The Land Clearing and Inert Debris Landfill Notification Application was filed for recordation with the Ashe County Register of Deeds on May 3, 2010. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. This inspection was performed to verify the efforts taken to establish the 100-foot buffer between the edge of waste and the western property line. 2. The facility is located on a 35.53 acre parcel of land located north of 2509 Carson Woods Road and is owned by Jackie W. and Mila M. Noblett. 3. It appeared that the waste area was less than 2-acres in size. 4. A gate was located at the entrance to the facility to prevent unauthorized access. 5. The facility had proper signage attached to the gate of the facility. 6. The access road leading to the landfill was of all-weather construction and well maintained. 7. 15A North Carolina Administrative Code 13B .0564(9)(b) states: “(9) The facility shall meet the following minimum buffer requirements: (b) 100 feet from the disposal area to property lines, residential dwellings, commercial or public buildings, and wells.” x During the February 4, 2015 inspection, a measurement was taken by range finder from the fence line of the property boundary located on the west side of the waste area to the edge of waste. The distance was measured as 29.0-yards (87-feet.). Therefore, it appears that waste has been placed within the required 100-foot buffer to the western property boundary. x During the April 30, 2015 inspection, Mr. Noblett stated that measurements were taken at three separate locations from the fence line to the waste limits which were found to be 90-feet, 85-feet, and 90-feet. x During a telephone conversation on May 11, 2015, Mr. Noblett stated that he would pull waste back from the property boundary to achieve the required 100-foot buffer requirement. Mr. Noblett also stated that he would keep the Solid Waste Section informed as work is completed to establish the 100-foot buffer to the property line. x Mr. Noblett notified the Solid Waste Section by telephone on June 9, 2015 that waste had been pulled back from the western property boundary establishing the required 100-foot buffer to the property line. x During the June 12, 2015 inspection, multiple measurements were taken by range finder from the edge of waste to the fence line of the property boundary located on the west side of the waste area. The measurements were found to be 38.0-yards (114-feet), 36-yards (108-feet), and 35-yards (105- feet). Therefore, it appeared that the proper buffer had been provided along the western property boundary. The facility appeared to meet all other required buffers.
