I visited the Cherokee Co. Landfill on the morning of April 7, 2006 in response to a complaint registered
by JoAnne Huff. Jeff Clark, Cherokee Co. Landfill Supervisor told me that the reason trucks were at the
landfill at such an early hour was that one of the counties two garbage trucks was broken down and they
were using one truck to pick up all the garbage for the day. The refuse was from the convience centers
and the 2 loads sthat were brought to the landfill for disposal before opening time (7:30am) were
weighed by the truck driver. One load weighed 8.94 tons and the other weighed 8.58 tons. The landfill
was not open for public use befbre 7:30 am, so it is not a requirement alat a ceitified operator be on bite.
Cherokee Co. does random waste screenings as required, but these loads were not screened.(all loads do
not have to be screened). We as a section do not have noise violations, so there is nothing we can do
about this. Please advise if further information is needed.

RE: Illegal activity at the Cherokee County Landfill
Dear Sheriff Lovin,
In the early morning hour of 0115, March 28, 2006, the Sheriff's office was called to
report suspicious activity in the Cherokee County Landfill, located in Marble, NC. At that
time, loud noise from a truck's back-up alarm awoke me and my husband. We observed
a large truck with multiple lights dumping unknown contents into the rear landfill area.
Thinking this was an unusual situation, we attempted to first notify Robert Allen,
manager of the landfill, at home. We were unable to reach him. We then called your
office and were told that a deputy would be dispatched to investigate. I requested that
following the investigation, someone from your office call and report the results. The
person answering the phone told me to call the next morning, which I did. When I called,
there was no record of my call (earlier that morning) or of any action taken. Next I called
Robert Allen at the landfill. His response "Ms Huff, that was only the boys dumping. Our
truck had broken down and we were finishing up. I thank you for your concern."
May I point out that conducting operations at the landfill at that hour is a violation of the
recently past noise ordinance of Cherokee County. Second, it is illegal to operate a
landfill without a Certified Operator on duty. Third, the contents being dumped must be
weighed and inspected. I am requesting your office to issue a citation for the above
offenses. Thank you for your consideration. I await your response.

AREAS OF CONCERN AND COMMENTS:
(1) Sediment basin has been cleaned since last inspection = good work.-
(2) Still need to complete replacing nonwoven fablic that has blown off the HDPE liner in the leachate lagoon. Some
work has already been done — it just needs finishing.
(3) Some exceedences in VOC's and metals documented on Fall 2005 sampling event for groundwater monitoring
wells. This issue is being handled by Raleigh Central Office.
(4) Some litter needs picked up on phase One.
(5) On site leachate seeps on phase one dike. Repair these seeps.

OTHER COAUNMENTS /SUGGESTIONS:
(1) Sediment basin needs "cleaning" to ensure adequate capacity for winter operations. Also replace stone around
basin stand pipe.
(2) Complete mowing phase one inactive cell.
(3) Geotextile cover over the HDPE liner in the leachate lagoon has blown up exposing the liner. Pull the geotextile
bggk ever the liner and anchor with canrlh as.
(4) Litter accumulated along the litter fence needs picking up.
(5) Groundwater issues being handled by Raleigh Central office.
(6) Make sure the yard waste area is designated on the landfill plan.

AREAS OF CONCERN AND COMMENTS:
1.An on site landfill operator course was conducted by Jeff Clark (MOLD). Attendees included Jason Rowland, James
Phillips, Wanda Payne, and Dick Godfrey. The course was completed on 6/01/05
2.Cherokee County Landfill is accepting only waste generated in Cherokee County; however the service area for the
landrill includes ra am Co., Swain Co., and clay Co.
3.The geotextile fabric is once again coming off exposing the HDPE liner in the leachate lagoon. This needs to be repaired
in such a way that it will permanently remedy the problem.
4.The landfill is currently receiving about 60 tons of waste a day.
5. Cherokee County Emergency Services gave a workshop on hazardous waste recognition to landfill employees in
September.
6 The edge of liner markers along the slope next to the Valley River which have been removed need replacing.
7. Remove the materials that have been stored on the edge of the landfill next to the maintenance building.
8. The inactive cell needs mowing.
9. Groundwater issues are being addressed by the Raleigh Central Office.
10. Completed slope areas in the cell currently being. used need seeding.
11. Methane gas monitoring has been done this quarter.
12. Waste screening and scrap tire certification forms are being completed and look good.

(8) Groundwater issues are being handled by Raleigh Central Office.
(9) The last methane gas sampling was done on 3/7/06. Make sure that sampling is performed each quarter. Jeff
Clark ensured me that the monitoring would be done on Monday (7/17/06) and sometime again during the
quarter to compensate for the Quarter that was missed (April — June).

(2) Geosynthetic cover blown off HDPE Lagoon liner in a couple of places. Address these areas as we discussed.
(3) Some windblown litter needs to be picked up.
(4) The completed areas we discussed need to be seeded.
(5) Cherokee County is presently receiving approximately 60 tons of waste a day.
