HomeMy WebLinkAbout47A-HokeCoLCIDLF_Request_RevisePermitConditions_FID1404152_202004271 Chao, Ming-tai To:Dan Koliba Cc:Stanley, Sherri; Powell, David C; Hammonds, Andrew; Frost, Larry Subject:RE: [External] Hoke County LCID Dear Mr. Koliba:   After reviewing the 5-year permit to operate (permit) dated July 11, 2018 (FID 1223758) and the approved documents, the Solid Waste Section makes the following decisions on you requests of revising Permit Conditions No. 17 and 32: Permit Condition No. 17 Permit Condition No. 17 (Part V, Attachment 3 of the permit) states that “Solid Waste must be covered with 1- foot of suitable soil cover at least once per month or when the active area reaches 1 acre in size, whichever occurs first, or more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown materials, vectors or excessive infiltration.” Hoke County requests to revise the permit condition to the term as follow: “Solid waste must be covered with suitable cover when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown material, vectors or excessive water infiltration.”    Regarding the LCIDLF cover requirement, NC Solid Waste Management Rule 15A NCAC 13B .0566(4) states “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” The Section 6 of the approved Operation Plan (FID 1079351) reiterated the same rule requirement on Page 5. The SWS agrees County’s request to eliminate the “rigid” thickness from the permit language, but County’s request is missing the rule-required cover frequency. Please revise the cover requirement by adding the rule- required minimum frequency. Permit Condition No. 32 Permit Condition No. 32 (Part VII, Attachment 3 of the permit) states that “The volume of material that will be processed and stored must be contained within the 0.5-acre wood grinding area and one (1) acre wood storage/stockpile area shown on drawing included in approved operation plan.” Hoke County requests to revise the permit condition to the term as follow: “The volume of material that will be processed and stored must be contained within the one (1) acre grinding area and one (1) acre wood storage/stockpile area shown on drawing included in approved operation plan.”  The drawing Sheet No. 3 of 7 of the Approved Permit Application (FID 1079351, see attachment) shows the wood grinding area is 0.5 acres in size and sandwiched by a 0.85-acre wood storage/stockpile area to the north and a 0.65-acre wood storage/stockpile area to the south. Based on the finding, the SWS will revise the permit language after the County resubmit the revised drawing and operation plan (as needed) to show the correct footprint of wood grinding area and wood storage/stockpile area – one acre each.
