OBSERVED VIOLATIONS:
None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS:
01 - Facility has good security, chain link fencing with locking gates. Also has a good water source to fight fires or to use if moisture is needed in the compost windrows. 02 - Has signage at entrance and directional signage. Need to replace emergency contact number.
03 - Roads are made of all-weather construction. 04 - Setbacks appear to be in compliance. 05 - Temperature records are being kept and were not reviewed. 06 - Wind rows are kept small for easier management. Put 07 - Adequate fire lanes around all windrows. 08 - Some of the finished compost is being used for a community garden to feed the homeless and soup kitchens. 09 - This garden is on the same tract of land as the Yard Waste Notified Facility. Started recently. 10 - The Parks and Recreation Department will be using the rest of the compost at this time. An agreement has been made with DOT also for use in their areas. 11 – Facility has added rock on the access road /fire lanes. 12 - Facility management appears good during this facility inspection. 13 - Other signage is scheduled to be added this month. 14 – Facility has added Permanent Edge of Waste Markers to ensure the facility dosen’texceed the less 2 acre rule for notified facilities. If you exceed the 2 acre rule, you will have to apply for a PERMIT.
15 - Continue efforts to keep good vegetation on the outer berm. 16 - Processed material looks really good. 17 - Digital pictures taken during this inspection. Some are attached to this report.
