Based on a review of our records and discussions with Division of Water Quality (DWQ) staff, we have confirmed that the Yard Waste Center is currently covered under NPDES Stormwater Permit COC No. NCG120007. This permit was obtained in 1993 and covers the entire landfill operation including the Landfill, Yard Waste Center, and the Vehicle Maintenance Shop (see enclosed Certificate of Coverage, accompanying site map, and General Permit). In a phone conversation, DWQ staff member Michael Myers, confirmed that our stormwater permit is current and valid through August of 2002. I hope this addresses your needs. The inspection was conducted on November 28, 2000. The inspector noted that some areas of the Yard Waste Center were in need of seeding. These areas include areas where the City is currently grading in preparation for placement of windrows. This comment is fairly minor in nature and the City will comply. We have had telephone discussions with Mr. John Holley, P.E. the Regional Engineer for the NCDENR Land Quality Section. We discussed the stormwater and Erosion and Sediment Control Permits for the Yard Waste Center and Landfill. Mr. Holley indicated that since an Erosion and Sediment Control Permit was issued for the Yard Waste Center prior to 1995, the site is not currently listed under the general stormwater permit for related activities. Since 1995, such a general authorization is automatically provided with an approved Plan. The Yard Waste Center does not have a NPDES Permit separate from the Wilders Grove Landfill. Mr. Mark Senior, Stormwater Engineer with the City of Raleigh, is in contact with DWQ to discuss the stormwater permitting requirements for this type of facility. Mr. Senior expects to have a resolution shortly. We will then inform you of the type of stormwater permit required. The City will submit the permit to the Composting and Land Application Branch as soon as it is issued. During our telephone conversation, Mr. Holley indicated that he would schedule on of his staff to conduct an inspection of the Yard Waste Center within the week. A copy of the inspection report will be forwarded to you as soon as it is received from Land Quality. If you or your staff have any questions or require additional information, please contact us. Hazen and Sawyer has prepared responses to each individual comment using the numbering system used in your letter, which is attached. Where appropriate, we have attached revised pages or sections for your review. Also included is discussion of additional or updated information provided on the Application Drawings. 1. Responses To DENR Comments 1. The Division of Land Quality has not recently inspected the Yard Waste Center. Inspections for compliance with the approved Erosion and Sediment Control Plan have been made on several occasions by Mr. Tim Liles. Mr. Liles is the Conservation Inspector Supervisor for the City of Raleigh and is responsible for inspections for erosion control, surface water and related items. During his site inspections, Mr. Liles identified several areas where minor work was required. In his latest inspection completed on August 3, 2000, Mr. Liles indicated that the site is in compliance with the approved Plan. Mr. Liles's inspection reports are attached. 2. The stream nearest to the Yard Waste Center is Crabtree Creek (Meuse River Basin). According to published stream classification information provided by NCDENR, Crabtree Creek in the vicinity of the site is classified as "C NSW". 3. The City of Raleigh has prepared an information handout available to all users of the materials processed for distribution at the Yard Waste Center. Since all of the materials are bulk in nature, no product labels have been prepared. A copy of the handout is attached. A copy of the handout is attached. 4. Management of unacceptable materials is addressed in the Operations Plan. If a load of unacceptable material is received and noted by the scale house operator or spotter, the load is rejected and removed from the site by the hauler (Section 1.5). City crews that pick up residential yard waste on the designated day of the week are directed to reject unacceptable material or remove such material prior to loading (Section 2.5). Unacceptable material found in small quantities in the material to be processed is removed before grinding if at all possible (Section 1.5). Such material is generally stored in roll off containers owned by the City. These containers are located adjacent to the , Warmth For Wake storage area east of the scale house. The containers are hauled to a landfill as needed. 5. The "Proposed Operations Layout Plan", Drawing G3 of the Application has been revised to show the location of the tub grinder, public receiving area, pallet area, and curing area. It should be noted that the tub grinders are mobile and are periodically moved as necessary to most effectively process incoming or stockpiled material. The location shown on Drawing G3 is a typical location only. Revised Drawing G3 is attached. As outlined under response to Comment No. 4 above, unacceptable materials not removed by the hauler are stored in roll -off containers. The containers are spotted as required to manage the material removed. City staff can spot the containers in any location needed to effectively manage rejected material. As such, no designated "unacceptable material management area" is needed. 6. Oversized materials from the compost screening process are normally returned to the tub grinder and placed into windrows. Depending on the nature and quantity of material processed through the screen, oversized materials are sometimes placed directly into windrows without additional grinding. The flow chart in Section 1.3 of the Operations Plan has been revised to reflect this. Revised page S of the Operations Plan is attached. 7. Temperature of the windrows is measured by Yard Waste Staff using 4-foot long Reotemp Compost thermometers. The thermometers are always inserted to full depth to monitor temperature. After each measurement, the thermometers are removed from the windrows and allowed to cool down below 80' F before the next reading. On hot days, the thermometers are kept in an air-conditioned truck to lower the temperature. Temperature readings are taken every 50-feet along the windrow. This information has been inserted into Section 2.5 of the Operations Plan. Revised page 17 of the Operations Plan is attached. Compliance with time and temperature requirements of .1406(10) has been added to Section 2.5 of the Operations Plan. Revised page 17 of the Operations Plan is attached. 9. The City does not use manure as a nitrogen source for the compost and has no plan to do so. The reference to the use of manure in Section 8 of the Operations Plan has been removed. Revised page 27 of the Operations Plan is attached. 10. The City of Raleigh Fire Department (RFD) is responsible for responding to any fires at the Yard Waste Center. A letter from the RFD is attached. 11. Annual Reports submitted by the City will show quantities in tons. This has been clarified in Section 4.0 of the Operations Plan. Revised page 20 of the Operations Plan is attached. 2. Additional Information The City of Raleigh has recently completed a boundary survey of the Yard Waste Center, Wilders Grove Landfill and surrounding parcels owned by the City. The property lines provided on the Application Drawings submitted in April 2000 have been slightly revised. The modifications to the property line do not affect the permitted boundary of the Yard Waste center itself. The Local Area Study Map, Drawing G1 and Existing Conditions Site Plan, Drawing G2, showing the revised boundaries, are attached. Drawing G1 has also been updated with the latest utility locations provided by the City's Utilities Department. The locations of water, sewer and gas lines within the study area are shown. During this process, two residential water supply wells were identified on adjacent properties. These wells are located in excess of 1000-feet east of the Yard Waste Center. These wells are shown on the revised Drawing G1. It should be noted that the facility still is in compliance with the Section .1404 Siting Criteria as outlined in Section 2 of the Application.
