Kirk, Jr., Secretary October 20, 1986 Mrs. Donna Crowell Clay County Manager Coinunity Services Building Hayesville, NC 28904 Dear Donna: I visited the Clay County Landfill and met with landfill operator, Calvin Ashley, on September 22, 1986. The purpose of this visit was to inspect the landfill and estimate the life expectancy of the current landfill. The final lift of the landfill is currently being utilized and based on Mr. Ashley's and my estimates, this lift will be completed in nine months to one year. If the county wishes to add another lift to the landfill, plan revisions will have to be submitted to and approved by the North Carolina Division of Health Services. Regarding the permitted landfill site presently being used for borrow material just across the road from the landfill currently being used by Clay County for waste disposal; a decision needs to be made as to future use of this area. So much soil has been removed from this site that if waste disposal is intended for this area, a revision to the existing landfill plan will have to be made. I would suggest that an engineer be contacted to determine if development of this area would now be practical. It may be that this area is suitable only for borrow material because so much soil has been removed. In either case, Clay County needs to act soon on one of the alternatives stated above. This is a direct violation of the North Carolina SOLID 6%ZASTE MANAGEMENT RULES. Please make arrangements to lock the gate at the landfill when an attendant is not on duty. Any violation of the N. C. SOLID WASTE MANAGEMENT RULES is subject to administrative action pursuant to G.S. 130-166.21E.
