The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Site entrance had proper signage. 2. Access roads were of all-weather construction and properly maintained. 3. 15A NCAC 13B .0566 (4) Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first. Be sure and cover once reaches one acre in size or after one-month waste is put into NLCID. Parts of some of the slopes were in need soil cover at the time of this inspection. 4. A couple of the slopes had good soil cover in parts and had recently been stabilized with grass. Looked good,
continue working on all sides of the landfill and maintain the 3:1 slopes. 5. 15A NCAC 13B .0566 (10), Surface water shall be diverted from the working face and shall not be impounded over waste. The waste should be compacted and site graded to ensure water is diverted per this rule.
6. 15A NCAC 13B .0563 (3) An individual permit is required, except for landfills subject to Item (5) of this Rule, for the construction and operation of a Land Clearing and Inert Debris (LCID) landfill when: (a) The facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood, and yard trash. Operations must be consistent and in compliance with the local government solid waste management plan as approved by the Division of Solid Waste Management, and (b) The total disposal area is greater than two acres in size. There were few items of unapproved waste such as scrap metal rod, OSB lumber and plastic. Be sure and remove and dispose of properly. Working face operator should remove unapproved waste as its discovered and before covering or compacting. Facility is taking untreated dimensional lumbar scraps from a truss manufacturer. Be sure no unapproved waste makes it onto LCID by being comingled with the untreated lumber scraps, such as the OSB board in the “I” beam joists on side slope. 7. There were old concrete meter covers with the metal lids observed dumped on west side of the landfill. The
concrete covers may be disposed of in the landfill if you remove the metal lids. 8. Drillers mud was dumped down the West slope of the LCID recently. Liquid waste cannot be accepted at this facility. Drillers mud must not be accepted in this facility without being analyzed for contaminants and properly solidified first. Contact Section Staff if you wish to establish an area on your property for this purpose. 9. Owners and staff from SWS discussed future new site where they are currently finishing up approximately 5-
acre barrow pit which they would like to be first cell in an approximately 15 acre permitted LCID. Andrew Hammonds instructed on how to start the process and David Powell later emailed Josh Byrd and Duncan Parker the information guidance on the process. 10. Corrective measures are necessary as a result of this compliance inspection. Please ensure that all items discussed are corrected and maintained as part of the normal operating procedures. Recent grass establishment and erosion control fence. Liquid waste was recently dumped from top and allowed Cover and slope accordingly. to pour down side slope. Do not accept liquid waste or drillers mud.
Plastic pipe and more plastic were found on working face. Remove and dispose of at the proper solid waste facility. Working face operator should be removing unapproved waste as its discovered and educating the waste haulers.

“I” beam joist dimensional lumber is treated and cannot be accepted. Only un treated and unpainted clean lumber. Be careful accepting this waste and screen each load.
