This past January a letter was mailed to all landfill owner/
operators informing them that the Solid Waste Section will be
requiring semi-annual ground and surface water monitoring beginning
January 1, 1993. All landfill owner/operators were requested to
notify the Section prior to July 1, 1992, of the months they will be
performing each of their semi-annual sampling episodes for the 1993
calendar year. Please note details in the letter of January 10, 1992
that is enclosed with this letter.
As of this date the Solid Waste Section has no record of the
proposed sampling dates for next year for your facility.. Please
notify the Solid. Waste Section in writing immediately of the two
months you have chosen for sampling this coming year. A response
should be received in our office by October 15, 1992.

quality monitoring program required at sanitary landfills in North
Carolina, please contact the Solid Waste Section at (919) 733-0692.

Subject: One Time Disposal of Approximately 400 Tons of Gasoline
Contaminated Soil from the Tusquitee Work Center (Murphy,
NC) at the Cherokee County Landfill, (Permit #20-01).
Dear Mr. Cole:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid Waste
Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no -free liquids.
3. The waste shall be land applied in an area of the landfill
which has received two feet of earthen cover or in a virgin
area.
4. The waste shall be applied in a thin layer not to exceed
six inches in depth.
5. Surface water shall be diverted from the area of
application.
6. The area shall be seeded to control erosion if necessary.
7. Approval for sanitary landfill disposal is explicitly
limited to a "one-time” basis. Further approval by this
office will require submittal of a new Waste Determination
form, and (if applicable), new analytical data.
Failure to meet these conditions may result in revocation of
this approval, and subsequently, an administrative penalty. If you

I have received your laboratory analyses concerning the petroleum contaminated soils
(135 cubic yards) resulting from a leaking storage tank at Baker Furniture Company and have
discussed the data with Bill Hocutt, Solid Waste Section Chemist. We have concluded that
this soil is acceptable for use in areas that have received final soil cover at the Cherokee
County Landfill. The contaminated soil should be applied in no more than a six-inch layer
in these areas and the areas should then be stabilized with grass.
Please contact Robert Allen, Cherokee County Landfill Supervisor at 704/837-2621
to arrange a time for delivering this soil to the landfill.

Subject: Request to Landfill Soil
Baker Furniture Company - Andrews Plant
Dear Mr. Patterson:
Per our conversation in your office on January 3, 1992, with Ms. Kay Dechant and
Mr. Don Link, I am writing on behalf of Baker Furniture Company at Mr. Jerry Carroll's
direction to request approval for disposal of petroleum -containing soil in the Cherokee
County municipal landfill. Baker Furniture has used this landfill previously for disposal of
other solid waste from routine plant operations, but this would be the first use of it for soil
disposal by our firm. Initial discussion with the county and landfill managers have indicated
acceptance on their part, contingent upon regulatory approval. The following information
is provided for your review in the approval process.
PROJECT INFORMATION

storage tanks are maintained at the northwestern portion of the site. Previously, these tanks
were located underground in the same area. An apparent release of No. 2 fuel oil was
discovered and reported to the State of North Carolina by Baker Furniture on December 6,
1990. A Fluor Daniel hydrogeologist was present at the site on December 17-18, 1990 as
soils were removed from the release area to collect samples for laboratory confirmation of
field screening results. A report summarizing these activities was submitted to the State of
North Carolina by Fluor Daniel on behalf of Baker Furniture Company on March 8, 1991
(Fluor Daniel 1991a).
In response to the March 8, 1991 report, the North Carolina Department of Environment,
Health, and Natural Resources (NCDEHNR) requested that Baker Furniture install one
groundwater monitor well, collect one groundwater sample and one soil sample for total
petroleum fuel hydrocarbons (TPFH) analysis. On May 8, 1991, a Fluor Daniel
hydrogeologist was present at the site with the drilling subcontractor to install the well and
collect soil and groundwater samples. Results of the laboratory analyses indicated that the

soil contained a TPFH concentration of 60 milligrams per kilogram (mg/kg). A report
summarizing the findings of this work was submitted to the State of North Carolina by Fluor
Daniel on behalf of Baker Furniture Company on June 14, 1991 (Fluor Daniel 1991b).
Subsequently, NCDEHNR required a more detailed site investigation including multiple
groundwater monitor wells and delineation of the contaminated soil due to the close proximity
of groundwater to the affected soil. This work was performed by Fluor Daniel during August,
1991 as detailed in the associated report to NCDEHNR (Fluor Daniel 1991c). Essentially,
this work found the affected groundwater to include only monitor well MW-1 with a
somewhat wider area of low-level soil involvement. The five monitor wells were sampled
again on December 5, 1991. These results supported the August 1991 site investigation work
since only monitor well MW-1 exhibited evidence of petroleum contamination (Fluor Daniel
1992a).
A meeting was held with Ms. Kay Dechant and Messrs. Don Link and Jim Patterson of
NCDEHNR on January 3, 1991, to discuss these accumulated data and a remedial plan for
this site. Attending also were Mr. Jerry Carroll of Baker Furniture, Mr. Gene Wong of
Kohler Company and Messrs. John Whitehead and Mike Marcus of Fluor Daniel. The results
of this meeting were incorporated into a proposed remedial plan (Fluor Daniel 1992b) that
was subsequently approved by NCDEHNR. This plan was implemented on January 29-30,
1992.
REQUIREMENTS FOR DISPOSAL APPROVAL
Per our discussion on January 3, the following requirements must be met for disposal
approval to be granted:
No more than 50 gallons of material have been released to the affected soils;
2. The TFPH concentration of the soils for disposal not exceed 100 mg/kg;
3. Approval of the county landfill be obtained.
RESPONSE TO DISPOSAL REQUIREMENTS
1. Release of material not to exceed 50 gallons.
The volume of material released resulting in the original December
1990 response was not documented; however, we have no data,
information or otherwise reason to believe that it was more than 50
gallons.

2. TFPH concentration not to exceed 100 mg/kg.
The data presented in Table 1 demonstrate that the TFPH level was
slightly over the 100 mg/kg limit (104 mg/kg). No TCLP volatile
organics were detected. Although the TFPH data just exceeded the
100 mg/kg limit, other historical data from the site indicate that the
soils typically encountered either through borings or excavation were
less than the criterion (Table 2).
3. Approval of County Landfill Authority
Disposal of this soil has been discussed with Mr. Todd Reece, Manager of
Cherokee County. Since the TCLP results for VOCs were negative, the
landfill is prepared to accept this soil once NCDEHNR has granted approval.
IMPLEMENTATION
Upon receipt of your approval to dispose of approximately 135 yd3 of soil in the Cherokee
County landfill, Baker Furniture will move immediately to do so. Documentation of disposal
(e.g., scales/tipping receipt) from the landfill will be obtained from the county landfill and
forwarded to Ms. Kay Dechant of NCDEHNR as per the request in her letter to Baker
Furniture of April 6, 1992.
SUMMARY
We appreciate your review of the material presented herein for approval to dispose of
petroleum -containing soil from the Andrews plant in the Cherokee County landfill. Such
approval will greatly assist us in continuing to manage this site with the best environmental
practices for straightforward clean-up and closure.

Dust the Cherokee County Landfill, (Permit #20-01).
Dear Mr. Shuh:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid Waste
Management Division has no objection to the sanitary landfill
disposal of this waste, if in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined,
compacted, and covered in accordance with the Solid Waste
Management Rules (15A NCAC 13B).
3. The waste shall be transported and disposed in a manner
which prevents a physical hazard from dust.
4. Additionally, a resubmittal of the Waste Determination Form
and current supportive analytical data, is required on the
anniversary of this approval.
Failure to meet these conditions may result in revocation of
this approval, and subsequently, an administrative penalty. The
approval is subject to change if new regulations were to prohibit
this practice. If the process which generates the waste changes or
if the composition of the waste changes significantly, this approval
is void and re-evaluation of the waste will be required prior to
subsequent disposal.

Dear Mr. Patterson:
This letter will confirm our telephone conversation on 5-21 92 regarding the
disposal of wastewater pretreatment sludge from the Lee facility in Andrews,
North Carolina. We have been utilizing on -site storage and disposal of our
sludge waste.
During our discussion, you informed me that on -site storage and disposal is
not acceptable unless prior approval is granted from your Department. You
stated that our waste is classified as non -hazardous and may be disposed in
the future at the city landfill if proper moisture levels are achieved, and
the city landfill agrees to accept the waste. You also stated that the
existing waste disposed of on -site does not need to be removed.
Based upon this information, we will no longer store or dispose of this waste
on our property. Attached is the information concerning our facility in
Winston-Salem which generates similar waste. We are pursuing methods to dry
the sludge before disposal at the city landfill.

Please find attached the Waste Determination Questionnaire for
the Lee Company facility to be located at Centre Park Boulevard
in Winston-Salem, North Carolina. As noted in the questionnaire,
I am requesting approval to dispose of the waste at the Winston-
Salem City Landfill.
The facility is currently under construction and scheduled for
production start-up on June 1, 1992. Therefore, I'm asking you
to expedite this request as soon as possible, should questions or
concerns arise.
I have attached sample test results from our Springfield,
Missouri, and Dalton, Georgia facilities which generate similar
waste. These sample tests include results for pH, paint filter,
and TCLP analysis, as you've requested.

Subject: Disposal of Approximately 27 Tons/Week of Dried Denim
Garment Processing Sludge at the City of Winston-Salem
Landfill, (Permit #34-02).
Dear Mr. Webb:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste appears to be non -hazardous. The Solid Waste
Management Division has no objection to the sanitary.landfill
disposal of this waste, if.in accordance with the conditions listed
below:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no free liquids and can be confined,
compacted, and covered in accordance with the Solid Waste
Management Rules (15A NCAC 13B).
3. Total or TCLP leachable potassium permanganate
concentration residual in this waste is to be determined at
a detection level <1.0 ppm once this new plant is
operational (after June 1, 1992). This data should be
forwarded to the Solid Waste Section as soon as available.
4. Additionally, a resubmittal of the Waste Determination Form
and current supportive analytical data, is required on the
anniversary of this approval.
Failure to meet these conditions may result in revocation of
this approval, and subsequently, an administrative penalty. The
approval is subject to change if new regulations were to prohibit
this practice. If the process which generates the waste changes or
if the composition of the waste changes significantly, this approval
is void and re-evaluation of the waste will be required prior to
subsequent disposal.

I have received your laboratory analyses concerning the petroleum contaminated soils
(135 cubic yards) resulting from a leaking storage tank at Baker Furniture Company and have
discussed the data with Bill Hocutt, Solid Waste Section Chemist. We have concluded that
this soil is acceptable for use in areas that have received final soil cover at the Cherokee
County Landfill. The contaminated soil should be applied in no more than a six-inch layer
in these areas and the areas should then be stabilized with grass.
Please contact Robert Allen, Cherokee County Landfill Supervisor at 704/837-2621
to arrange a time for delivering this soil to the landfill.
