The Land Clearing and Inert Debris Landfill Notification Application was filed for recordation with the Ashe County Register of Deeds on May 3, 2010. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS 15A North Carolina Administrative Code 13B .0566(2): β€œThe facility shall only accept those solid wastes which it is permitted to receive.” During the inspection, multiple pieces of painted concrete block were observed on the south side of the landfill adjacent to the hillside. A piece of corrugated plastic pipe, a piece of treated lumber, and a piece of painted lumber were observed on the west side of the landfill at the edge of the soil cover on the top of the landfill. A piece of plastic conduit was observed on top of wood waste just south of the corrugated, plastic pipe. The aforementioned wastes are unacceptable for disposal in a land clearing and inert debris landfill. Therefore, Jackie Noblett is in violation of 15A NCAC 13B .0566(2). To achieve compliance, within 30 days of receipt of this inspection report, all unacceptable wastes must be removed and properly disposed at a facility permitted by the Division of Waste Management. Proof of disposal must be provided by submitting all solid waste management facility receipts where waste is disposed to the Solid Waste Section. Receipts for disposal of unacceptable wastes should be mailed to the following address: Charles Gerstell, Environmental Senior Specialist 610 East Center Avenue, Suite 301 Mooresville, North Carolina 28115 ADDITIONAL COMMENTS 1. The facility is located on a 35.53 acre parcel of land located north of 2509 Carson Woods Road and is owned by Jackie W. and Mila M. Noblett. 2. A gate was located at the entrance to the facility to prevent unauthorized access. This gate was closed and latched upon arrival. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The access road leading to the landfill was of all-weather construction and well maintained. 5. A sediment trap was located on the north side of the landfill. 6. No off-site erosion or sedimentation was observed. 7. 15A North Carolina Administrative Code 13B .0564(9)(b) states: β€œ(9) The facility shall meet the following minimum buffer requirements: (b) 100 feet from the disposal area to property lines, residential dwellings, commercial or public buildings, and wells.” x During the inspection, a measurement was taken by range finder from the fence line of the property boundary located on the west side of the waste area to the edge of waste. The distance was measured as 29.0-yards (87-feet.). Therefore, it appears that waste has been placed within the required 100-foot buffer to the western property boundary. x Within 60-days of receipt of this inspection report, steps must be completed to ensure that the 100-foot buffer has been established between disposed waste and the western property boundary. Should it be found that waste is located within the required buffer, steps must be taken to reestablish the buffer. This can include, but not be limited to relocating waste to an area outside of the required buffer. 8. During the inspection, it appeared that the waste area was less than 2-acres in size. However, actual area could not be verified. Edge of waste markers must be provided marking the limits of the landfill area to ensure that the facility remains within the required footprint of less than 2-acres and buffers are maintained.
