North Carolina Solid Waste Management Rules (Rule .1632) require a statistical
analysis of water quality monitoring data at all municipal solid waste landfills that are
subject to 40 CFR Part 258 requirements (Subtitle D). In general, a statistical analysis
of the data is required each time the monitoring wells are sampled. Rule .1632 (i) (2)
states that "Within a reasonable period of time after completing sampling and analysis,
the owner or operator shall determine whether there has been a statistically significant
increase over background at each monitoring well' for each parameter in the Appendix
I or II list. Rule .1632 0) states that "Within 14 days of completing the statistical
analysis for the analytical data from the ground -water samples, the owner or operator
shall submit to the Division a report that includes all information from the sampling
event; including... statistical analysis...." To date, Cherokee County has not submitted
to this office a statistical analysis of any data.
A statistical analysis of the monitoring data is particularly important because an
assessment monitoring program can be initiated by statistical results. Several non -
naturally occurring man-made organic contaminants have been reported in the
monitoring data from the Cherokee County Landfill. Although none of the parameters
have exceeded a 2L groundwater standard, a statistical analysis of the data is needed to
determine their significance.
Cherokee County is advised to comply with Solid Waste Management Rule .1632 by
providing the Solid Waste Section within 60 days a statistical analysis of all previous
ground -water monitoring data from the landfill. Failure to take the required action is a
violation of Solid Waste Management Rules.-

Cherokee County landfill permitted under 20-01 stopped receiving solid waste on
January 1, 1998, The County closed 14 acres of the old landfill under the landfill
construction contract. It is understood that the remaining landfill area of 1+ acres will be
closed as soon as the weather breaks, but within the required 6 months.

The Solid Waste Section has reviewed your request, submitted on your behalf by Municipal
Engineering Services Company on 19 August 1998, for a revised extension of time to finish

revised proposed schedule outlined in the letter and approves the proposed completion date of
' 30 November 1998. If, for reasons beyond Cherokee County's control, items addressed in the
19 August 1998 letter cannot be completed in the proposed time frame Cherokee County shall
& notify the Section and provide an explanation for the delay along with a revised time line.
Meanwhile, Cherokee County should maintain the existing cover and repair any erosion or
damage done to the interim cover and portions of the final cap completed thus far. If
necessary, temporary seeding or mulch shall be applied to landfill areas to minimize on-siteerosion.

As a reminder, according to Waste Management Rules 15A NCAC 13B section .1627(c)(7),
"following closure of each MSWLF unit, the owner or operator shall notify the Division that
a certification, signed by the project engineer verifying that closure has been completed in

accordance with the closure plan, has been placed in the operating record." This notification
can accompany the CQA document submitted to the Section, upon completion of the cell
closure, with the stated date that the notice was placed in the operating record.

Murphy, North Carolina. The landfill stopped receiving waste on or before January 1, 1998. The
landfill closure is being performed by Ground Improvement Techniques, Inc. (GIT). Due to
delays encountered by GIT in completing the closure, we are requesting a time extension until
November 30, 1998 to complete the landfill closure.

Dear Mr. Coffey:
MESCO requests the existing testing requirement of 4 in -place permeability tests per acre per lift
on cohesive soil liner [Section (e) of Cohesive Soil Liner under Construction Methods of the
Closure Plan] be changed to 1 permeability test per acre per lift. This modified frequency
satisfies the permeability test requirement of 1 permeability test per acre per lift outlined in the
Federal EPA, Technical Guidance Document 600/R-93/182 for Quality Assurance and Quality
Control for Waste Containment Facilities, Chapter 2, Page 84, Paragraph 2.8.4.3, Frequency of
Testing. At each permeability test location, an in -place moisture -density test will be performed.
If material consistency changes considerably, then the frequency of the in -place permeability and
moisture -density testing will be increased as determined by MESCO.
As part of this modified permeability testing frequency, MESCO requests changing the frequency
of visual classification, Atterberg Limits, moisture content, and sieve analysis tests [Section (h)
of Cohesive Soil Liner under Construction Methods of the Closure Plan] to 1 of each test per lift
per acre (constructed), provided the material consistency remains the same during construction.
If material consistency changes considerably, an adequate number of tests will be performed to
determine the suitability of the cohesive soil liner material during construction.

I am currently conducting personal research on the solid waste issues facing
Cherokee County. As you know, I appeared before the Board of Commissioners,
last November to address many of the questions I had regarding the proper disposal
of solid waste. I was assured by Mr. Eugene Morrow, Chairman, Board of
Commissioners, that a plan that would meet state policies and goals would be
forthcoming. It has now been six months since that meeting and I have not observed
any noticeable change. Therefore, I am respectfully requesting that you provide me with
the following information.
A copy of the new plan on recycling.
It is unlawful to dispose of aluminum cans in the landfill. It is posted on
the green boxes and yet no effort is made by the county to enforce this rule.
There should be, at a minimum, a collection container at each dumpsite to
collect aluminum cans. It should be clearly stated that aluminum cans
should be separated out of the other household waste and deposited in the
specially marked box. The collection of aluminum cans could be a source
of revenue for the county. County residents are not going to drive to
Andrews or Murphy every time they need to dispose of cans.
Mr. Morrow had told me, his plan was to have manned dumpsites?
It is unlawful to dispose of white goods in a landfill.
White goods are being disposed of in the old landfill. There is a huge pile
of white goods that has been there for months and it continues to grow
everyday.
It is unlawful for out -of -county residents to dispose of solid waste in the
green boxes. What is the plan for deterring this act?
Can you tell me the rule for legally disposing of the following materials
in the County? Antifreeze, PCBs, pesticides, used oil, paint and paint
solvents, lead acid batteries, tires, appliances, steel cans, liquid waste ,
hazardous waste, asbestos. Where can they be dumped or collected?
Where are the records kept on random inspections?
Where are the records kept on methane monitoring? How often do
you monitor? What plan of action is in place in the event of an elevated
reading? How would you warn the residents of Marble?
Are you presently accepting sludge at the landfill? How is it being
utilized?
Are you presently accepting solid waste from other counties?
Are you presently accepting euthanized dogs and cats, as well as other
animals, from other counties at the landfill?
A copy of your operating hours.
The hours of public operation are posted at the landfill. My question is concerning
the hours of private operation. I have observed trucks dumping garbage in the
middle of the night, on Sundays etc. Can you tell me why solid waste has to be
dumped at 6 a.m. on a Sunday morning and why residents must wake at that hour
to the sounds of trucks backing up and bulldozers moving garbage? Is there no
time when we can expect peace and quiet? Can you tell me who weighs the solid
waste loads in the middle of the night and during private hours? Who randomly
inspects what is being dumped?
3. A copy of the demonstrations regarding airports, wetlands, floodplains as required by
EPA rules 258.10, 258.11, 258.12. If the demonstrations are too extensive to copy,
then where the operating record is kept, so I might go there to read them.
4. I would like to know where the permits are kept regarding open burning of yard waste,
synthetic cover material, and co disposal of sludge with solid waste?

Re: Landfill Permit 20-01
Dear Mr. Patterson:
Cherokee County landfill permitted under 20-01 stopped receiving solid waste on
January 1, 1998. The County closed 14 acres of the old landfill under the landfill
construction contract. It is understood that the remaining landfill area of 1+ acres will be
closed as soon as the weather breaks, but within the required 6 months.

Dear Mr. Wiggins:
The Solid Waste Section has reviewed your request, submitted on your behalf by Municipal
Engineering Services Company on 10 June 1998, for an extension of time to close the above
referenced landfill. The Solid Waste Section (the Section) approves of the proposed schedule
outlined in the letter and approves the proposed completion date of 31 August 1998. If, for
reasons beyond Cherokee County's control, items addressed in the 10 June 1998 letter cannot
be completed in the proposed time, Cherokee County shall notify the Section and provide an
explanation for the delay along with a revised time line. Meanwhile, Cherokee County should
maintain the existing cover and repair any erosion or damage done to the interim cover.
Temporary seeding or mulch shall be applied to landfill areas to minimize on -site erosion if
necessary.
As a reminder, in accordance with Waste Management Rules 15A NCAC 13B section
.1627(c)(7), "following closure of each MSWLF unit, the owner or operator shall notify the
Division that a certification, signed by the project engineer verifying that closure has been
completed in accordance with the closure plan, has been place in the operating record." This
notification can accompany the CQA document submitted to the Section, upon completion of
the cell closure, with the stated date that the notice was placed in the operating record.
