STATUS OF PERMIT:
Active; Permit to Operate Phases I and II and Permit to Construct Phase III issued 24 February 2016, expires 5
October 2020. A complete permit review request for the next 5-year phase of operations including updated Facility,
operations, and waste screening plans was due on or before 5 April 2020. This application must comply with the rules
and regulations in effect at the time of the application.
PURPOSE OF SITE VISIT:
Comprehensive Facility Compliance Inspection
STATUS OF PAST NOTED VIOLATIONS:
None applicable
OBSERVED VIOLATIONS:
1) 15A NCAC 13B .0564 (9)(b) states “The facility shall meet the following minimum buffer requirements: 100
feet from the disposal area to property lines…”
2) 15A NCAC 13B .0566 (1) states “Operational plans shall be approved and followed as specified for the
facility.”
3) 15A NCAC 13B .0566 (2) states “The facility shall only accept those solid wastes which it is permitted to
receive.”

ADDITIONAL COMMENTS:
1) This Facility is a Land Clearing and Inert Debris (LCID) Landfill.
2) This Facility is recorded with the Onslow County Register of Deeds at: Book #1794; Page #169.
3) This Facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood,
uncontaminated soil, and inert debris such as unpainted rock, brick, concrete, and concrete block.
4) This Facility is permitted to receive waste generated within Onslow County.
5) Signage is posted at the entrance to the Facility stating the Facility name, permit number, and Facility
emergency contact number.
6) The Facility is secured with steel posts at the entrance and a steel cable locked across the access road and has
controlled access for safety.
7) The gate was closed and locked upon my arrival and no attendant was on site during this Facility Compliance
Inspection.
8) The Facility access road is of all-weather construction and is being maintained in overall good condition at
this time.
9) Soil has been stockpiled on-site for use in cover and grading operations.
10) Due to the growth of brush, trees, and other woody vegetation, inspection of the northern and eastern outside
slopes was not possible during this Facility Compliance Inspection. The area around the toe of the landfill
needs to be cleared of brush and woody vegetation. *Within thirty days of receipt of this Facility Compliance
Inspection Report, please clear the area around the entire perimeter of the toe of the landfill and maintain it
clear of brush for maintenance and inspections. (please see the aerial photograph attached on final of this
facility Compliance Inspection Report).
11) The landfill disposal area appears to have encroached the required 100’ buffer from the property line along the
northern toe of the landfill. *Within thirty days of receipt of this Facility Compliance Inspection Report, please
measure the landfill disposal footprint and all required buffers. All waste found to be disposed within the
required buffer areas should be pulled back far enough to provide for the required buffer distance(s) from the
toe of the disposal area (please see the aerial photograph attached on final of this facility Compliance Inspection
Report).
12) The landfill perimeter needs to be staked to identify the permitted landfill disposal area and all required buffers.
*Within thirty days of receipt of this Facility Compliance Inspection Report, please install permanent markers
delineating the waste disposal boundary and all required buffers.
13) No new disposal activities appear to have occurred since the last Facility Compliance Inspection.
14) Unpermitted waste consisting of asphalt roofing shingles was observed disposed on the landfill. *Within
thirty days of receipt of this Facility Compliance Inspection Report, please remove this unpermitted waste
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

from the landfill and transport it to a Facility permitted by the State to receive such wastes (please see the
aerial photograph attached on final of this facility Compliance Inspection Report).
15) Some brush and other woody vegetation was observed growing in several areas of the landfill. To prevent the
growth of trees and other woody vegetation, a regular mowing schedule should be initiated. *Within thirty days
of receipt of this Facility Compliance Inspection Report, plans need to be underway for the mowing of all
landfill sideslopes and all other inactive areas of the landfill. Moving forward, a regular maintenance schedule
needs to be instituted which should include regular mowing of the landfill and the area around the toe of the
landfill to promote the growth of a healthy cover crop suitable to prevent erosion of your landfill cap system
and to prevent the establishment of woody vegetation and trees in these areas.
16) *Please ensure that all outside slopes of the landfill are compacted, covered, and graded at a slope not greater
than 3:1.
17) Waste concrete and asphalt have been staged on the western end of the landfill adjacent to the landfill access
road for crushing and later re-use. * Please note that the State rules regarding recovered materials state that for
a material to qualify as a recovered material, the majority of the material (75% or more) must be sold, used, or
re-used within the calendar year of placement on site. If the material cannot meet this requirement, it should
be properly disposed in the landfill.
18) No off-site erosion was observed during this Facility Compliance Inspection.
19) *Corrective actions are required as a result of this Facility Compliance Inspection.
