RE: NOTICE OF VIOLATION - GRAHAM COUNTY LANDFILL
(PERMIT NO. 38-01)
Dear Mrs. Irons:
Pursuant to North Carolina Statute §130A-22(a) and 15A North Carolina Administrative Code
13B, I conducted an inspection on August 26, 1994, at the Graham County landfill, Permit No. 38-01,
located on SR 1112 near Robbinsville, North Carolina. The inspection found the Graham County
landfill to be in violation of certain requirements contained in the North Carolina Solid Waste
Management Rules, codified at 15A North Carolina Administrative Code 13B, specifically:
1. 15A North Carolina Administrative Code 13B.0505(4)(a) requires that adequate erosion con-
trol measures shall be practiced to prevent silt from leaving the site. The Graham County
landfill was operating in violation of 15A North Carolina Administrative Code
13B.0505(4)(a) in that the small silt basin had "blown out" and silt was leaving the landfill
site.
2. 15A North Carolina Administrative Code 13B.0505(7)(c) requires that leachate shall be con-
tained on site or properly treated prior to discharge. The Graham County landfill was operat-
ing in violation of 15A North Carolina Administrative Code 13B in that leachate was leaving
the landfill site and being discharged into a small stream below the landfill.
3. 15A North Carolina Administrative Code 13B.0505(12)(b) requires that appropriate methods
such as fencing and diking shall be provided within the area to confine solid waste subject to
be blown by wind. At the conclusion of each day of operation, all windblown material result-
ing from the operation shall be collected and returned to the area by the owner or operator.
The Graham County landfill was operating in violation of 15A North Carolina Administrative
Code 13B.0505(12)(b) in that solid waste in road ditch line and rip rap drainage discharge
areas has not been collected and properly disposed of.

Based upon the foregoing, Graham County is hereby ordered to take the following actions by
October 31. 1994, to correct all violations as stated in this Notice of Violation and otherwise be in
compliance with the North Carolina Waste Management Rules, codified at 15A North Carolina
Administrative Code 13B:
1. Comply with 15A North Carolina Administrative Code 13B.0505(4)(a) by repairing the exist-
ing sedimentation basin or by installing a new sedimentation basin.
2. Comply with 15A North Carolina Administrative Code 13B.0505(7)(c) by taking measures
necessary to ensure that leachate does not leave landfill site.
3. Comply with 15A North Carolina Administrative Code 13B.0505(12)(b) by picking up all
waste material in road ditch line and rip -rap discharge areas. The material will have to be dis-
posed of at the Cherokee County landfill since the Graham County site is not receiving waste.
If the requirements above are not met on a continuing basis, enforcement action may be taken.
Remedies include assessment of administrative penalties of up to $5,000.00 per day per violation dat-
ing from the compliance date in this Notice of Violation and/or injunctive relief, pursuant to North
Carolina General Statute §130A-18 or North Carolina General Statute §130A-22.

The Graham County Board of County Commissioners and I
would like to take this opportunity to express our
appreciation to you for taking the time, after work hours,
to attend our Tri-County Solid Waste meeting in Cherokee
County Tues. March 22, 1994. Your input at the meeting was
very beneficial in.planning our long range goals for the
Authority.
In looking ahead, the Graham County Board of County
Commissioners plan tc; look at various options in order
to reduce our costs. One option is to look into the
feasibility of a small transfer station. Would you please
review the state regulations and permit requirements for
a project of this nature and transmit to me for review?
Solid waste issues are changing at, a rapid pace, as you
are well aware. You are a vital link between various
entities involved in this issue. You are always willing
to assist us as we plan ahead for long range goals to
simplify the solid waste collection and disposal process.
