PURPOSE OF SITE VISIT: Permitting STATUS OF PAST NOTED VIOLATIONS: NONE
OBSERVED VIOLATIONS:
1) Upon review of the land application records submitted with the package for permit renewal, it was
noted that the permitted maximum annual application rate of 198,000 gal/ac/yr was exceeded by
14,000 gal/ac in 2016 for Field 1. The exceedance in the maximum annual application rate is a
violation of Rule .0842(b)(1) that states “Maximum land application rates for septage shall be
determined based upon the following: (1) domestic septage land application rates shall be in
accordance with 40 CFR 503.12(c).” The maximum annual application rate for this site is noted in
Permit Condition 7 as “The maximum annual application rate shall be 198,000 gallons per acre per
year…”
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1) Site visit conducted to review the records and nutrient management plan submitted for permit renewal.
2) Upon review of the land application records submitted with the package for permit renewal, it was
noted that the permitted maximum annual application rate of 198,000 gal/ac/yr was exceeded by 14,000
gal/ac in 2016 for Field 1. The maximum application rate to Field 1 in 2017 was 150,400 gal/ac which is
47,600 gal/ac less than the permitted maximum annual application rate of 198,000 gal/ac/yr. Thus,
considering the overage of 14,000 gal/ac for Field 1 in 2016 and the underage of 47,600 gal/ac in 2017,
there is no exceedance to account for after 2017. No other overages noted upon review of the records.
Gave copy of an updated Excel workbook for which it should be easier to track how much that has been
applied to a given field within the year. It also tracks the remaining balance that can be applied within
the year.
3) Need to be sure to record the time of discharge. The time of discharge was missing from July 2016
through 2018.
4) Reviewed the nutrient management plan with Billy. Encouraged him to include all crops that he may
plant on the fields. Also, the residual nitrogen calculations needed to be recalculated to reflect the most
recent waste analyses. Received an updated nutrient management plan on 08/26/2019.
