P-5719 Phase IB, second phase of the development of the Charlotte
Yard, Locomotive and Railcar Maintenance Facility (LRMF) in
Charlotte, NC
Date: Wednesday April 1, 2020
Participants: Craig Newton, DOT Rail Division, Kevin Miller and Charles Lavender III, DOT
Geotechnical Engineering Unit, Abner Buddy Riggs, Jr. and Allison Stenger, Terracon, Carolyn
Minnich, Brownfields (BF) Project Manager, Matt Bramblett and David Graham, Hart &
Hickman, and Gordon Box DOT GeoEnvironmental Section.
Notes:
- LRMF Phase IA work is complete.
- Design work for Phase IB will begin in June 2020.
- 25% plans are anticipated to be available early 2021.
- No additional right of way is anticipated to be acquired.
- Craig Newton would like to begin Geotechnical work, while Geoenvironmental work is
anticipated to be conducted after design work.
- The Design is anticipated to include a significant soil cut. Thus, a cut will be required during
construction and for installation of proposed drainage features. Some of that cut is anticipated to
be in the Brownfields property. After 25% plans are available, H&H are anticipated to be tasked
with geoenvironmentally delineating (horizontally and vertically) the extent of RCRA Hazardous
material (i.e. lead highly impacted soil) that requires removal and to be tasked with developing a
work plan to excavate and dispose of that material. (On the Phase IA project, there was a benefit

to treating the excavated material, thus, reducing the leachable lead content, so the material
would no longer be classified as RCRA Hazardous material, and that operation was conducted
and the soil was therefore disposed at a local landfill, rather than being shipped out of state to a
landfill that could accept material classified as RCRA Hazardous material. Also, the side slope of
the proposed grade was over-excavated approximately 2' and backfilled with clean material. It is
anticipated similar scope of work could be performed for Phase 1B). Geoenvironmental work by
H&H would also likely include culvert excavation testing to the invert (~20' below existing
ground surface) along the entire project, some of which may lie within the Brownfields, and
some of which may lie in known or unscreened but suspected areas along the project (previous
investigations stressed detecting right of way acquisition contamination issues; with a proposed
design, other sampling may be appropriate, upon review).
- H&H will need 25 % plans to prepare a scope of work for additional Phase II activities for BF
and non-BF properties.
- No Geotechnical test borings are anticipated to be conducted on the Brownfields (BF) property.
However, Geotechnical workers will notify H&H and the GeoEnvironmental Section if that plan
changes.
- Geotechnical workers reviewed and scoped geoenvironmental concerns and responsibilities
with GeoEnvironmental workers.
Action items include:
- Terracon will establish an independent Health and Safety Plan for the Geotechnical work.
- Terracon will conduct the Geotechnical work (having conducted the previous LRMF
Geotechnical work).
- Carolyn Minnich will confirm if the existing Environmental Management Plan (EMP) is
sufficient and relevant for proposed geoenvironmental sampling and geotechnical test borings
(relevant if geotechnical borings need to be added to the scope).
- Craig Newton will confirm with Norfolk Southern Railroad (NSR) the applicability of the
existing or if there is need for a new environmental access agreement(s) for the minor grading
excavation proposed within NSR ROW.
- For BF property sampling, H&H will need to prepare a work plan for the BF program. (A new
EMP might be needed for sampling, and/or Geotechnical test borings (if any to be done in the
Brownfields Property) pending review of the current EMP by Carolyn Minnich).
- H&H will conduct Geoenvironmental work (having conducted the previous LRMF
Geoenvironmental work).
- H&H will need to prepare a new EMP for construction activities for BF property.
- Carolyn Minnich emphasized that no soil cuttings from outside of the Brownfields property
should be brought into the BF Property, and if soil is sampled on the BF property, then all
cuttings must be contained and disposed properly offsite, and the cap must be maintained and
repaired as needed; The cap is a significant Land Use Restriction issue. Therefore, if sampling or
conducting Geotechnical work on the BF property, workers will need to patch borings with
asphalt or concrete and drum cutting and dispose of soil and properly abandon test borings so the
existing and proposed elevations are protected.
- Geoenvironmental sampling/Geotech work (if any) disturbance and maintenance of the cap
must be documented in the Brownfields Property annual Land Use Restriction Update (LURU).
Miscellaneous Notes:
- H&H has provided Parcel 31 PSA report to DOT for Terracon, other reports are available for
Terracon on DEQ portals and NCDOT server.
- Zoladz (construction contractor for Phase 1A) continues to lease office/yard off of Summit Ave.
- A contractor is still using the BF Property for a laydown yard area and is scheduled to do so for
another year (this required BF Program permission and updates in the annual Land Use
Restriction Update).
