WITH A CROSS (X).
(1) PLAN AND PERMIT REQUIREMENTS
— (a) Construction plans shall be approved and followed.
(b) Specified monitoring and reporting requirements shall be met.
(2) SPREADING AND COMPACTING REQUIREMENTS
— (a) Solid waste shall be restricted into the smallest area feasible.
_(b) Solid waste shall be compacted as densely as practical into cells.
(3) COVER REQUIREMENTS
- (a) Solid waste shall be covered after each day of operation, with a
compacted layer of at least six inches of suitable cover or as
specified by the division.
— (b) Areas which will not have additional wastes placed on them for
12 months or more shall be covered with a minimum of one foot
of intermediate cover.
— (c) After final termination of disposal operations at the site or a
major part thereof or upon revocation of a permit, the area shall
be covered with at least two feet of suitable compacted earth.
(4) EROSION CONTROL REQUIREMENTS
(a) Adequate erosion control measures shall be practiced to pre-
vent silt from leaving the site.
(b) Adequate erosion control measures shall be practiced to pre-
vent excessive on-site.erosion.
(5) DRAINAGE CONTROL REQUIREMENTS
—(a) Surface water shall be diverted from the operational area.
— (b) Surface water shall not be impounded over or in waste.
(c) Completed areas shall be adequately sloped to allow surface
water runoff in a controlled manner.
(6) VEGETATION REQUIREMENTS
— (a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
— (b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
— (a) The separation distance of four (4) feet between. waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
(b) Solid waste shall not be disposed of in water.
— (c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
(a) The site shall be adequately secured by means of gates, chains,
berms, fences, and other security measures approved by the
division, to prevent unauthorized entry.
(b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.
(c) The access road to the site shall be of all-weather construction
and maintained in good condition.
— (d) Dust control measures shall be implemented where necessary.

(9) SIGN REQUIREMENTS
— (a) Signs providing information on dumping procedures, the hours
during which the site is open for public use, the permit number
and other pertinent information shall be posted at the site
entrance.
_— (b) Signs shall be posted stating that no hazardous or liquid waste
can be received without written permission from the division.
(c) Traffic signs or markers shall be provided as necessary to pro-
mote an orderly traffic pattern to and from the discharge area
and to maintain efficient operating conditions.
(10) SAFETY REQUIREMENTS
— (a) Open burning of solid waste is prohibited.
— (b) Equipment shall be provided to control accidental fires or
arrangements shall be made with the local fire protection
agency to immediately provide fire -fighting services when
needed.
— (c) Fires that occur at a sanitary landfill shall be reported to the
division within 24 hours and a written notification shall be
submitted within 15 days.
(d) The removal of solid waste from a sanitary landfill is prohibited
unless the owner/operator approves and the removal is not
performed on the working face.
— (e) Barrels and drums shall not be disposed of unless they are empty
and perforated sufficiently to ensure that no !iquid or hazard-
ous waste is contained therein.
(11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS
(a) A site shall only accept those solid wastes which it is permitted to
receive.
(b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by
the division.
(c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
(d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either;case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be,covered immediately with soil in a
manner that will nJfcause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-
ous Waste Management Branch, Division of Health Services,
P. O. Box 2091, Raleigh, NC, 27602.
(12) MISCELLANEOUS REQUIREMENTS
— (a) Effective, rector control measures shall be applied to control
flies, rodents, and other insects or vermin when necessary.
- (b) Appropriate methods such as fencing and diking shall be pro-
vided within the area to confine solid waste subject to be blown
by the wind. At the conclusion of each day of operation, all
windblown material resulting from the operation shall be col-
lected and returned to the area by the owner or operator.

.I visited the Graham County Landfill on October 20, 1986. I arrived at the
landfill at 9:30 a.m. and discovered a fire encompassing an area approximately
10' x 20' along the edge of the landfill's current lift. I was unable to find an
attendant or operator at the site.
I proceeded to drive to Robbinsville to inform.the County Manager, Roy Brooms,
that the landfill was on fire. Mr. Brooms did not seem alarmed at hearing about
the fire. He said that he would go to the landfill.in a "little while" to check on
the fire and went on to say that the operator should be back at the landfill site
"any time." When I questioned Mr. Brooms as to why his operator was not at the
landfill, he said that he had sent him out in the county to pick up a couple of old
refrigerators that the Graham County Health Department had complained about. I in-
formed Mr. Brooms that a written report would have to be filed with our Branch
concerning the fire.
I drove back to the landfill and observed Mr. Brooms covering the burning material
with soil. For the.most part, the fire was smothered out when I left the landfill
about 12 noon. As far as the cause of the fire, it was believed to have been
purposely set.
If further information or action is needed, please advise.

Dear Roy:
•I hope. -this.letter;. finds everything going well with .yoga: and the :County
today. As you no doubt ;guessed, I am writing about"our favorite.subject, the
landfill. Donnie Richardson and I had occasion to visit the Atoah site this
Tuesday, and we noted several things that should be called to your attention.
1. The area recently seeded:. -.is coming up,real,gooa. There are.9 couple
places where: the berm has been breached by rainwater runoff. This is'dausing
"erosion of the smoothed and seeded area and needs prompt attention.
2- Trail bikes have been riding all over the place, including the area
recently seeded, due to,the landfill being left open all the time. As.you
know, leaving the area open without an attendant on duty is in violation of
the State regulations as well as the landfill.permit, and is an open
invitation for illegal dumping of hazardous wastes. With some repairs to the
existing fence and gate, the landfill can be easily closed. We will be happy
to assist the Sheriff's Department in enforcing this closure if you will have
this done.
3. There has.been a_recent fire at the landfill, supposedly set by someone
while the area was..open-with no attendant on duty. An attendant is supposed
to -be .on duty at all times the ,land fill site is open. This. should not be a
problem if steps are taken to close the gate when the attendant `leaves, and
the days wastes have been covered prior to departure.
u. Mr. Grindstaff questioned us about what was he going to do with the
entrance road. The grade, surface, and drainage on it have it to the point
where any little rain makes it impossible to get trucks up to the lift area
without pulling them up with the dozer. Have you had your engineering firm
complete their review and design of the site based on the contour data
supplied by the Soil Conservation Service? It was our understanding that
thib'engineering"plan would incorporate roading, sediment ponds, planning to
maximize operations on the site, and final closeout planning. We certainly
want to be involved on this with your engineering folks. Any such plan will
also require State approval before implementation. The present situation
appears to be becoming critical, given the approach of winter.

5. We have heard some mention of additional area being needed at the
landfill site for fill material from Mr. Grindstaff. While we have not had a
formal request, we have looked at the site. It looks like there MAY be some
area on the right hand side looking upslope from the lift area to expand and
obtain some fill material. This area is not presently under permit, and will
require study as to suitability and impacts to the environment before
permission can be granted. If additional area is needed you should have your
engineering folks look at the site with the State and ourselves and then make
a formal application as far in advance of the time it is going to be needed
as possible.
You may also wish to have the State folks go over proper compaction and cover
procedures with your operators. We have heard this mentioned on numerous
occasions that improved compaction and covering would greatly reduce the
amount of fill material needed.
6. We are wondering, exactly where the County is now since the State's denial
of the proposed Cornsilk site and the filing of the appeal? As you know, the
Forest Service has been holding on any further proceedings as regard3 the
Cornsilk site, awaiting this decision from the State. In the event the
Cornsilk site is favorable with the State, we still will have some matters
concerning the environmental assessment and permit process that will involve
some time before this site could become operable. I want to be sure that you
and others will understand that the site will not be immediately available
and operable in event of the State's approval. (This is only a necessary
step along the way.) I would like to affirm what I have told you previously
- we stand ready to assist the County in looking for other alternatives
(private and public) in the event the Cornsilk site is denied.
Roy, I hope this letter will be of benefit to you in getting a leg up on the
situation at hand in these final days of your term in office. This letter
may also be useful to whoever may be elected in deciding on future courses of
needed action, so feel free to pass copies on to others as you see fit. This
entire situation will be one demanding their immediate attention, as I am
sure you are all too well aware. Feel free to call on me anytime we can be
of assistance.
