Dear Mr. Jordan:
In accordance with the Solid Waste Management Rules and
consistent with current policies and legislative goals to ensure
adequate capacity of environmentally -protective solid waste
disposal facilities and to encourage regional approaches to solid
waste management, the Solid Waste Section hereby approves an
amended service area for the referenced facility. The approved
service area is defined by the resolution for local government
approval adopted by the Cherokee County Board of Commissioners on
June 21, 1993 (Attachment).
This approval is contingent upon strict adherence to the
following implementation schedule detailing transition from the
existing unlined landfill unit to operation of a lined landfill
unit:

A contingency plan for disposal of waste into an alternative
lined landfill shall be implemented if this schedule is not met.
The proposed lined MSWLF unit shall be subject to all the
permitting requirements for a new MSWLF unit in accordance with the
recently adopted MSW Rules.

In addition, the referenced landfill shall meet the following
conditions:
(1) Disposal shall be in accordance with the approved
construction plans
(2 )—The grou-n- dwater monitoring system shall be upgraded
to include replacement of one well and installation
of two new wells at locations and depths approved
by the Section, within 90 days of this approval.
(3) Solid waste which is currently being disposed in a
lined landfill or an incinerator shall not be
accepted for disposal.

' RESOLUTION TO ESTABLISH
'A REGIONAL LANDFILL
the State of NorthCarolina requires local governments to provide adequate solid
waste disposal facilities for its citizens;
WHEREAS, the counties of Clay, Graham, and Swain desire to close their solid waste disposal
facilities due to the high cost of maintaining these facilities under the new subtitle "D" rules
taking effect October 9, 1993;
WHF_RF_ri.S, Cherokee County has sufficient facilities available at the Cherokee County Landfill
to accept and dispose of solid waste from the three aforementioned counties;
WHEREAS, the State of North Carolina requires that the Cherokee County Landfill permit be
revised or re -issued to allow disposal of solid waste from the Counties of clay, Graham, and
Swain;
NOW BE IT RESOLVED by the Board of Commissioners of Cherokee County, North Carolina,
that the Cherokee County Landfill will henceforth be operated as a Regional Solid Waste
Disopoal facility.
BE IT FURTHER RESOLVED that out -of -county waste accepted for disposal at the Cherokee
County Landfill be limited to that generated by the Counties of Clay, Graham, and Swain.

Ref: Cherokee County Request for Task Force Evaluation
A Task Force is being formed to assist Cherokee County with their landfill site selection process. The
county's engineer, Municipal Engineering, will be forwarding maps and other preliminary data to the
Section shortly. I will forward copies of all information received�to you.
The tentative date for the site visit is 9:00 am, Wednesday, January 5, 1994.
In addition to Ground Water, Water Quality, and Public Water Supply, I have invited the following
agencies to participate:
• Natural Heritage Program - Division of Parks and Recreation
• Historic Preservation Office - Division of Cultural Resources
0 Forest Resources - Division of Forest Resources
• Habitat Conservation - NC Wildlife Resources Commission
• Water Quality Planning - Division of Environmental Management (Wetlands)
All of these agencies have indicated that they will participate in the Task Force by reviewing the
preliminary information and attending the site survey, if possible.

The following enclosed items have been provided by Cherokee County for Task Force Participant's use
in evaluating the site:

In order to promote the effectiveness of the Task Force, the Solid Waste Section requests that all
agency comments be submitted to my attention within 7 calendar days following the site visit.
Comments should provide a preliminary assessment of the site, relative to your agency's regulatory
interest or expertise. Agencies that are providing comments based upon the preliminary information
only (without site visit) are encouraged to return their comments to me as early as possible.
The Solid Waste Section will compile comments and will issue a summary cover letter with the
comments attached. The comments and observations of the Task Force are intended to provide local
decision makers with state agency information and technical advice to be considered in their site
selection process.
