The landfill problem with Randy VVlggins and Commissioners Barbara Vicknair and Commissioner Dana
Jones. They say they will look Into it. They are right back to dumping In the Middle of the night. ThIs moming
a load came in at 4:30 a.m. Who Is weighing the garbage and monitoring what is being dumped at that hour?
We were promised that this night time dumping would stop. The Peachtree durllpSite has been a mess.
Poople are dumping construction debris, appliances, furniture, and tires outside the greets. boxes. Something

Con you not Issue a summons to comply to the law or face flnes7 Do I need to take this to a higher level to
get a decision Of that kind enforced? If they can't run a landfill, what will happeri with this plasma torch and
hazardous waste? Platise I am begging for your help. I am home after nine at night should you want to talk

Mr. Foscue, My name is Lynda Van Atta and I live on Burnt Branch Overlook. My back yard overlooks the land fill in Marble
NC. On Monday night Septerber 6, 1999 there was a truck dumping something at 8:30 pm and the first thing the next morning it
was covered up with dirt (a lot of dirt). I would say that they were hiding something. Someone is dumping their at night, on the
weekends quite often. Also in J* and August they didn!t cveH which is a violation. %en they do cover it flicy
use a 12xl2 tarp on a 50x50 hole I would say that this is not legal. If they use dirt they use a couple of scoops full which does not
do the job. I would say someone is not or cannot do their job, if they can't do it then get someone that will. This morning the smell
from the land fill was over whehning up here. Thank you for listening, Lynda

Dear Mr. Foscue,
I would like to take this opportunity to thank you for your help in addressing the problems in Cherokee County. There has been
marked improvement over the past week with the dirt cover of the landfill. The Peachtree convenience site was cleaned up and
day as 1 passed by,gates were being instaficd to fcwe it in. To diate tLIUVII C is Ltu control of the vy astestream. Due to a iack of
education, most county residents are not aware of what wastes can be disposed of in the green boxes( and how you get rid of
hazardous waste legally). There is no enforcement, so consequently, anyone can dump anything, at any time, with no
consequence. Since our county is bordered by Georgia, TN, and a tourist destination, solid waste has increased dramatically in
the past five years. We have a recycling rate of less than 1% and an inspection rate at the landfill of less than 2%. I believe that
there is no construction & demolition dump, that white goods are left at the convenience sites where their chemicals are
discharged. They are then transported to the landfill and "stored". I personally saw some buried. Yard waste is accepted at the
landfill and buried. Despite our numerous requests that something be done, nothing changed until we spoke with you. With your
permission, I would like to keep you updated on progress. Hopefully, some priority will be put on these problems and the
improved job performance will continue.

Dear Mr. Wiggins:
Pursuant to North Carolina General Statute 130A-22(a) and 15A North Carolina Admin-
istrative Code 1313, I conducted an inspection on September 14, 1999, of the Cherokee County
Landfill, Permit No. 20-02, located on Highway 74 near Marble, NC (Cherokee County). The
inspection found the Cherokee County Landfill to be in violation of certain requirements con-
tained in the North Carolina Solid Waste Management Rules, codified at 15A North Carolina
Administrative Code 13B specifically:
(1) 15A North Carolina Administrative Code 13B .1626(2)(a) requires that owners or op-
erators of MSWLF units must cover disposed solid waste with six inches of earthen
material at the end of each operating day, or at more frequent intervals if necessary to
control disease, fires, odors, blowing litter and scavenging. The Cherokee County
Landfill was operating in violation of 15A North Carolina Administrative Code 13B
.1626(2)(a) in that solid waste was not being covered at the end of each operating day
with six inches of earthen material.
(2) 15A North Carolina Administrative Code 13B .1626(l 1)(a) requires that MSWLF units
shall restrict waste into the smallest area feasible. The Cherokee County Landfill was
operating in violation of 15A North Carolina Administrative Code 13B .1626(11)(a) in
that incoming waste was being spread over a large working area.
(3) 15A North Carolina Administrative Code 13B .1626(11)(b) requires that solid waste be
compacted as densely as practical into cells. The Cherokee County Landfill was operat-
ing in violation of 15A North Carolina Administrative Code 13B .1626(11)(b) in that the
working face of the landfill was not being properly compacted.
(4) 15A North Carolina Administrative Code 13B .1626(11)(c) requires that at the conclu-
sion of each day of operation, all windblown material resulting from the operation be

collected and returned to the area by the owner or operator. The Cherokee County
Landfill was operating in violation of 15A North Carolina Administrative Code 13B
.1626(11)(c) in that windblown material had not been collected and returned to the area
at the end of each day of operation.

lina General Statute 130A-309. 1 0(f)(7) in that whole scrap tires were observed being
disposed of in the landfill working area.
Based on the foregoing, Cherokee County is hereby ordered to take the following
actions by October 1, 1999, to correct all violations as stated in this Notice of Violation
and otherwise be in compliance with the North Carolina Waste Management Rules,
codified at 15A North Carolina Administrative Code 13B and other applicable General
Statutes:
(1) Comply with 15A North Carolina Administrative Code 13B .1626(2)(a) by covering all
exposed waste with six inches of earthen material.
(2) Comply with 15A North Carolina Administrative Code 13B .1626(11)(a) by restricting
waste into the smallest area feasible.
(3) Comply with 15A North Carolina Administrative Code 13B .1626(11)(b) by compacting
waste as densely as practical into cells.
(4) Comply with 15A North Carolina Administrative Code 13B .1626(11)(c) by ensuring
that windblown material resulting from the operation is collected and returned to the
area at the conclusion of each day of operation.
(5) Comply with North Carolina General Statute 130A.10(f)(c) by taking all steps necessary
to ensure that no scrap tires are landfilled.
If the requirements above are not met on a continuing basis, enforcement action may be
taken. Remedies include assessment of administrative penalties of up to $5,000.00 per day per
violation dating from the compliance date in this Notice of Violation and/or injunctive relief,
pursuant to North Carolina General Statute 130A-18 or North Carolina General Statute 130A-
22.

I am writing in response to questions concerning the 16 ounce geotextile fabric covering the
secondary liner of the lagoon at the above referenced landfill. The fabric was initially intended to
protect the secondary liner from deer getting into the lagoon and not being able to get out
without harming the liner. The fabric was not intended for environmental protection because it
was only protecting the secondary liner of a double lined lagoon.
The County constructed a chain link fence around the lagoon to protect it from deer or other
creatures. In the meantime, the County has been removing the geotextile because it was wind
blown and could possibly plug the exit pipe so that leachate could not be drained from the
lagoon.
The fence is protecting the lagoon from wildlife. In order to prevent the possibility of plugging the
entrance, it best serves the County to remove this fabric from the lagoon. If you have any
questions or need additional information, please do not hesitate to call.
