Expires July 11, 2023. PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: 1. Permit Attachment 3, Part VII, 33 - If wood material/mulch containing yard trash is provided to the public, the permittee must submit a plan for composting the yard trash in accordance with the requirements of 15A NCAC 13B .1400, et. seq. At the time of this inspection, the processed waste in this area was being loaded into dump trucks and removed by 401 Sand. Hoke County Staff, stated that the waste was being disposed of in the 401 Sand NLCID. Hoke County staff need to ensure that this waste is not being distributed to the public without first going through the correct composting process. Any changes in operations need to be submitted to the Division for review and approval before initiating. Permit Attachment 1, Part I, 8 - The edge of the waste footprint for all disposal units must be identified and maintained with permanent physical markers. At the time of this inspection, waste was observed along the edge of the road and beyond the Edge of Waste (EOW) markers. EOW markers were not being maintained so that SWS staff could determine where the EOW was located and must be repaired. 3. 15A NCAC 13B .0563 (1) (a) - The facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood, and yard trash. Operations must be consistent and in compliance with the local government solid waste management plan as approved by the Division of Solid Waste Management. Unapproved waste such as painted block, a tire, plastic etc. were observed during this inspection and must be removed. Remove and dispose of properly, and keep documentation of removing these unapproved wastes. 4. (Land Clearing and Yard Waste Debris Processing Conditions) Permit Attachment 3, Part VII, 32 - The volume of material that will be processed and stored must be contained within the 0.5-acre wood grinding area and one (1) acre wood storage/stockpile area shown on drawings included in approved operation plan. At the time of this inspection, it appeared that the area had reached the maximum size for the grinding area and stockpile area and waste was being removed by 401 Sand. Please contact permitting if you would like to increase the size limits of the approved areas. ADDITIONAL COMMENTS 1. The sign at the entrance sign at the entrance to the facility was correct. It contained the permit number for the transfer station and the LCID. The emergency contact number is “911’, consider adding a 24/7 County contact number as well. The gate at the entrance was unlocked at the time of this inspection. 2. An attendant shall be on duty at all times while the landfill is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes. Recommend that facility staff accompany customers to the LCID or YW areas when dumping to better screen waste to ensure only acceptable waste is received. 3. Trees and shrubs must be removed from the inactive area and active area of the LCID to include slopes and drainage areas. 4. Permanent EOW markers should be reinstalled to define the limits of the waste and must be visible one to the other. Any waste dumped beyond the EOW must be placed within the limits of the landfill upon observation. 5. Solid waste must be covered with 1-foot of suitable soil cover at least once per month or when the active area reaches 1 acre in size, whichever occurs first, or more often when necessary to prevent the site from becoming a nuisance or to mitigate conditions associated with fire, windblown materials, vectors or excessive water infiltration (PTO, General Conditions, Cover Material Requirements # 17). Any changes to this permit condition as far as the amount of soil should be submitted to and approved by the permitting section staff. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical foot (3:1) unless previously approved by the Section. 7. While onsite, an attendant removed some unapproved waste from yard trash processing area. Good job. 8. Corrective measures are necessary as a result of this inspection. A follow up inspection will be conducted about 30 days after sent date of this inspection. Remove trees and unapproved Painted block should be removed then waste leveled off waste. Allowing waste to be dumped at front will stop and covered in LCID. Traffic from entering LCID and disposing of the waste evenly across the LCID. Cover is needed after trash removed. Needs pushing into EOW and then graded 3:1 and proper cover.
