PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 15A NCAC 13B .1626 OPERATIONAL REQUIREMENTS FOR MSWLF FACILITIES: (2) Cover material requirements. (a) Except as provided in Sub-Item (b) of this Item, the owners or
operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging. (b) Alternative materials of an alternative thickness (other than at least six inches of earthen material) may be approved by the Division if the owner or operator demonstrates that the
alternative material and thickness control disease vectors, fires, odors, blowing litter, and scavenging without presenting a threat to human health and the environment, in accordance with 40 CFR Part 258.21. A MSWLF owner or operator may apply for a generic approval of an alternative cover material, which would extend to all MSWLF units. (c) Areas which will not have additional wastes placed on them for 12 months or more, but where final termination of disposal operations has not occurred, shall be covered with a minimum of one foot of intermediate cover.

ADDITIONAL COMMENTS: 01 - Permit to Operate was issued on December 10, 2019 and Expires on October 08, 2053. Reviewed on Laserfiche. 02 - Facility has signage at entrance with required information. 03 - Directional signs are present. 04 - Facility is secured by locking gates and fencing. 05 - Interior roads are constructed of all-weather materials and maintained well. Water was being added to prevent dust issues. 06 - Facility is permitted to receive waste generated by and in North Carolina.
07 - Several small leachate and gas line installation/repair areas are in need of attention. When repairs/installations are done, all waste should be covered and seeded as soon as the repair/installation is completed to prevent exposed waste and possible windblown trash and erosion. 08 - New grass matting has been applied to some bare areas. Need to work smaller areas. 09 - There is a large amount of windblown trash coming from the new cell. Screens and fencing are being used but not capturing windblown trash nor was the windblown trash picked up by the end of the working day. John College was on-site at 7:15 am (facility opens at 7 am.) and found this large amount of windblown trash on the East side of the new cell. A small amount of windblown trash was in standing water which the water is now considered leachate. 10 - Facility has a Plan of Action in place to address the issue of these observed violations. This plan of action was emailed to John College on April 17, 2020. 11 - John College will conduct unannounced follow up inspections to ensure these observed violations are corrected and maintained. 12 - Leachate tank area looks good and tanks have adequate storage available. Tanker trucks were removing leachate during this inspection. 13 - Facility burns off landfill gas. The system appears to be working correctly looking at the flares 14 - No on-site records were reviewed during this inspection due to COVID-19. 15 - All COVID-19 CDC Recommendations were followed during this inspection. 16 - Digital pictures were taken of the observed violations and some are attached to this report.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
