Huff 98 Burnt Branch Overlook Marble, NC 28905 Dear JoAnne: In response to your November 12, 2002 letter, I offer the following comments: • Item No. 1 in your letter refers to guidance for preparation of permit applica- tions for facilities processing municipal solid waste. The information you refer to in (A) and (B) of Item 1 is also concerning processing of municipal solid waste. Municipal solid waste is defined in General Statute 130A-290(a)(18a). Once again, both (A) and (B), which you refer to in your letter, are guidance and not rules or regulations for municipal solid waste treatment and processing facilities. The Solid Waste Section is currently in the process of developing rules specifi- cally for LCID/yard waste treatment and processing facilities and at this time there is no requirement for processing or removing materials accumulated within one year. • The LCID yard waste area does not accept waste containing asbestos. Asbestos may be placed in the municipal solid waste landfill following requirements specified in 15 North Carolina Administrative Code 13B. 1626(d). Hazardous waste from commercial entities cannot be placed in the municipal solid waste landfill; however, household hazardous waste is not exempted from landfill disposal. After careful analysis of these documents, I am left with some unanswered questions. I am hoping that you will be able to answer them for me. 1. In accordance with the Application requirements for Treatment and processing Facilities, Section .0301 of 15A NCAC 13B , certain guidtlines are outlined for the preparation of the permit application for facilities processing municipal solid waste materials. I am in possession of the application prepared by Municipal Engineering Services CO, PA. It appears that this application is lacking several documents required by the outline: A. The Site plan including parts a- q. B. The Operation Plan - " A demonstration that the operations plan ensures that the facilities' capability to manage the waste in such a manner that 100% of the recyclable material will be processed and removed from the facility within one year of receipt. Comment: There has been no activity to process the stockpile since it's inception. No composting, no mulching and no tub grinding. According to the figures in the Annual Solid Waste Report July 1, 2001--June 30, 2002 , 141..04 tons of yard waste has been collected plus 3.21 tons of pallets. These figures do not include the 2000-2001 period. My question is : Why is there no enforcement of the rules ? it also appears that there is more than pallets and yard waste in the stockpile. Do you have access to the present material screening plan including a list of the unacceptable materials, bypass material, and recyclable materials? How big does the pile have to be to justify doing something? 1 first contacted Mr. James Coffey in March, 2001 about the pile. It has been well over a year since the materials have collected there and there has been no processing. If the materials cannot be managed according to the plan, Is there not some type of remediation? 1 do not see a narrative describing how Asbestos Containing Materials will be screened. How is this handled? Regarding general questions: What is the present plan for collecting or separating Hazardous Waste? Nothing is mentioned in the Annual Report ?
