The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Boundaries of the 2-acre notified area and edge of waste “EOW” needs to be more visibly and permanently marked. This is needed for the inspector to know what the corners are during inspection as well as for the owner
and anyone working or dumping in the landfill to know where its permitted to dump. Suggest long PVC pipe, can be painted at top. Be sure the corners are in the correct location and the footprint meets buffers. 50 feet from the waste boundary to all surface waters of the state as defined in G.S. 143-212 and 100 feet from the disposal area to property lines, residential dwellings, commercial or public buildings, and wells. 2. 15A NCAC 13B .0563 (1) (a) - The facility is to be operated for the disposal of land clearing waste, inert
debris, untreated wood, and yard trash. Operations must be consistent and in compliance with the local government solid waste management plan as approved by the Division of Solid Waste Management. A piece of painted wood and a tire were discovered and removed while Section Staff was present onsite. Screen loads to be sure no unapproved waste make it into LCID.
3. Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. The working face was vertical and long at the time of this inspection. Also, this waste should be brought back onto the LCID, compacted, soil covered and sloped at 3:1. There was about ~ 50 feet to what Mr. Dawson indicated
was the back two corner edges of 2 Acre Notification. (A scrap piece of rebar and a T post were barely visible. Please add better EOW markers.) There should be sufficient room to fix the vertical working face back into a proper working face. A proper working face should have waste dumped back to front, and covered once the
working face reaches one acre in size or the time from any waste being in the LCID 30 days, whichever occurs first. The waste should be compacted and the landfill built with a sloping grade of at least 3:1. 4. 15A NCAC 13B .0566 (11) - Solid waste shall not be disposed of in water. Water was observed ponding at the backside toe of the vertical working face at the time of this inspection. While no waste was observed in water, due to access for staff to inspect backside working face, the area should be properly covered and graded to allow positive drainage of water away from the disposal area. 5. 15A NCAC 13B .0566 (4) - Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first. Facility staff must ensure that waste is covered as required by the above rule.
6. 15A NCAC 13B .0566 (9) - Access roads shall be of all-weather construction and properly maintained. Access road around the LCID, on North East side, which also goes into the area being mined, needs to be
opened. There was soil drying that prevented staff from easily accessing to backside of LCID. Vehicles could not drive around to North East side of LCID, although there was access to top of the LCID. It’s important to have access, should the LCID catch fire and firefighting equipment needs to respond.
7. Within one calendar year 75% of all recovered materials shall be processed and recycled/removed from the site. This is relevant to the concrete recycling onsite. 8. Corrective measures are necessary as a result of the findings of this inspection and must be completed within 30 day’s receipt of this report. Please fix the vertical working face, cover properly and slope to 3:1. A follow up will be completed to inspect if the correct measures have been done. EOW need to be installed on all four corners as well as to ensure buffers are met. Roadway needs to be fixed and of all-weather construction. 9. Discussed drillers mud while onsite. Cannot be taken at NLCID. David sent owner Drillers Mud Guidance in email following day after inspection. Owner should discuss with permitting if further questions or needing more guidance.
