Dear Jim:
The Cherokee County Landfill has been utilizing "air space saver" tarps as
alternative daily cover for quite some time. This tarp has seemed to work effectively in
controlling blowing litter, odor control, and preventing water infiltration. I thought that
a letter reflecting the demonstration of this material had been written, but could find
nothing in the files reflecting the 90-day demonstration. I see no problem with using air
space saver tarps in place of daily soil cover at the Cherokee County MSW Landfill.

Annual Local Government Financial Test Update
WILLIAM L. MEYER This is a reminder that, as specified in 15A NCAC 13B .1628(e)(1)(F)(vi), annual updates of
DIRECTOR the local government financial test must be submitted 120 days after the close of the fiscal
year. Financial assurance tests submitted in the past year expired as of July 1, 2000 and
updated tests must be submitted to my attention at this office no later than NOVEMBER 1,
2000.
The following items need to be submitted by this deadline:
1. THE LOCAL GOVERNMENT FINANCIAL TEST
As specified in 15A NCAC 13B .1628(e)(2)(F)(ii), the local government financial test
letter must be worded as specified in Part (e)(2)(G) of this rule and signed by the
unit of local government's chief financial officer (CFO). Please ensure that you are
using the exact wording as required by these rules. Updated tests must be
completed using audited figures from the local government Annual Financial
Information Reports (AFIR) dated June 30, 2000.
If the audited figures are not available before November 1, request an extension
stating the date you anticipate being able to submit the updated test.
COST ESTIMATES
Please submit current closure, post -closure and corrective action cost estimates. All
estimates must be dated subsequent to 1998! Estimates derived prior to 1998 will
not be accepted. Please use a 1.5% inflation factor (multiplication factor of 1.015)
to correct to 1999 dollars.
Failure to submit updated estimates along with the financial test will result in having
the package returned to you as incomplete and may result in a finding that you are
in violation of 15A NCAC 13B .1628(a)(4).

Dear Mr. Matthews,
I live directly above the Cherokee County Landfill in Marble. I have repeated complained to the County Commissioners about the
way the landfill is not covered with six inches of dirt at the end of each day. The synthetic cover does not cover all the garbage
exposed, which then creates a blowing litter problem, and bird problem.( As you may recall from your visit in 1996,when you
said placing the landfill so close to the airport (11,000 ft) may not be a good idea.) Our homeowners group was also promised
that there would be no night operations on weekend nights (or early morning i.e. 3:30 am dumpings) Repeatedly, garbage is
dumped on weekends in the middle of the night. They have cut off the back-up signal on the trucks ( which probably is not in
keeping OSHA rules) . However, since it is located in the valley below our homes, we can still hear the trucks and dumping
operations. We feel this is an unreasonable practice since there are many daylight hours when the landfill does not operate. We
also wonder why the truck drivers can write their own weighing slips by looking in the window of the scale house? As a taxpayer,
I wonder how much revenue is lost by this poorly managed practice? Keys to the landfill have been given to more than just the
manager,so what is being dumped? We have no separation of garbage, less than 1 % recycling, no control over the green boxes,
less than 1% inspection of garbage from the trucks, no enforcement of litter laws, storage(or better described as dumping) of
white goods in the old landfill next to a river, leaching from. the old landfill, no construction or demolition dump, no collection or
separation of hazardous waste, and more important than all of that: No one who can enforce or change the way the Solid Waste
Operations are managed. I am asking for your help. I have previously talked with Commissioners Dana Jones, Barbara Vicknair,
Cherokee County Manager Randy Wiggins, Jim Patterson, Julian Foscue. Mr. Foscue has been very helpful, and the situation
improves for about two weeks after he intervenes, but then it all goes right back to a poorly run operation. Please help. If you have

1) A certified operator is required at a landfill during operation. We had a similar situation with
Greensboro operting in wee hours and we told them they could not (may want to confer with Hugh and
files). If they are operating (opening the gates) without a certified operator on site, they are in violation.
2) I appreciate Jim's efforts on this site, and it seems that they will straighten things up when he is
watching, but we should not have to look over their shoulders. If they are not covering properly, we
need to make them understand what their responsibility is.
I know there are always two sides to a story and that if Jim says they are right they are right. I am in
receipt of Jim's e-mail to you on this site, and I appreciate as always his rapid response to complaints.
Please confer with me as needed and follow up with Jim. I will e-mail the complainant back and report to
her Jim's previous findings and tell her that you will be looking into her allegations. Please make sure that

Brent,
i visitea the C,nerokee CO. Landfill on Jan.19, 2000 in response to your telephone call of Jan. 19,
2000 concerning a citizen complaint about conditions at the landfill. I observed that the landfill was
covered with soil at the end of the day. There were some windblown papers that were not collected
before sunset on this day, but were picked up the next day. I returned to the landfill on Friday,
Jan. 21, 2000 to verify this. I also took pictures of the landfill and will send you copies.
Regarding the hours of operation, landfill personal told me that at times, especially around the
holidays they had no option except to begin work early in the mornings.
Please let me know if further information or action is necessary.

they go back to their old ways. Maybe it's time to get someone that knows the

Initatien: The eye irritanc,7 potential of the powdered form was assessed by instilling 10 mg or 60 Mg into
the inferior conjunctival sac of one eye of each of 6 rabbits. Eyes were them examined for signs of
ocular and perioeular inflammation and injury up to 7 da stinstillation. The material was
found from the 60 mg results to be an ocular irritant by � standards.
Additional Toxicological Infoatratlon:
A similar product has an extremely low order of toxicity by swallowing. The similar pellets were
pulverized and suspended in semi -solid agar for ease of administration.
When the Molecular Sieve was administered by stomach intubation to male rats, the animals
survived single massive doses equivalent to 32-0 gram pa kilog�rram of Body weight with good
weight gains. There were no significant micropathological findings on tissue taken fourteen days
after dosing.

- Dear Mr. Sullivan
I am writing in response to your letter dated 10 November 1999 regarding the above
facility. Jim Patterson, Solid Waste Specialist for Cherokee County, noted during an
inspection of the facility that the 16 oz. geotextile used in the leachate lagoon had
been removed. I called your office to request information as to why this had occurred
and in your response letter you indicated that the textile was not needed since its
original intent was for protection against wildlife. Since that time, I have reviewed
the approved permit documents for the facility and have found two items that
contradict your letter. Drawing E7 of the approved design drawings and Section
2.1.7 Engineering Plan both state that the 16 oz. geotextile are for protecting the
HDPE liner from UV degradation. For this reason, the geotextile should be replaced
and an evaluation of the HDPE should be made to determine if the length of exposure
has caused any damage or reduced its effectiveness. Please address this problem as

Dear Mr. Wiggins:
Pursuant to N.C.G.S. § 130A-22(a) and 15A North Carolina Administrative Code
13B, I conducted inspections on February 18, 2000 and on May 2, 2000 of the Cherokee
County Municipal Solid Waste Landfill located on SR 1515 near Marble, North Caro-
lina. The inspections found the Cherokee County Municipal Landfill to be in violation
of certain requirements contained in the North Carolina Solid Waste Management Rules,
codified at 15A North Carolina Administrative Code 13B, specifically:
15A North Carolina Administrative Code 13B .1626(7)(b) requires that adequate

sediment control measures (structures or devices) shall be utilized to prevent
excessive on -site erosion. The old Cherokee County Landfill is operating in
violation of 15A North Carolina Administrative Code 13B .1626(7)(b) in that
several large eroded areas were observed at the time of the inspections.
Based on the foregoing, the County of Cherokee is hereby ordered to take the
following actions by June 15, 2000 to correct all violations as stated in this Notice of
Violation, and otherwise be in compliance with the North Carolina Solid Waste Manage-
ment Rules, codified at 15A North Carolina Administrative Code 1313:
Comply with 15A North Carolina Administrative Code 13B .1626(7)(b) by repair-
ing eroded areas with appropriate soils (soils with permeabilities of 1 x 10-5 centi-
meters per second, plus a six-inch erosion layer). Adequate erosion control devices
should then be installed to prevent future erosion of these areas.

This forin is supplied to assist generators of wastes or persons responsible for the disposal of wastes to
characterize candidate materials to be non -hazardous as defined by 15A NCAC 13A and to be suitable for disposal
at a solid waste management facility. The types of materials that will be evaluated are primarily, but not
exclusively, industrial and commercial wastes and sludges and sludges from Publicly Owned Treatment Works.
The facility management reserves the right to request additional information or to waive some of the
requirements as deemed necessary depending on the source, type or knowledge of the particular material. The
facility may also require some wastes to be treated or altered to render the wastes environmentally immobile prior
to disposal at a sanitary landfill. To be suitable, wastes musk be non -liquid which can be properly managed as per
the 15A NCAC 13B "Solid Wastd Management Rules".
APPROVAL TO DISPOSE OF THE WASTE SHALL BE OBTAINED FROM THE OWNER/ OPERATOR OR
MANAGEMENT OF THE LANDFILL PRIOR TO DISPOSAL.
It is recommended that the information which the landfill will require to make a determination be
reviewed with the landfill management prior to under taking any testing or characterization. An asterisk(*)

Following are the EPA Toxicity Chap ucteristic Leaching Procedure (TCLP) hazardous threshold limits for the
thirty nine regulated constituents. These limits can be found in the 40 CFR 261.24 Federal Regulation. Waste
chemical analyses are required to be made using detection limits at or below the hazardous thresholds allowing
determination of hazardous/non-hazardous for constituents that are detected. Corrosivity can be determined by
pH measurements on slurrys of DI water and the waste when feasible. Individual pH values must be >2.0 and
<12.5; average values accepted normally range from 4.0 to 10.0.
The generators are responsiBle for determining that their wastes are not hazardous and meet N.C.
requirements to be landfilled. Analyses for herbicides, pesticides and organics must be performed whenever

Dear Mr. Welch:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid
Waste Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined,
compacted, and covered in accordance with the Solid Waste
Management Rules (15A NCAC 13B).
3. Renewal of this approval will. require resubmittal of a
Waste Determination Form and current supportive
analytical data. Renewal is required prior to subsequent
disposal if the process generating the waste changes or
if the waste composition changes significantly.
Failure to meet these conditions may result in revocation of
this approval, and subsequently, an administrative penalty. The
approval is subject to change if new rules and/or regulations were
to prohibit this practice. If the process which generates the
waste changes or if the composition of the waste changes
significantly, this approval is void and re-evaluation of the waste
will be required prior to subsequent d-isposal. If you have further

This form is supplied to assist generators of wastes or persons responsible for the disposal of wastes to
characterize candidate materials to be non -hazardous as defined by 15A NCAC 13A and to be suitable for dis

Following are the EPA Toxicity Chu, acteristic Leaching Procedure (TCLP) hazardous threshold limits for the
thirty nine regulated constituents. These limits can be found in the 40 CFR 261.24 Federal Regulation. Waste
chemical analyses are required to be made using detection limits at or below the hazardous thresholds allowing
determination of hazardous/non-hazardous for constituents that are detected. Corrosivity can be determined by
pH measurements on slurrys of DI water and the waste when feasible. Individual pH values must be >2.0 and
<12.5; average values accepted normally range from 4.0 to 10.0.
The generators are responsitle for determining that their wastes are not hazardous and meet N.C.
requirements to be landfilled. Analyses for herbicides, pesticides and organics must be performed whenever
knowledge of the waste makes their resence a ossibilit . Leachable metals must always be determined.

This fonn is supplied to assist generators of wastes or persons responsible for the disposal of wastes to
characterize candidate materials to be non -hazardous as defined by 15A NCAC 13A and to be suitable for disposal
at a solid waste management facility. The types of materials that will be evaluated are primarily, but not
exclusively, industrial and commercial wastes and sludges and sludges from Publicly Owned Treatment Works.
The facility management reserves the right to request additional information or to waive some of the
requirements as deemed necessary depending on the source, type or knowledge of the particular material. The
facility may also require some wastes to be treated or altered to render the wastes environmentally immobile prior
to disposal at a sanitary landfill. To be suitable, wastes must be non -liquid which can be properly managed as per
the 15A NCAC 13B "Solid Waste Management Rules".
DISPOSE OF THE WASTE SHALL BE OBTAINED FROM TIC OWNER/ OPERATOR OR
MANAGEMENT OF THE LANDFILL PRIOR TO DISPOSAL.
It is recommended that the information which the landfill will require to make a determination be
reviewed with the landfill management prior to under taking any testing or characterization. An asterisk(*)
appearing in any of the following lettered or numbered categories. denotes that the (those) particular categories of
information is (are) the minimum required on Publicly Owned Treatment Works Sludge. The landfill management
has the prerogative of denying disposal of this or any other waste in the landfill even if suitability is indicated.

Following are the EPA Toxicity C. Icteristic Leaching Procedure (TCLP, �azardous threshold limits for the
thirty nine regulated constituents. These limits can be found in the 40 CFR 261.24 Federal Regulation. Waste
chemical analyses are required to be made using detection limits at or below the hazardous thresholds allowing
determination of hazardous/non-hazardous for constituents that are detected. Corrosivity can be determined by
PH measurements on slurrys of DI water and the waste when feasible. Individual pH values must be >2.0 and
<12.5; average values accepted normally range from 4.0 to 10.0.
The generators are responsible for determining that their wastes are not hazardous and meet N.C.
requirements to be landfilled. Analyses for herbicides, pesticides and organics must be performed whenever
knowledge of the waste makes their resence�sibfili�y.Leachable metals must alwa s be determined.

Subject: Disposal of 3 Yd3/Week of Rotoclone (Aluminum) Sludge at
the Cherokee County Landfill, (Permit #20-01).
Dear Mr. Welch:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid
Waste Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined,
compacted, and covered in accordance with the Solid Waste
Management Rules (15A NCAC 13B).
3. Renewal of this approval will require resubmittal of a
Waste Determination Form and current supportive
analytical data. Renewal is required prior to subsequent
disposal if the process generating the waste changes or
if the waste composition changes significantly.
Failure to meet these condi-ti.ons may result in revocation of
this approval, and subsequently, an administrative penalty. The
approval is subject to change if new rules and/or regulations were
to prohibit this practice. If the process which generates the
waste changes or if the composition of the waste changes
significantly, this approval is void and re-evaluation of the waste
wi l-I be required prior to subsequent disposal.. If you have further

Listed below, are four process waste streams that I need approval/disapproval for disposal into the
Cherokee County Landfill. I currently have a full roll -off hopper containing a mixture of these
components. I have set this hopper aside pending test results. In the meantime, I am in desperate need
of space. Last Friday, I talked with Jeff Clark and gave him a list of our most immediate needs.
Specifically, I asked him the following questions:
Can we continue shipping drag sludge as we have in the past?
Can we continue shipping con rod grinding swarf per Robert Allen's verbal approval?
• Can we mix #1 and #2 in the same hopper, or does the material need to remain separate?
* Can we mix the roto-clone sludge in with the drag sludge?
1. Drag sludge: OMC-Andrews uses a large slung system ("drag") to polish and debur aluminum
gearcase housings. The drag wastewater treatment system removes aluminum and drag media
particles (plastic and silica) from the process water through pH adjustment and precipitation. The
resulting sludge is dried in a filter press and dropped into a large roll -off hopper. This material has
never exhibited any hazardous characteristics. OMC-Andrews has sent this material to the
Cherokee County Landfill for 12 or more years.
2_ Grinding swarf: The connecting rod grinders at OMC-Andrews machine copper plated 8620 steel.
This is a new process transferred from our Milwaukee facility. The grinders are plumbed into
common Oberlin coolant filters, These filters remove the particulate matter (steel alloy and
abrasives) from various grinding operations and then dry the material. This produces a dry "filter
cake". I recently tested a representative sample of the connecting rod swarf. These results were
submitted to Robert Allen for possible landfill acceptance, He gave me verbal approval.

3. Roto-Clone sludge: The Roto-Clone (air filtration system) uses a bath of city supplied water to
separate and collect dust from the air in our polishing room. The wet mixture is continuously
dumped into a small hopper that, when full, is stored under a shed or dumped into the roll -off
hopper. Primary Ingredients: Aluminum dust, water, and abrasive materials. I am certain that this
material instigated the exothermic reaction in our hopper.
4. Gear slurry mu , _elgeaTs-?re "slurried" -in -abrasive -media -to -improve -the -sup ace nfinish
of the gear. On occasion, the tanks are cleaned out and the "mud is dumped into the roll -off
hopper. The resulting waste is primarily wom media settled in a water bath. I assume that this is
non -hazardous and am developing a method of drying the mud before attempting to send it to the
landfill.

Cherokee County Landfill
To whom it may concern:
I would like to address some waste disposal issues that have come to light over the past
month. In May of 2000, OMC-Andrews experienced an exothermic reaction (there was no combustion,
fire, or damaging temperature) in a waste roll -off hopper that contains a mixture of several industrial
waste streams. This occurrence aroused the interest of Jeff Clark, and led to a re-examination of the
wastes that OMC-Andrews has historically shipped and disposed of at the Cherokee County Landfill.
OMC re -tested a sample from each of our four waste streams that have been locally landfilled in the
past. The roll -off hopper that experienced the reaction contains an unknown percentage of each waste.
We are currently working to resolve two problems: 1) The continued disposal of our current waste
streams. 2) The disposal of the roll -off hopper containing mixed waste.
In May of 2000, 1 obtained and shipped four representative samples of OMC-Andrew's industrial
waste streams to Pace Analytical Labs for testing in accordance with North Carolina non-
hazardous landfill guidelines. After receiving the results, I completed a "REQUEST TO DISPOSE
WASTE IN SUB -TITLE D LANDFILLL PERMIT NO: " form for each waste. OMC-Andrews, in
agreement with corporate environmental specialists, believes all four wastes to be non -hazardous
and further request approval to dispose of them in the Cherokee County Landfill. I realize that a
reaction did occur and we are making steps to insure that it does not happen in the future.
Specifically, OMC has related the reaction to the handling of our "RotoClone" sludge. This industrial
sludge is a byproduct of aluminum sanding operations. Several OMC facilities perform similar
operations and generate an identical sludge. The other facilities have historically landfilled their
sludge. OMC-Waukegan experienced similar reactions in the past when they mixed their sludge
with common trash. Since they segregated their RotoClone sludge from both trash and other
sludges, they have not experienced any problems. I have attached a memo from OMC's corporate
environmental office detailing their determination of the RotoClone sludge.
2. OMC-Andrews requests permission to dispose of the mixed roll -off hopper at the Cherokee County
Landfill. Immediately after the reaction occurred in our roll -off hopper, I contacted Onyx
Environmental to discuss disposal options. I supplied them with a general description of the
incident as well as the processes that generated the waste. Assuming that the reaction is complete
and the material is in a shippable container, Onyx initially recommended disposal in a sub -title "D"
landfill. After the initial reaction, no subsequent activity has been observed. The hopper is currently
being stored on -site at OMC-Andrews pending definite landfill approval/disapproval. The
components of the hopper include all four waste streams, as well as some construction debris.
OMC-Andrews is dedicated to environmental responsibility and is interested in supplying The Cherokee

As you requested, I have reviewed the draft copy of the waste profile that you completed for the Roto-
clone sludge generated at OMC Andrews. As we discussed, I believe that the Roto-clone sludge should
be classified as non -hazardous for purposes of disposal. After reviewing Subpart C of RCRA (40 CFR
261), I do not believe that the Roto-clone sludge meets the definition of hazardous waste.
The argument could be made that the sludge has the reactivity properties (Le, 13003), defined in section
261.23(a)(7): It is readily capable of... reaction at standard temperature and pressure. While this
condition could, at times, be possible, I do not believe that this condition readily exists. This
determination is consistent with that made for Roto-clone sludge generated at other OMC facilities for
the past several years.
As we discussed, I suggest that the sludge be collected and transported in a designated container,
without the mixing of other waste materials, such as grinding swarf or drag finishing sludge. The mixing
of these materials may have been the cause for the smoldering that was recently experienced.

(6) Violations Noted:
A. 15A North Carolina Administrative Code 13B .1626(2)(a) states that all MSWLF units must
cover disposed solid waste with six inches of earthen material at the end of each operating day
or at more frequent intervals if necessary to control disease vectors, fires, odors, blowing litter,
and scavenging. The Cherokee County Landfill was operating in violation of this rule in that
disposed waste was not covered with at least six (6) inches of earthen material.
B. General Statute 130A-309.10(f)(7) prohibits landfilling whole scrap tires. The Cherokee County
Landfill was operating in violation of this statute in that whole scrap tires were observed in the
landfill. Remove all whole scrap tires and make it a practice to immediately remove tires from
the working area when they are found in any load.
(7) Comments/Suggestions:
A. Make sure that your waste screening includes at least I percent. of waste received at your
MS WLF.
B. Acknowledgement is needed in waste determination file for waste acceptable for disposal at
Your landfill.
C. Make sure all information on scrap tire certification forms is filled out.
D. Documentation is needed for replacing the geotextile material in the leachate lagoon. This
documentation can become part of your periodic maintenance of the leachate collection system.

Cherokee County Landfill
Dear Sir or Madam:
I am requesting permit approval for the disposal of grinding swan at the Cherokee County Landfill. The
"grinding swarf" is the product of a machining operation in which material is removed from copper
plated connecting rod forgings. The metal grindings are filtered and dried, ultimately producing a dry
filter "cake". I obtained a representative sample of the grinding swarf and sent it to Pace Analytical Labs
in Asheville, NC for metals, pesticide, and TCLP testing. I did not find any hazardous materials in
concentrations higher than the NC Landfill maximum. I have summarized the results on an attached
sheet. Please review the summarized material, the Pace Analytical results and OMC's permit

REQUEST TO DISPOSE WASTE IN SUB -TITLE D MSW LANDFILL PERMIT NO:
This form is supplied to assist generators of wastes or persons responsible for the disposal of wastes to''
characterize candidate materials to be non -hazardous as defined by 15A NCAC 13A and to be suitable for disposal
at a solid waste management facility. The types of materials that will be evaluated are primarily, but not
exclusively, industrial and contmercial wastes and sludges and sludges from Publicly Owned Treatment Works.
The facility management ieserves the right to request additional information -or to waive some of the
requirements as deemed necessary depending on the source, type or knowledge of the particular material. The
facility may also require some wastes to be treated or altered to render the wastes environmentally immobile prior
to disposal at a sanitary landfill_ Tn_b.e_suitable—wa-ste-must be-non=liquid which can be properly managed as per
the 15A NCAC 131B "Solid Waste Management Rules".
APPROVAL TO DISPOSE OF THE WASTE SHALL BE OBTAINED FROM THE OWNER/ OPERATOR OR
MANAGEMENT OF THE LANDFILL PRIOR TO DISPOSAL.
It is 'recommended that the information which the landfill will require to make a determination be
reviewed with the landfill management prior to under taking any'testing or characterization. An asterisk(*)
appearing' in any of the following lettered or numbered categories denotes that the (those) particular categories of
information is (are) the minimum required on Publicly Owned Treatment Works Sludge. The landfill management
has the prerogative of denying disposal of this or any other waste in the landfill even if suitability is indicated.

Following are the EPA Toxicity Characteristic Leaching Procedure (TCLP) hazardous threshold limits for the
thirty nine regulated constituents. These limits can be found in the 40 CFR 261.24 Federal Regulation. Waste
chemical analyses are required to be made using detection limits at or below the hazardous thresholds allowing
determination of hazardous/non-hazardous for constituents that are detected. Corrosivity can be.determined by
pH measurements on slurrys.of DI water and the waste when feasible Ind' 'd al H 1

response that operators at the Cherokee County landfill do make the effort to comply with our standards
and to be responsive to concerns raised by you and other citizens. I have been asked by Mr. Randy
Wiggins to provide him with copies of all the complaints we have received regarding solid waste issues. I
will be forwarding him the complaints we have received to date, as well as a copy of this e-mail
correspondence and the response to your numbered issues (I am sending that response separate - I still
have some questions of my own that I would like to have answered.
I strongly encourage you to bring any future solid waste issues directly to the attention of Mr. Wiggins

SUBJECT: Solid Waste Complaint at Cherokee County Landfills
Permit No. 20-01 and Permit No. 20-02

After receiving the e-mails on Monday, February 21, 2000, with complaints concerning solid
waste and the Cherokee County Landfills, I made an unannounced visit to the Cherokee County
Landfill on Tuesday morning, February 22, 2000.
Upon arriving at the landfill, I learned that Robert Allen, Cherokee County Landfill
Supervisor, and Wayne Sullivan, Cherokee County's Consulting Engineering firm representative,
were meeting with Randy Wiggins, Cherokee County Manager, to discuss the Cherokee County
Solid Waste plan update. I telephoned the courthouse and made arrangements to meet with them
to discuss the areas of concern mentioned by the complainants. Detailed below is a list of the
areas of concern and answers to the issues obtained from my interview, my personal knowledge,
and/or information obtained from on -site visits to the landfills on this day (February 22, 2000).
(1) "Garbage left exposed all night because the artificial cover is too small for the amount of
garbage." My unannounced visits to the landfill have reflected waste properly covered
most of the time. In looking over past inspection sheets, inappropriate cover was
documented as a violation once during the past two years of quarterly inspections. This
was noted during my September 14, 1999 inspection. Also, the approved operation plan for
this facility speaks of cover being a combination.of soil and synthetic material.
(2) ,(A)Equipment that is routinely run over plastic liner posing�a problem to its integrity.
(') Toxic chemicals dumped indiscriminately in the landfill."
(A) During my visits/inspections, I have not observed equipment running on the liner.
There is a three-foot layer of protective soil over the plastic liner and I have not seen
this cover disturbed. Also, Mr. Allen stated that there has been no equipment tearing
up the liner.
(B) Toxic chemicals are not allowed to be dumped into the landfill. Cherokee County
does routine waste screenings at the landfill to ensure that hazardous waste is
excluded. Mr. Allen informs me that there is a pesticide disposal program offered by
the Department of Agriculture to assist homeowners and farmers with these materials.
(3) "Pooling of Leachate." I observed no pooling of leachate at the Cherokee County Landfill.
I did observe some impounded water in a couple of areas that had received intermediate
cover and were seeded. I asked landfill personnel to fill these areas with soil. I am sending
pictures reflecting this situation.
(4) "No inspection of garbage dumped in the middle of the night." According to landfill
employees, there is no dumping of garbage in the middle of the night. Landfill operating
hours are from 7-30 Am to 4•00 E!m Monday through Friday and from 7.30 NA to 1 o •nn
noon on Saturday. The landfill is closed on Sundays. Mr. Robert Allen, landfill operator,
and Mr. Jeff Clark, scale house attendant (also MOLO certified) indicated that county
trucks do not dump until daylight. Mr. Clark is on site every day except Sundays. On
Sundays, the landfill is closed to the public, but three to five compactor loads from
greenbox sites are hauled to the landfill and covered with soil by a landfill employee.
(5) "Leaching of the old landfill into the Valley River." Wayne Sullivan and I walked the
entire perimeter of the old, closed landfill and observed no evidence of leachate from the
landfill entering the river. I did point out some on -site erosion on the old landfill, which
was noted as a violation on my February 18, 2000 post -closure inspection of the site.
(6) "The storing of white goods at the old landfill and the practice of disposing of white goods
in the new landfill."
(A) Cherokee County uses the old landfill premises as its white good collection site.
White goods are stored in an area that was not used for solid waste disposal. The area
is between the old maintenance building and the landfill area. White goods were
being loaded for off -site shipment during my visit to the landfill this day.
(B) As for disposing of white goods in the new landfill, Cherokee County Landfill
personnel told me that occasionally white goods come to the landfill from unmanned
greenbox sites. However, when this happens, the white goods are taken to the white
goods collection site at the old landfill.
(7) "The dumping of construction and demolition debris into the Subtitle D Landfill."
Cherokee County does dispose of construction and demolition material in their Subtitle D
Landfill. The county does not have a landfill strictly for C&D disposal, so the material
goes into the Subtitle D cell. This is not a violation of any federal or state regulations.
(8) "The disposal of animals that were not cremated by the humane shelters." According to
Mr. Allen, Cherokee County does accept non -cremated animals for disposal at the landfill.
He said that when dead animals come to the landfill, they are taken to the disposal area and
covered immediately. This disposal practice is in agreement with, and in a manner
prescribed by the North Carolina Solid Waste Management regulations.
(9) "The disposal of yard waste into a Subtitle D Landfill." Cherokee County stores "yard
trash" in a notified yard trash storage site. The site is the former site of the county's air

curtain burner and is located adjacent to the white goods storage area at the old landfill.
Mr. Allen stated that occasionally LCID waste, such as large stumps, is placed in the
Subtitle D cell. Since LCID is not "yard trash," this practice is acceptable.
(10) "The constant bird problem due to garbage left exposed." As I have stated earlier, I have
found the landfill in Cherokee County covered most of the time (seven out of eight
inspections). I have, however, seen birds at the site almost every time T have visited_ T have
also seen birds at every other landfill that I visit/inspect. Cherokee County has a bird
management plan in its approved solid waste operational plan. It is required that the plan
be implemented if there is a "bird strike" by an incoming or outgoing plane at the Andrews
airport. Such strikes have not been reported.
(11) "Lack of enforcement on litter and illegal dumping." Cherokee County needs to upgrade its
enforcement practices. The Cherokee County Solid Waste plan states that the Sheriff's
department will be the agency responsible to enforce litter and dumping violations. I do not
believe this has been a priority for the Sheriff's department. Mr. Randy Wiggins and Mr.
Wayne Sullivan told me that the county has prepared three manned greenbox sites to be
placed in operation soon. They plan to place attendants at all collection sites in the future.
They stated that the problem of unacceptable materials on the ground at the collection sites
(furniture and building debris) should be resolved when all sites are manned. I was also
told by Mr. Wiggins and Mr. Sullivan that Cherokee County plans to have better
enforcement of litter laws and is committed to taking additional measures in the coming
years to resolve problems.
(12) "Fire prevention plan." Mr. Allen told me that fire extinguishers are located on landfill
equipment, in the scale house, and at the fuel storage area in the landfill. Mr. Randy
Wiggins related that county employees are told to call 911 in case of any emergency,
including fires.
I am enclosing photographs (taken on the day of my visit to the Cherokee County Landfill)
for your review.

Knowing the work of Jim Patterson, I can assure you a violation of solid waste rules is no joke to him.
His work over the years would indicate just the opposite. I am sure Mr. Prete took the actions he felt
appropriate. However, I will talk to Mr. Prete and Mr. Patterson and make sure your concerns are
addressed.
Mark Davis is the contact at EPA. His number is 404-562-8488. Mark will probably tell you that NC is
an approved State to implement the federal regulations. Enforcement in addition to the States is offered
by federal regulation through citizen suits. You can bring a suit against an owner/operator of a municipal
solid waste landfill for violation of a fedral rule.
I hope this information is helpful. I will let you know what is reported to me. Please keep me informed if
you continue to have complaints.

Dear Ms. Huff:
I have not been in Cherokee County as you indicate. I have asked that my staff look into your complaints
and make sure that we are doing everything we can to assure that this landfill is operating the way it
should be. We have not completed our complianc assurance work and it in fact will be an on -going
effort. I will provide a more detailed response to some of your questions once I have been fully briefed
on operational issues.
I will remind you that every county is required to update their comprehensive solid waste management
plans at least once every three years. That deadline is approaching for any counties that have not yet
updated their plan (July 1, 2000). Some of the issues you have raised in this communication are more
appropriately handled through that process (illegal dumping enforcement and prevention program, for
example), and I would recommend that you bring your concerns to the attention of your elected leaders
in your county as well.
Thank you for your continued interest in assuring that waste is managed appropriately in your county.
Please feel free to contact me if you have not received a response from us, at least partially addressing
your several questions, by the end of the month.

These are just some of the problems facing Cherokee County. It is apparent that this county needs technical assistance as well
as a public education plan on recycling and reduction at the source. So far, little priority has been given to saving the
environment. I can only hope that you will help with all possible resources at your disposal. Thank you

Dear Ms. Van Atta:
Please be advised that apparently you have been misinformed. I do not have any idea who the "Mr.
Allen" is that you report that I have had breakfast with - I have certainly never met him, spoken with him,
nor have I ever had a meal of any sort with him. While I have been through Cherokee County one time in
my travels, it was in 1978 - which is about 20 years before the landfill of your concerns was permitted.
I concur with Mr. Dexter Matthews' response to you that you can be assured that Mr. Jim Patterson
does not think this is a joke. Mr. Patterson takes his job and the responsibility of protecting the
environment and public health very seriously. I also can assure you that I take this matter seriously and
have asked Mr. Patterson to look into the issues and make sure that we are doing what we can.
I appreciate your concerns with the landfill and its operations. You have a right to be concerned. I do
not appreciate that you are reporting heresay and mis-information about me.
We will continue to monitor landfill operations and make sure the rules and conditions of the permit are
being followed.
