A Notice of Violation of 15A NCAC 13B .1626 (5)(d) was issued for not notifying the Division of a fire at the closed MSW Landfill. The notification has been received. 2. A Notice of Violation of 15A NCAC 13B .1626 (5)(b) was issued for previous open burning of landclearing material. This activity has ceased. This report indicated Notifications were no longer being issued at permitted facilities and directed you to obtain a Request for Authorization Letter (RAL) for the land clearing debris treatment and processing at the facility. In general this is a correct statement. However, in your case the RAL does not apply. The closed MSW landfill and, therefore, the permit have been inactive for many years. In this situation yard waste and land clearing debris treatment and processing activities are treated as if the facility has no permit. In that regard, to stay in compliance, you should continue to submit the annual notification form along with the required annual report as you have done in the past. Finally, I would like to point out the Yard Waste Notification is for the composting of yard waste only. If you are only grinding or mulching you should submit the Treatment and Processing Notification form. I apologize for any confusion and trouble this issue may have caused.
