OBSERVED VIOLATIONS:
1. Rule .0842(a)(17) approved nutrient management plans shall be followed. Permit Condition 2 This site shall be
operated and maintained in accordance with the nutrient management plan submitted by Ollie Merritt and
approved by the Division of Waste Management. A review of the land application site logs submitted
for the permit renewal showed that the monthly application rates per the approved nutrient management
plan were exceeded during the months of June 2019 (by 4,000 gallons), July (by 500 gallons) and August
(by 2,550 gallons). These three months have a “low” monthly application rate of 5,000 gallons per the
permitted disposal acreage of 6.2 acres which results in a maximum application amount per each of those
specific months of 31,000 gallons. The permit holder shall monitor application rates during all calendar
months to ensure that the monthly application rates per the approved nutrient management plan are not
exceeded. The log review showed that annual maximum application rate for this site was not exceeded.

enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
