Grading Charles Gerstell, NCDEQ – Solid Waste Section STATUS OF PERMIT: A Yard Waste Notification Facility Renewal Form was approved by the Solid Waste Section on June 4, 2015. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. The facility consists of a Notified Yard Waste Facility approved for the collection and processing of land clearing debris only as described in the approved Yard Waste Notification Facility Renewal Form. 2. A gate was located at the entrance to facility to prevent unauthorized access. 3. The access road was of all-weather construction and well maintained. 4. No unacceptable waste streams were observed. 5. The facility is not open to the general public for the disposal of land clearing debris. 6. Steel stakes with bright, orange markers were in place to designate the facility boundaries of the operational area. 7. Only two small loads of unground waste were on site at the time of inspection. 8. Mr. Walker explained that grinding operations took place approximately 2-3 weeks prior to inspection. 9. Ground mulch had been placed on an exposed slope for stabilization and remaining material had been graded to address wet soil conditions due to recent heavy rains. 10. The operational area appeared to be less than 2-acres in size. 11. During the inspection, an area of beneficial fill was observed on the left side of the access road approximately 200- feet to the east of the operational area. Waste observed consisted of un-painted concrete. Mr. Walker explained that no additional filling was needed. 12. It is recommended that a clear, unobstructed path be maintained to any erosion and sedimentation control measures such as the sediment basin located on the south side of the site to allow for maintenance of the devices. 13. It appeared that all required buffers were being maintained. Please pay special attention to the setback from property boundaries at the southwest corner of the. This is the location where the facility activities are nearest to the property boundary.
