Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. The facility, as currently permitted, consists of one 4,000-gallon and one 14,000-gallon above ground steel tanks for a total capacity of 18,000 gallons for the storage of domestic septage and grease septage. 2. According to staff, the existing 4,000-gallon tank actually has a capacity of 3500 gallons. 3. Setback requirements have been met. 4. There appeared to be no septage in the new tank. No leaks or spills were observed from the existing permitted tanks. 5. No vegetation was observed around the tanks allowing for easy access and inspection. 6. A new tank was observed on site but has not been used or placed in location. Using a measuring wheel, setbacks were checked for permanent placement. This tank is 4,000 gallons and cannot be used until a permit modification is issued by the Solid Waste Section. Total capacity will be 21,000 gallons. A capacity over 25,000 gallons would require double the current setbacks unless there is 100% secondary containment. A pre-operational inspection will also be required.
