PURPOSE OF SITE VISIT: Routine STATUS OF PAST NOTED VIOLATIONS: None noted on the previous inspection report.
OBSERVED VIOLATIONS:
1) Ponding of septage noticed on Field 2. See picture below. The ponding of septage is a violation of Rule
.0842(a)(7) that states “septage shall be applied to the surface of the land from a moving vehicle to
have no standing liquid or soil disturbance resulting from the waste flow after the discharge is
complete.” Need to improve application method such as increasing the speed of the vehicle when
applying.
2) pH of the ponded septage was not at 12. The failure of the septage to be at a pH of 12 is a violation of
Rule .0842(c)(1) that states “domestic septage shall be treated in accordance with the requirements in
40 CFR 503 D (including Appendix A and B) except that 503.33(b)(11) is not incorporated.” 40 CFR
503.32 (c)(2) of Subpart D states “The pH of domestic septage applied to agricultural land, forest, or a
reclamation site shall be raised to 12 or higher by alkali addition and, without the addition of more
alkali, shall remain at 12 or higher for 30 minutes and the site restriction in §503.32 (b)(5)(i) through
(b)(5)(iv) shall be met.” Need to ensure that the septage is at a pH of 12 when land applied.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1) The “No Trespassing” sign present as you turn down the access road from Lane Farm Road. The
“Septage Disposal Area” sign is present along the access road before you get to Field 1.
2) The access road needs some repairs. Access road had several potholes.
3) Markers present and visible on Field 2. Recent applications were to Field 2.
4) All septage discharges appeared to be within the permitted boundaries of Fields 2.
5) Some ponding noticed on Field 2 after a recent application. Randy Register was leaving the site as I was
entering. As noted in the Observed Violations Section above, the ponding of septage after the
application is complete is a violation of Rule .0842(a)(7). I also checked the pH of the ponded septage.
The pH of the ponded septage was not at 12. This is a violation of Rule .0842(c)(1) as stated above in the
Observed Violations. Please adjust your application method so that there is no ponding after the
application and be sure to check the pH of the septage to make sure that it at a pH of 12 when applied.
6) Rye was present on the field.
7) Slight odor noticed where the septage had been applied.
8) No setback issues noticed.
