On April 19, 1983, Mr. Julian Foscue, my supervisor, and I inspected
the Clay County landfill. We found problems with handling waste for A.C.I.
which involved the necessity of handling their waste in a separate area be-
cause wire found within their waste cannot be spread and compacted with
other waste due to damage which would result to the seals of track equipment.
We understand that this company plans to increase production of wire
which would worsen the problem. This situation can be resolved in one of
two ways. Either require that all wire be brought to the landfill completely
separate .from any other waste, in which case it could be placed separately
from normal solid waste and covered weekly, or no longer allow A.C.I. to
dispose of this wire at the landfill.

On June 14, 1983 and July 7, 1983 I inspected the Clay County
landfill in Hayesville, NC. This letter is to notify you that the
following violations of the N. C. SOLID WASTE MANAGEMENT RULES were
recorded on these two consecutive inspections:
1. Failure to restrict solid waste to the smallest area practical
[DHS Rule .0505(3)].
2. Failure to cover solid waste after each day of operation with
a compacted layer of at least six inches of suitable
cover [DHS Rule .0505(4)].
These violations must be corrected by proper operation in com-
pliance with the SOLID WASTE M41NAGE'�=- RULES and followed consistently
on a daily basis. I will reinspect this site on or soon after August 1,
1983 and record any violations found.
Any violations of the SOLID WASTE MANAGEMENT RULES are subject to
administrative penalties or injunctive action purusant to G.S. 130-166 21E.

Dear Mr. Anderson:
On June 14 and July 7, 1983, Mr. J. W. Moore, Jr., Waste Management
Specialist from this Branch.; inspected the Clay County Landfill near Hayesville,
N.C. Mr. Moore notified..yqu by his letter of July 19, 1983, of the violations
that those inspections .r.evealed and of the date by which those violations were
to be corrected. A copy -:of that letter is attached. Mr. Moore conducted a
follow-up inspection on August 8, 1983, and recorded the following violations
of the North Carolina Solid Waste Management Rules:
1. Solid waste in the landfill was not restricted to the smallest area
practical, as required by 10 NCAC lOG .0505(3).
2. Solid waste was not covered at the end of the day of operation with a
compacted layer of at least six inches of suitable cover, as required
by 10 NCAC 10G .0505(4).
You are hereby requested to correct the above violations by no later than
September 5, 1983. If you fail to do so, an administrative penalty will be
assessed against you. The Solid Waste Act authorizes assessment of an adminis-
trative penalty of up to $500.00 for a violation of the Act or regulations
promulgated pursuant to it.

Dear Mr. Patterson:
This letter is in response to your request for a hearing dated October 21, 1983.
The request will be forwarded to the Hearing Officer for the Division of Health
Services and you will be notified of a hearing date and location. This Branch
opposes your request that the hearing be held at the landfill in question. You
are within your rights to request that the hearing officer view the site; however,
it is this Branch's opinion that such a viewing would be irrelevant because the
penalty was assessed for the condition of the site at the time of the September 20,
1983,.inspection and the present or future condition of the site is not at issue.
I want to emphasize that Mr. Moore had inspected the site three times previously
on June 14, 1983, July 7, 1983 and August 8, 1983 and found similar violations on
all three inspections. Inspection reports were made on all three occasions and
were received by George Anderson. Our records contain no letters from Mr. Anderson
or anyone else claiming that these reports were erroneous. Furthermore, Clay County
was requested to improve the ongoing operation of the site by letters from Mr.
Moore (July 19, 1983) and Mr. Glenn Dunn (August 22, 1983), and no letters of protest
were received.
It is the practice of this Branch to inform landfill operators of violations and
provide liberal opportunity for compliance. Such has been the case in this matter,
but the Clay County landfill continued to be in violation of the operational
standards according to Mr. Moore's September 20, 1983 inspection.
You should receive in the near future a notice of the date, time and location of
a hearing. If you have additional questions or wish to discuss the matter further,

NOTICE OF ADMINISTRATIVE PENALTY

Dear Mr. Anderson:
Pursuant to N.C.G.S. 130-166.21(E) and to 10 NCAC lOG .0701-.0707, this letter
is to inform you that an administrative penalty has been assessed against Clay
County for the following violation.
On June 14, 1983, July 7, 1983, and August 8, 1983, Mr. J. W. Moore, Jr.,
Waste Management Specialist for the North Carolina Solid and Hazardous
,Taste Management Branch, inspected the Clay County Landfill and observed
two violations of the North Carolina Solid Waste Management Rules. By
letter from Mr. Glenn Dunn dated August 22, 1983, you were notified of
those violations and requested to correct the violations by September 5,
1983. (A copy of that letter is enclosed.) On September 20, 1983, Mr.
Moore re -inspected the landfill and.observed the following violations:
(1) The solid waste was not being restricted to the smallest area
feasible, as required by 10 NCAC lOG .0505(3).
(2) The solid waste was not covered at the end of the operating
day with six inches of compacted suitable cover or other
manner specified by the Division, as required by 10 NCAC lOG
.0505(4).
(3) No attendant was on duty while the landfill was open for public
use, as required by 10 NCAC lOG .0505(9).
The penalty assessed for the above violations is two hundred dollars ($200.00).
The assessment of this administrative penalty is effective upon our mailing of
this notice. Please be advised that pursuant to N.C.G.S. 130-166.21(E), each
day that a violation continues constitutes a separate violation for which an
additional penalty may be assessed. If the violations are not corrected by
October 20, 1983, an additional penalty will be assessed for each subsequent
day the -violation continues.
