conditions specified in this
letter." In addition, Condition 8(c) in the closure letter states that "Water quality
detection monitoring shall continue for a minimum of five years from the date of
the Section's receipt of the owner/operator's notification that the facility will be
maintained in compliance with the post -closure conditions specified in this letter.
After five years the Section will determine if further monitoring is to be required."
All post -closure requirements, except the water quality monitoring and reporting
requirements, are performance based and are not time limited.
Our records indicate that the Section received the required certification
letter on February 7, 1996, therefore the five-year post -closure monitoring period
ends on February 7, 2001. As stated in the closure letter, after five years the
Section will determine if further monitoring is to be required. It is important to note
that the water quality monitoring system has consistently detected at least two
volatile organic compounds in one down -gradient well and that continuation of <.
post -closure monitoring beyond the five-year time period is likely. It is also

important to note that our records indicate that the Section has not received water quality data
for this facility since March of 1998. If water quality sampling has been performed since March
of 1998, please submit a copy to the Section within 30 days. If water quality sampling was
suspended March of 1998, the County is required to resume semi-annual sampling immediately
to fulfill the post -closure requirements.
