First let me say how much I appreciate the efforts you and the other commissioners are making toward giving this situation the attention it so much needs! Things are starting to look better. To be sure, a great deal remains to be done; but you folks are making a start! As to where we are with the existing site on Atoah, I am attaching some copies of correspondence for your reference (particulary my 10/28/86 letter, items u through 6 are especially pertinent). Also attached is a copy of the special use permit and operating plan for your use and reference, since you mentioned that the County's file for the landfill could not be located. You will note that the present special use permit for the Atoah site has expired; however, attached is an amendment to extent this permit until March 1, 1987. You should sign, date and return this amendment to this office to legitimize the current landfill operation on National Forest lands. We have been suggesting to the county since last summer the need for the county to enlist an engineering firm to prepare a closeout plan for the site. In particular, a sediment and erosion control plan with respect to a sediment basin and possible re-route of the entrance road. The SCS assisted by providing the county detailed topographic information and offered on -site construction oversight.assistance; however, as far as can be determined nothing was done. The present access problems up onto the lift area at the landfill is a result of this inactivity, as well as State of N.C. inspection reports documenting non-compliance with sediment control. Attention is needed now so these measures can be implemented as soon as weather permits. Jim Patterson will be visiting the Sarvis Branch area discussed this morning on Tuesday, January 27 (will be here about 9:00 a.m.). Kirk, Jr., Secretary January 27, 1987 RE: Meeting in Graham County concerning Solid Waste 0n January 20, 1987, I met with Chester Crisp (Graham County Manager), Raymond Williams (Graham County Commissioner), Donnie Richardson (U.S. Forest Service), Steve Rickertson (U.S. Forest Service), Bill Timson (U.S. Soil Conservation Service), and Richard Green (U.S. Soil Conservation Service) to discuss the Graham County Landfill. During the meeting, we talked about re- curring past problems and violations at the landfill and the need to correct the problems. We also asked Graham County to check with their engineering firm, McGill & Associates, concerning revisions of current construction plan. The change would construct a new sediment basin and re-route the access road. Finally, Graham County was encouraged to look for a new site because of space and cover limitations at the existing site. Box 30 Stanleytown, Va. 24168 RE: Disposal of Core Solid Glue Waste (SOLIDS ONLY) Dear Mr. Stubblefield: The Solid & Hazardous Waste Management Branch has received a request for characterization of the subject waste. Based upon the submitted information, the waste appears to be non -hazardous. The Solid & Hazardous Waste Management Branch has no objection to the sanitary landfill disposal of this waste if in accordance with the conditions listed below: 1. The waste contains no -free liquids and can be con_ -fined, compacted, and covered in accordance with the "Solid Waste Management Rules." 2. The owner/operator of the landfill approves the disposal 3. The sludge is used as a soil conditioner and incorporated with the final two feet of cover the same day it is delivered to the landfill. 4. If the waste is delivered in drums and the drums are to be disposed, they are perforated with small holes, prior to delivery, to ensure that no liquids are present. 5. The waste is removed from the drums before disposal. Failure to meet these conditions may result in revocation of this approval, and subsequently, an administrative penalty. This approval is subject to change if new regulations were to prohibit this practice. If the process which generates the waste changes or if the composition of the waste changes significantly, this approval'is void, and re-evaluation of the waste will be required prior to subsequent disposal. In talking with your landfill operator, Billy Grindstaff, I learned that the landfill had been illegally set on fire over the weekend by an unknown person. The -area where the fire had been set was under control and for the most part smothered out. There was, however, another area where Billy Grindstaff 'was purposely burning waste from Stanley Furniture (wooden pallets, cardboard, etc.). Upon asking him about this burning, he told me that a federal representative driving a blue car with U. S. Government markings had visited the landfill site and advised him that the burning of this type material was permisssable. He also stated that this person had also comnented.on landfill life and on areas which he would allow to be filled. I told Mr. Grindstaff and your Vice -County Manager, Mr. Raymond Williams, that the Solid and Hazardous Waste Management Branch is the regulatory agency in charge of sanitary landfills and there is no open burning permitted at landfill sites. If this or any other official should, in the future, try to regulate your landfill operation, we would appreciate your finding out the person's name and who he represents and let us know. I advised Mr. Williams that the Solid and Hazardous Waste Management Branch would need a written notification concerning the fire within fifteen-(15) days. I might suggest having the Sherriff's Department patrol the landfill area on the weekends. This may prevent some of the problems you are having at the site. I did note on my visit that the landfill gate had been repaired and that a locking mechanism was in place. Thank you for your efforts on this matter and if you have questions, please let me know. The inspection revealed a serious erosion problem which has caused offsite sedimentation damage to the streams adjoining this property. Drainage from the landfill does not enter a basin or settling pond before leaving the site; consequently, sediment does not have the oppor- tunity to settle out of the drainage water. Correction of this problem will, most likely, require the construction of a sediment basin below the area disturbed for the landfill. This matter must be corrected as soon as possible. I am available to meet with you and Graham County officials, as necessary, to begin resolution of the problem. Please let me know by May 4, 1987, your intentions in this matter. Sincerely, Richard D. (b) Surface water shall not be impounded over or in waste. (c) Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. (6) VEGETATION REQUIREMENTS 9; fh — (a) Within six months after final termination of disposal operations at the site on a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses. — (b) Temporary seeding will be utilized as necessary to stabilize the site. (7) WATER PROTECTION REQUIREMENTS — (a) The separation distance of four (4) feet between waste and water table shall be maintained unless otherwise specified by the division in the permit. — (b) Solid waste shall not be disposed of in water. (c) Leachate shall be contained on site or properly treated prior to discharge. An NPDES permit may be required prior to the dis- charge of leachate to surface waters. (8) ACCESS AND SECURITY REQUIREMENTS — (a) The site shall be adequately secured by means of gates, chains, berms, fences, and other security measures approved by the division, to prevent unauthorized entry. — (b) An attendant shall be on duty at the site at all times while it is open for public use to ensure compliance with operational requirements. (c) The access road to the site shall be of all-weather construction and maintained in good condition. (d) Dust control measures shall be implemented where necessary. (b) Signs shall be posted stating that no hazardous or liquid waste can be received without written permission from the division. (c) Traffic signs or markers shall be provided as necessary to pro- mote an orderly traffic pattern to and from the discharge area and to maintain efficient operating conditions. (10) SAFETY REQUIREMENTS (a) Open burning of solid waste is prohibited. (b) Equipment shall be provided to control accidental fires or arrangements shall be made with the local fire protection agency to immediately provide fire -fighting services when needed. (c) Fires that occur at a sanitary landfill shall be reported to the division within 24 hours and a written notification shall be submitted within 15 days. — (d) The removal of solid waste from a sanitary landfill is prohibited unless the owner/operator approves and the removal is not performed on the working face. (e) Barrels and dru ms shall not be disposed of u n less they are empty and perforated sufficiently to ensure that no liquid or hazard- ous waste is contained therein. (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS — (a) A site shall only accept those solid wastes which it is permitted to receive. — (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. — (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. _ (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as amended through January 1,1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. At the conclusion of each day of operation, all windblown material resulting from the operation shall be col- lected and returned to the area by the owner or operator. (10) SAFETY REQUIREMENTS (a) Open burning of solid waste is prohibited. — (b) Equipment shall be provided to control accidental fires or arrangements shall be made with the local fire protection agency to immediately provide fire -fighting services when needed. (c) Fires that occur at a sanitary landfill shall be reported to the division within 24 hours and a written notification shall be submitted within 15 days. — (d) The removal of solid waste from a sanitary landfill is prohibited unless the owner/operator approves and the removal is not performed on the working face. _ (e) Barrels and drums shall not be disposed of unless they are empty and perforated sufficiently to ensure that no liquid or hazard- yam•. ^ ous waste is contained therein. —(b) Surface water shall not be impounded over or in waste. C?s1 —(c) Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. (6) VEGETATION REQUIREMENTS —(a) Within six months after final termination of disposal operations at the site on a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses. _—(b) Temporary seeding will be utilized as necessary to stabilize the site. (7) WATER PROTECTION REQUIREMENTS (a) The separation distance of four (4) feet between waste and water table shall be maintained unless otherwise specified by the division in the permit. (b) Solid waste shall not be disposed of in water. (c) Leachate shall be contained on site or properly treated prior to discharge. An NPDES permit may be required prior to the dis- charge of leachate to surface waters. (8) ACCESS AND SECURITY REQUIREMENTS (a) The site shall be adequately secured by means of gates, chains, berms, fences, and other security measures approved by the division, to prevent unauthorized entry. (b) An attendant shall be on duty at the site at all times while it is open for public use to ensure compliance with operational requirements. (c) The access road to the site shall be of all-weather construction and maintained in good condition. (d) Dust control measures shall be implemented where necessary. REMARKS: - DATE: NAME: (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS — (a) A site shall only accept those solid wastes which it is permitted to receive. (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. — (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as amended through January 1,1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. Copies of 40 CFR 61 may be obtained and inspected at the Solid and Hazard- ous Waste Management Branch, Division of Health Services, P. O. Box 2091, Raleigh, NC, 27602. (12) MISCELLANEOUS REQUIREMENTS (a) Effective vector control measures shall be applied to control flies, rodents, and other insects or vermin when necessary. (b) Appropriate methods such as fencing and diking shall be pro- vided within the area to confine solid waste subject to be blown by the wind. At the conclusion of each day of operation, all windblown material resulting from the operation shall be col- lected and returned to the area by the owner or operator.
