RE: Assessment Monitoring Requirements - Cherokee County Landfill (Permit # 20-01)
Dear Mr. Allen:
The Cherokee County Landfill is in an assessment groundwater monitoring program and therefore must
complete the requirements of 15A NCAC 13B .1634. In addition to requiring sampling and analyzing for
Appendix II contaminants and characterizing the extent of the contamination, which have been done,
Rule .1634 also requires that a number of other steps be taken. Included is the initiation of an
assessment of corrective measures as described in Rule .1635 if concentrations of contaminants are
determined to be statistically greater than approved groundwater protection standards [.1634 (g)(1)(D)J.
These requirements were noted in correspondence to the County dated June 2, 1999 (see attachment).
The statistical analyses of monitoring results received thus far by the Solid Waste Section have been
comparisons of downgradient monitoring well data to upgradient or background data, but not to
groundwater protection standards. Consequently it will be necessary to complete this requirement of
Rule .1634. As stated previously, groundwater protection standards have been established for most
detected Appendix II constituents and they conform to 15A NCAC 2L groundwater standards.
Cherokee County must proceed with completing the remaining requirements of Rule .1634 within the
next 90 days. If the conditions of Rule .1634 (g) are met, it will be necessary to fulfill the requirements
of Rule .1635.
Failure to comply with solid waste management rules could result in compliance actions with
administrative penalties.

Re: Implementation of Groundwater Assessment and Corrective Action
Requirements (Permit # 20-01).
Dear Mr. Wiggins,
Cherokee County has fulfilled part of the municipal solid waste landfill
requirements of North Carolina Solid Waste Management Rules, 15A N.C.A.C.
13B, .1633 (Detection Monitoring Program). Based on groundwater monitoring
data from the facility the County is now required to proceed with the remaining
requirements of. 1634 (Assessment Monitoring Program), .1635 (Assessment of
Corrective Measures), .1636 (Selection of a Remedy), and .1637
(Implementation of the Corrective Action Program). These requirements are
intended to be self -implementing.
Groundwater protection standards have been established for most Appendix II
constituents detected in assessment monitoring. In general, the groundwater
protection standards conform to N.C. 2L Groundwater Standards or
recommended health -based concentrations determined by the Division of
Epidemiology. If needed, these groundwater protection standards are available
upon request to the Division of Waste Management, Solid Waste Section.
Additionally, the Section has received only one report of potable well data
requested in the April 10, 1996 letter. To reiterate that letter, the primary item of
concern is the close proximity and the water supply of several domiciles around
the landfill. Active water supply wells adjacent to the landfill create the
possibility of locally influencing predicted groundwater flow direction. As a
routine precaution the Section recommends the County develop a sampling
program, for Section approval, of the wells and spring(s) adjacent to the landfill
being used as a potable water supply.

RE: Eligibility for Distributions of White Goods Disposal Tax Proceeds

This is to notify you that Cherokee County will not receive further distributions of the white goods
disposal tax proceeds. As stated in GS 130A-309.87:
A county may not receive a quarterly distribution of the white goods disposal tax proceeds under GS
105-187.24 unless the undesignated balance in the county's white goods account at the end of its fiscal
year is less than the threshold amount
.... the term "threshold amount" means twenty-five percent (2501o) of the amount of white goods disposal
tax proceeds a county received, or would have received if it had been eligible to receive them under GS
130A-309.87, during the preceding fiscal year.
Cherokee county reported in its FY 2001-02 Annual Financial Information Report (AFIR) that it has an
undesignated balance of $3,435.00 in its white goods account, which is 25% or greater of the annual
amount of which the county received or would have received if fully eligible. This report was submitted
to the Local Government Commission by the county finance officer.
The Solid Waste Section is required to report to the Department which counties may not receive a
distribution of the white goods disposal tax proceeds.
Please note that this does not penalize a county for having surplus funds. Counties are expected to use
existing funds in their account for white goods expenses.
If the undesignated balance falls below the threshold amount the county may submit a statement to the
Solid Waste Section, certified by the county finance officer, that the balance is less than the threshold
amount. The Solid Waste Section will notify the Department of Revenue that the county is eligible to
receive further distributions of the white goods disposal tax proceeds.
