RE: Gas Monitoring Plan for Cherokee County Landfill
Dear Mr. Patterson:
As required by the Notice of Violation for the Cherokee County Landfill, I am
submitting a plan for monitoring the migration of methane gas from the permitted
Landfill area.
The site was originally monitored using five monitoring wells in March of 1989 to j
determine if in fact methane was migrating off the landfill property. It was
determined that indeed there was gas migrating off the property. Consequently, a
remedial plan was devised which consisted of 14 wells with a header connected to a
blower pump with the gas being sent to a flare to be burned. The remedial plans were
accepted and the facility was constructed with construction being completed on or
before September 14, 199U. The system is working as planned and the methane gas is
being burned at the " flare" with no propane gas necessary for burning other than
ignition.
The monitoring will consist of weekly tests for a year at the five monitoring points that
were used in March 1989. The monitoring points were and are noted as P-1 thru P-5.
The monitoring will be done by the Solid Waste Manager of Cherokee County, Robert
Allen. Mr. Allen will test each well weekly for percent LEL and pressure. He will
record the well number, date, time, well. pressure in inches of water, percent LEL, any
observations and weather conditions. He will note the amount of any rainfall that
occurred in the previous 24 hours. This data will be recorded on the form titled
"Landfill Gas Migration Survey Data" and they will be kept on file at the landfill
office for inspection by you at any time. The form is enclosed for your review.

that there has been a delay in shipment of the blower pump from the manufacturer,

Dear Mr. Patterson:
On June 19, 1990, I requested an extension for the installation of the methane
gas migration control system at the Cherokee County Landfill. The request for
this extension was to allow for the delivery of the equipment and installation.
The equipment has been delivered with the exception of the Rotron Blower Pump.
Originally it was supposed to have been delivered within one week of the other
equipment. The manufacturer is now telling us they will not be able to ship
until August 20, 1990 and will probably take another week before it is
delivered to the site. Consequently, I am requesting an additional extension
of the compliance date. With the way it has developed, we probably will not
get the pump on site until the end of August of which installation will take
place shortly thereafter. I am therefore requesting that our compliance date
be moved to September 14, 1990 to cover any further delays.
I would appreciate all consideration that can be given this matter. If you
have any questions, please do not hesitate to call me.

I am writing to request an extension of one month which will be July 31st,

and we do not expect them to be delivered for two or three weeks. We do have

Re: Evaluation of Ground and Surface Water Monitoring at the Cherokee
County Landfill (Permit 420-01)
Dear Mr. Allen,
The field inspection of the monitoring system at the Cherokee
County Landfill this past week confirmed a couple of problems. The
monitoring wells are not constructed properly. There is a need to
establish a surface water monitoring program.
All four of the monitoring wells at the landfill are too deep to
be effective for detection monitoring purposes. These deep wells
will be very difficult and expensive to sample. Also the results of
sampling the deep wells may be misleading. By the time potential
contamination were to migrate this deep in the aquifer, it would
already have spread so much as to possibly pose a serious threat to
the public health or the environment. At this point it would be very
difficult and expensive to perform an assessment and corrective
action if required.
The detection monitoring system should be designed to detect any
potential contaminants as early as possible. It appears that the
wells that were installed were constructed similar to drinking water
wells rather than detection monitoring wells. In order to intercept
contamination as early as possible, the monitoring wells should be
installed in the saturated soil zone of the uppermost aquifer. The
well screens should be set in the most conductive zones of this
saturated soil zone. Frequently this most hydraulically conductive
zone of the saturated soil is located in the weathered rock
(saprolite) just above bedrock. Generally the wells should be
installed no deeper than is necessary to effectively monitor the
uppermost aquifer. However, it is important to be sure there is a
sufficient level of water so that seasonal variations in the water
table would not result in a dry well at some time in the future.

The water table measurements made this past week by the Solid
Waste Section indicate that the water table is encountered fairly
close to the land surface at all the downgradient wells. Therefore
our office highly recommends that new more shallow wells be installed
to establish a more effective monitoring system. This will make
grQund-water_samp-l-ing much easier, more accurate, and less expensive. --
By establishing a shallower and more effective detection monitoring
system, you will reduce liability and the additional cost involved in
assessment and corrective action should contamination become wide-
spread before contamination is detected. It would be advisable to
contract an Engineering or Geotechnical firm that has experience with
the installation of ground -water monitoring wells to do this work.
At the two downgradient wells below the landfill (MW-3 and MW-4)
ground water was encountered within a couple of feet of land surface.
The well construction records indicate that rock was encountered at
fairly shallow depths for these wells. 'Therefore shallow monitoring
wells to a depth of 15 to 20 feet would be preferred at these
locations. The water table was encountered at about 15 feet below
land surface at the other downgradient well (MW-2). A monitoring
well of about 30 feet in depth would probably prove most effective at
this location. The upgradient well should also be screened in the
saturated soil zone. It should only be necessary to penetrate the
water table about 15 feet to set the well screen. This would enable
a much more shallow well for the upgradient well also.
In recent years surface water monitoring has been overlooked at
many solid waste management facilities. The Solid Waste Section is
now in the process of re-establishing surface water monitoring at all
sanitary landfills in North Carolina. Surface water sampling should
include a sample taken immediately upstream of the landfill facility
as well as a sample taken immediately downstream of the facility.
The streams should be sampled at the same time and for the same
parameters as the ground -water monitoring wells. Please include the
surface water data along with the ground -water analysis for all
future water quality samplings.
All monitoring wells should be designed and installed according
to the specifications in the "North Carolina Water Quality Monitoring
Guidance Document For Solid Waste Facilities". All ground and
surface water monitoring should also be performed in a manner that is
consistent with the "Guidance Document". If you have any questions

Dear Mr. O'Dell:
The enclosed Amendment to Permit for the referenced
facility is approved in accordance with G.S. 130A-294,
subject to the revised Conditions of Permit. The Conditions
of Permit supersede any conditions issued heretofore.
As described in General Condition No. 1, this permit is
not effective unless it has been properly recorded. The
General Conditions also describe provisions for sale of
property, permitted disposal, and expiration of permit.
Please note the Conditions for Construction and
Operations, which requires management of borrow soils,
describes proper operation and development, and references
further requirements.
Monitoring requirements include annual sampling for
groundwater wells and surface water locations, and explosive
gas monitoring. Monitoring for explosive gas at the
property line and maintaining compliance parameters through
operation of the LFG Migration Control System will require a
significant amount of work and experimentation. An approved
LFG Monitoring Plan, as described in Attachment 1, shall be
established as outlined in the 4-12-90 Notice of Violation.
This permit provides a planning period which Cherokee
County must use to develop a comprehensive solid waste
management plan that meets the requirements of the revised

A M E N D M E N T TO

SANITARY LANDFILL
CONDITIONS OF PERMIT:
GENERAL
1. This permit shall not be effective unless the certified copy is
filed in the Register of Deeds Office, in the grantor index
under the name of the owner of the land in the county or
counties in which the land is located. After recordation, the
certified copy shall be returned to the Solid Waste Section and
shall have indicated on it the page and book number, date of
recordation, and Registrar's seal.
2. When this property is sold, leased, conveyed or transferred, the
deed or other instrument of transfer shall contain in the
description section in no small type than that used in the body
of the deed or instrument a statement that the property has been
used as a sanitary landfill.
3. This solid waste disposal site is permitted to receive solid
waste generated within the territorial boundaries of Cherokee
County, and as defined in 10 NCAC 10G, .0101(36), except that
hazardous waste and liquid waste are prohibited from disposal at
this site.
4. This permit is issued for a period not to exceed five years from
the date of issuance. Upcoming amendments to the N.C. Solid
Waste Management rules, in accordance with EPA Subtitle D
revisions, may necessitate the modification of the construction
and operational plans prior to said review period.
CONSTRUCTION AND OPERATION
1. This permit is for construction according to the attached plans
with the following conditions:
a. The least permeable soil, as identified in the laboratory
testing report shall be stockpiled and utilized for final
cover.
b. Construction and operation shall be completed in accordance
with the revisions noted on the drawings.

Additional conditions and revisions of the approved plans shall
be approved by the North Carolina Solid Waste Management
Division.
-2. All sedfinentat-ion/erosion control activities -will be -conducted
in accordance with the Sedimentation Control Act (15 NCAC 4).
3. This facility shall conform to the operating procedures in Rule
.0505 of the Solid Waste Management Rules, and the conditions
specified herein.
4. According to the specifications and operating conditions for the
LFG Flare and pit burner, adequate separation distances shall be
determined by the Section and maintained.
5. A closure and post -closure plan must be submitted for approval
at least 90 days prior to closure or partial closure. The plan
must include all steps and measures necessary to close and
maintain the facility in accordance with all rules in effect at
that time. The final cover will be evaluated based upon
performance and upgraded if necessary.
MONITORING REQUIREMENTS
1. Four (4) ground water monitoring wells shall be located as shown
on the construction plans.
2. Cherokee County shall sample monitoring wells and surface waters
(two locations on plan) annually as per the N.C. Water Quality
Monitoring Guidance Document.
3. A readily accessible, unobstructed path shall be initially
cleared and maintained so that four-wheel drive vehicles may
access the monitoring wells at all times.
4. Ground water quality at this facility is subject to the
classification and remedial action provisions referenced in Rule
. 0503 (2) (d) of 10 NCAC 10G.
5. Cherokee County shall monitor for explosive gases at the
property line as described in an approved plan, prepared in
accordance with Attachment 1: 09-14-89 letter, Phase II -
Remedial Action.

RE: Compliance Order without Administrative Penalty issued January
9, 1989 - Cherokee County Landfill Permit 420-01.
Dear Mr. Green:
The referenced Compliance Order requires implementation of a
two-phase program to correct a violation -of 10 NCAC 10G .0503
(2)(a)(ii). Cherokee County has satisfied Phase I of the program.
The Solid Waste Section received preliminary plans on June 20,
1989, submitted by Municipal Engineering in behalf of Cherokee
County. This submittal marks the completion of Phase I - Monitoring
and Assessment. Phase II - Remedial Action requires the
implementation of a remediation plan which satisfies 10 NCAC 10G
.0503 (2)(a)(ii). Originally, the Section had planned to include
Phase II in the proposed Amendment to Permit application, but, due to
delays in completing the application, the Section has elected to
address the migration issue separately. The "area of concern" has
been adequately addressed in the proposed construction plan drawings.
Phase II - Remedial Action
Landfill Gas (LFG) will continue to be generated for a number of
years. The duration of methanagenesis is largely dependent on
landfill composition and its environment. Thus, the nature of the
problem establishes two goals:
(1) initially, installing and operating a migration control
system to achieve the required compliance parameters; and
(2) developing a "LFG Monitoring Plan" to maintain and
monitor for compliance.

Remedial action must satisfy both goals. Construction of the
migration control system should begin as soon as possible. The
County (and consultant) is encouraged to interact with the Section
throughout this process. Concurrently, the Remediation Plan must be
completed, submitted, and approved by the Solid Waste Section, and it —
must include the following minimal information.
1. LFG Migration Control System
Conceptually, the preliminary plans are adequate in addressing
general design. Installation and operation of the system must
consider the appropriate provisions, and complete plans shall
include:
A. A comprehensive project scope describing system design,
anticipated volume for LFG extracted from the landfill,
scheduling, etc...
B. Expanded monitoring probe system
C. Details on condensate management
(1) Anticipated volumes and capacities
(2) Collection devices
(3) Documentation of approved disposal
D. LFG Flare
(1) DEM Air Quality Permit
(2) Specifications
(3) Operating provisions
E. Construction provisions
(1) Well Construction
(a) Drilling logs shall be recorded and submitted to
the Solid Waste Section, and should include total
depth, level of liquids accumulated in the
borehole, completion details, and any pertinent
observations.
(b) Drilling shall not disturb the base of the
landfill.
(c) Four feet of pure bentonite backfill shall be
installed if the base of the landfill is
encountered.
(d) Drilling shall cease when liquids accumulate in
the borehole.
(e) Wells shall be capped upon completion.

(2) Collection System
(a) Trenching, installation of piping, and
backfilling shall be completed in a timely manner
in orde-r—to minimize nuisances
(b) specifications for vessels, piping, and
processing equipment shall be included.
(c) Pipelines markers will be installed to
locate collection lines.
F. Health and Safety Plan
adequately
(1) A plan identifying the potential hazards during
construction and operation of the system shall be
prepared. Accordingly, the plan shall describe safety
measures (including levels of Personal Protective
.Equipment, PPE) necessary for given situations.
Consult the Federal Right -to -Know Act and OSHA for
assistance.
G. As -built drawings (3 sets) will be submitted upon
completion of construction.
2. LFG Monitoring Plan
At a minimum the plan must include the following:
A. Name of the individual responsible for operation of the
control system and implementation of the Monitoring Plan.
B. After compliance is achieved, the minimum initial
monitoring frequency shall be weekly for the first year.
Subsequent scheduling will be dependent on performance.
C. Records of monitoring information for the probes at the
property line shall include:
(1) % LEL, methane concentration, and probe pressure;
(2) data, time, and weather conditions (24 hour period
prior to) when the measurements were taken; and
(3) the individual who performed/recorded the
measurements.
D. A methodology for correlating the operating parameters of
the migration control system and the parameters at the
monitoring probes. Testing procedures, equipment, and
maintenance requirements should be described in this
discussion.

E. A procedure of notifying the Solid Waste Section when
noncompliance parameters are observed. All information
shall be provided orally within 24 hours from the time the
owner/operator becomes aware of the circumstances. If
--requested-a—written submission shall—beprovzaea within 7
days of the event and will contain all pertinent
information including:
(1) period of noncompliance and the cause,
(2) corrective actions taken or planned, and
(3) if not corrected, the anticipated time it will
continue.
F. An annual report shall be submitted to the Solid Waste
Section discussing system performance, compliance, and
proposed modifications to the plan. System performance can
be described using the methodology referenced in #2.D.,
including data on gas quality and corresponding rates of
gas extraction. These discussions will substantiate any
proposed plan modifications.
The Solid Waste Section finds these requirements practicable and
necessary to effectively manage landfill gas migration at the

The only means of compacting the trash is by utilizing a D-8 dozer
for spreading and compacting and due to the insufficient
compaction achieved by this method, it is recommended that trash
be compacted in 12" layers not to exceed 24" layers. The best
compaction would be realized by operating the dozer in such a
manner as to press the trash upgrade against the existing ground
surface, rather than operating parallel to the toe dike.

division, to prevent unauthorized entry.
(b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.

and maintained in good condition.
(d) Dust control measures shall be implemented where necessary.

unless the owner/operator approves and the removal is not

and perforated sufficiently to ensure that no liquid or hazard-
ous waste is contained therein.
(11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS
(a) A site shall only accept those solid wastes which it is permitted to
receive.
(b) No hazardous, liquid, or infectious waste shall be accepted or
disposed of in a sanitary landfill except as may be approved by
the division.
— (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste,
and other animal waste delivered to the disposal site shall be
covered immediately.
— (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as
amended through January 1,1985, may be disposed of separate
and apart from other solid wastes at the bottom of the working
face or in an area not contiguous with other disposal areas, in
either case, in virgin soil. Separate areas shall be clearly marked
so that asbestos is not exposed by future land -disturbing activi-
ties. The waste shall be covered immediately with soil in a
manner that will not cause airborne conditions. Copies of 40
CFR 61 may be obtained and inspected at the Solid and Hazard-
ous Waste Management Branch, Division of Health Services,!

(12) MISCELLANEOUS REQUIREMENTS

Pursuant to NCGS 130A-22(a) and to NCAC 10G, I conducted an inspection on
March 22, 1990 of the Cherokee County Sanitary Landfill, Permit No. 20-01, located
in Cherokee County on State Road 1515 near Marble, North Carolina. This
inspection found the Cherokee County Sanitary Landfill to be in violation of
certain requirements contained in the North Carolina Solid Waste Management Rules,
codified at 10 NCAC 10G specifically:
10 NCAC 10G .0505(1)(a) requires that construction plans shall be approved
and followed. The Cherokee County Landfill was operating in violation of
NCAC.10G .0505(1)(a) in that the landfilling limits as specified in
landfill construction plan dated September, 1972 have been exceeded.

10 NCAC 10G .0505(1)(b) requires that specified monitoring and reporting
requirements shall be met. The Cherokee County Landfill was operating in
violation of 10 NCAC 10G .0505(1)(b) in that the conditions set forth in - the
compliance order dated January 9, .1989 and the subsequent letter dated
September 14, 1989, specifying monitoring requirements for explosive gases at
the property line have not been satisfied.
10 NCAC 10G-.0505(4)(b) requires that adequate erosion controlmeasuresshall
be practiced to prevent excessive on -site erosion. The Cherokee County
Landfill was operating in violation of 10 NCAC 10G .0505(4)(b) in that
adequate erosion control measures had not been practiced to prevent excessive
on -site erosion.

COMPLIANCE SCHEDULE
Based upon the foregoing, the County of Cherokee is hereby ordered o take
the following actions to correct all violations as stated in this Notice of
Violation, and otherwise be in compliance with the North Carolina Solid Waste
Management Rules, codified at 10 NCAC 10G:.
1. By June 1, 1990, comply with 10 NCAC 10G .0505(1.)(a) by submitting to the. N.
C. Solid Waste Management Section for approval a complete application for
landfill expansion.
2(a).By June 30, 1990, comply with 10 NCAC 1OG .0505(1)(b) by installing and
operating a landfill gas migration control system to achieve the required
compliance parameters.
2(b).By July 30, 1990, develop a landfill gas monitoring plan to maintain and
monitor for compliance.
3. By June 1, 1990 Comply with 10 NCAC 1OG .0505(4)(b) by repairing all eroded
areas on the landfill surface.
If the requirements above are not met on a continuing basis, enforcement
action may be taken:, Remedies include assessment of Administrative Penalties of
up to $5000.00 (five thousand dollars) per day per violation, dating from the
compliance date in this order, and/or injunctive relief, pursuant to G.S. 13OA-22
or G.S. 130A-18.

(c) Completed areas shall be adequately sloped to allow surface
water runoff in a controlled manner.
(6) VEGETATION REQUIREMENTS
(a) Within six months after final termination of disposal operations
at the site on a major part thereof or upon revocation of a
permit, the area shall be stabilized with native grasses.
(b) Temporary seeding will be utilized as necessary to stabilize the
site.
(7) WATER PROTECTION REQUIREMENTS
(a) The separation distance of four (4) feet between waste and
water table shall be maintained unless otherwise specified by
the division in the permit.
(b) Solid waste shall not be disposed of in water.
(c) Leachate shall be contained on site or properly treated prior to
discharge. An NPDES permit may be required prior to the dis-
charge of leachate to surface waters.
(8) ACCESS AND SECURITY REQUIREMENTS
(a) The site shall be adequately secured by means of gates, chains,
berms, fences, and other security measures approved by the
division, to prevent unauthorized entry.
(b) An attendant shall be on duty at the site at all times while it is
open for public use to ensure compliance with operational
requirements.
— (c) The access road to the site shall be of all-weather construction
and maintained in good condition.
— (d) Dust control measures shall be implemented where necessary.

(b) Equipment shall be provided to control accidental fires or
arrangements shall be made with the local fire protection
agency to immediately provide fire -fighting services when
needed.

division within 24 hours and a written notification shall be
submitted within 15 days.
— (d) The removal of solid waste from a sanitary landfill is prohibited
unless the owner/operator approves and the removal is not

I conducted a Notice of Violation compliance inspection at the Cherokee
County landfill, permit #20-01, located in Cherokee County on state road 1515
near Marble, North Carolina on September 25, 1990. All violations noted on the
April 12, 1990, Notice of Violation letter to Cherokee County, except development
of a landfill gas monitoring plan, have been addressed/corrected. The landfill
gas monitoring plan is due October 14, 1990.
The methane gas migration control system is operational and working
effectively. The flare is being fueled exclusively be methane being generated
at the landfill.

Treatment Sludge at the Cherokee County Landfill (Permit

Dear Mr. Williams:
The Solid Waste Management Division has received a request for
characterization of the subject waste. Based upon the submitted
information, the waste is non -hazardous. The Solid Waste Management
Division has no objection to the sanitary landfill disposal of the
waste if in accordance with the conditions listed below.
This approval is being issued as a replacement to the 9/28/90
approval letter for disposal of this waste at the Clay County
Landfill. The Clay County site does not have sufficient finished
area to accept all of the sludge.
The conditions of disposal are:
1. The owner/operator of the landfill approves the disposal.
2. The waste contains no -free liquids.
3. The sludge is used as a soil conditioner and incorporated
within the final two feet of earthen cover at agricultural
rates.
4. Approval for sanitary landfill disposal is explicitly
limited to a "one-time" basis. Further approval by this
office will require submittal of a new Waste Determination
form, and (if applicable), new analytical data.
The landfill may place limits on the amount of sludge received
based upon available capacity and weather conditions.

This procedure will be used by the Solid Waste Management.,
Division to determine whether a waste is (1) hazardous as defined by
10 NCAC 10F, and (2) suitable for disposal at a solid waste ---
management facility.
The types of wastes that will be evaluated by this procedure are
primarily, but not exclusively,. industrial and commercial wastes and
sludges, and Publicly Owned Treatment Works Sludges.
The Solid Waste Management Division reserves the right to
request additional information or waive some of the requirements
based on the type of waste if it deems necessary. The Division may
also require sane wastes to be treated or altered to render the
wastes environmentally immobile prior to disposal at a sanitary
landfill. Wastes disposed at sanitary landfills must be non -liquid
which can be properly managed in accordance with the "Solid Waste
Management Rules". APPROVAL TO DISPOSE OF THE WASTE SHALL ALSO BE
OBTAINED FROM THE OWNER OR OPERATOR OF THE LANDFILL PRIOR TO
DISPOSAL.

Dear Mr. O'Dell:
The enclosed Amendment to Permit for the referenced
facility is approved in accordance with G.S. 130A-294,
subject to the revised Conditions of Permit. The Conditions
of Permit supersede any conditions issued heretofore.
As described in General Condition No. 1, this permit is
not effective unless it has been properly recorded. The
General Conditions also describe provisions for sale of
property, permitted disposal, and expiration of permit.
Please note the Conditions for Construction and
Operations, which requires management of borrow soils,
describes proper operation and development, and references
further requirements.
Monitoring requirements include annual sampling for
groundwater wells and surface water locations, and explosive
gas monitoring. Monitoring for explosive gas at the
property line and maintaining compliance parameters through
operation of the LFG Migration Control System will require a
significant amount of work and experimentation. An approved
LFG Monitoring Plan, as described in Attachment 1, shall be
established as outlined in the 4-12-90 Notice of Violation.
This permit provides a planning period which Cherokee
County must use to develop a comprehensive solid waste
management plan that meets the requirements of the revised

SANITARY LANDFILL
CONDITIONS OF PERMIT:
GENERAL
1. This permit shall not be effective unless the certified copy is
filed in the Register of Deeds Office, in the grantor index
under the name of the owner of the land in the county or
counties in which the land is located. After recordation, the
certified copy shall be returned to the Solid Waste Section and
shall have indicated on it the page and book number, date of
recordation, and Registrar's seal.
2. When this property is sold, leased, conveyed or transferred, the
deed or other instrument of transfer shall contain in the
description section in no small type than that used in the body
of the deed or instrument a statement that the property has been
used as a sanitary landfill.
3. This solid waste disposal site is permitted to receive solid
waste generated within the territorial boundaries of Cherokee
County, and as defined in 10 NCAC 10G, .0101(36), except that
hazardous waste and liquid waste are prohibited from disposal at
this site.
4. This permit is issued for a period not to exceed five years from
the date of issuance. Upcoming amendments to the N.C. Solid
Waste Management rules, in accordance with EPA Subtitle D
revisions, may necessitate the modification of the construction
and operational plans prior to said review period.
CONSTRUCTION AND OPERATION
1. This permit is for construction according to the attached plans
with the following conditions:
a. The least permeable soil, as identified in the laboratory
testing report shall be stockpiled and utilized for final
cover.
b. Construction and operation shall be completed in accordance
with the revisions noted on the drawings.

Additional conditions and revisions of the approved plans shall
be approved by the North Carolina Solid Waste Management
Division.

3. This facility shall conform to the operating procedures in Rule
.0505 of the Solid Waste Management Rules, and the conditions
specified herein.
4. According to the specifications and operating conditions for the
LFG Flare and pit burner, adequate separation distances shall be
determined by the Section and maintained.
5. A closure and post -closure plan must be submitted for approval
at least 90 days prior to closure or partial closure. The plan
must include all steps and measures necessary to close and
maintain the facility in accordance with all rules in effect at
that time. The final cover will be evaluated based upon
performance and upgraded if necessary.
MONITORING REQUIREMENTS
1. Four (4) ground water monitoring wells shall be located as shown
on the construction plans.
2. Cherokee County shall sample monitoring wells and surface waters
(two locations on plan) annually as per the N.C. Water Quality
Monitoring Guidance Document.
3. A readily accessible, unobstructed path shall be initially
cleared and maintained so that four-wheel drive vehicles may
access the monitoring wells at all times.
4. Ground water quality at this facility is subject to the
classification and remedial action provisions referenced in Rule
.0503(2)(d) of 10 NCAC 10G.
5. Cherokee County shall monitor for explosive gases at the
property line as described in an approved plan, prepared in
accordance with Attachment 1: 09-14-89 letter, Phase II -
Remedial Action.

RE: Compliance Order without Administrative Penalty issued January
9, 1989 - Cherokee County Landfill Permit #20-01.
Dear Mr. Green:
The referenced Compliance Order requires implementation of a
two-phase program to correct a violation of 10 NCAC 10G .0503
(2)(a)(ii). Cherokee County has satisfied Phase I of the program.
The Solid Waste Section received preliminary plans on June 20,
1989, submitted by Municipal Engineering in behalf of Cherokee
County. This submittal marks the completion of Phase I - Monitoring
and Assessment. Phase II - Remedial Action requires the
implementation of a remediation plan which satisfies 10 NCAC 10G
.0503 (2)(a)(ii). Originally, the Section had planned to include
Phase II in the proposed Amendment. to Permit application, but, due to
delays in completing the application, the Section has elected to
address the migration issue separately. The "area of concern" has
been adequately addressed in the proposed construction plan drawings.
Phase II - Remedial Action
Landfill Gas (LFG) will continue to be generated for a number of
years. The duration of methanagenesis is largely dependent on
landfill composition and its environment. Thus, the nature of the
problem establishes two goals:
(1) initially, installing and operating a migration control
system to achieve the required compliance parameters; and
(2) developing a "LFG Monitoring Plan" to maintain and
monitor for compliance.

Remedial action must satisfy both goals. Construction of the
migration control system should begin as soon as possible. The
County (and consultant) is encouraged to interact with the Section
throughout this process. Concurrently, the Remediation Plan must be
completed, —submitted, —and approved by the Solid Waste—Sect-i-on-,—and_it_
must include the following minimal information.
1. .LFG Migration Control System
Conceptually, the preliminary plans are adequate in addressing
general design. Installation and operation of the system must
consider the appropriate provisions, and complete plans shall
include:
A. A comprehensive project scope describing system design,
anticipated volume for LFG extracted from the landfill,
scheduling, etc...
B. Expanded monitoring probe system
C. Details on condensate management
(1) Anticipated volumes and capacities
(2) Collection devices
(3) Documentation of approved disposal
D. LFG Flare
(1) DEM Air Quality Permit
(2) Specifications
(3) Operating provisions
E. Construction provisions
(1) Well Construction
(a) Drilling logs shall be recorded and submitted to
the Solid Waste Section, and should include total
depth, level of liquids accumulated in the
borehole, completion details, and any pertinent
observations.
(b) Drilling shall not disturb the base of the
landfill.
(c) Four feet of pure bentonite backfill shall be
installed if the base of the landfill is
encountered.
(d) Drilling shall cease when liquids accumulate in
the borehole.
(e) Wells shall be capped upon completion.

(2) Collection System
(a) Trenching, installation of piping, and
backfilling shall be completed in a timely manner

Specifications for vessels, piping, and
processing equipment shall be included.

F. Health and Safety Plan

(1) A plan identifying the potential hazards during
construction and operation of the system shall be
prepared. Accordingly, the plan shall describe safety
measures (including levels of Personal Protective
:Equipment, PPE) necessary for given situations.
Consult the Federal Right -to -Know Act and OSHA for
assistance.
G. As -built drawings (3 sets) will be submitted upon
completion of construction.
2. LFG Monitoring Plan
At a minimum the plan must include the following:
A. Name of the individual responsible for operation of the
control system and implementation of the Monitoring Plan.
B. After compliance is achieved, the minimum initial
monitoring frequency shall be weekly for the first year.
Subsequent scheduling will be dependent on performance.
C. Records of monitoring information for the probes at the
property line shall include:
(1) % LEL, methane concentration, and probe pressure;
(2) data, time, and weather conditions (24 hour period
prior to) when the measurements were taken; and
(3) the individual who performed/recorded the
measurements.
D. A methodology for correlating the operating parameters of
the migration control system and the parameters at the
monitoring probes. Testing procedures, equipment, and
maintenance requirements should be described in this
discussion.

E. A procedure of notifying the Solid Waste Section when
noncompliance parameters are observed. All information
shall be provided orally within 24 hours from the time the
owner/operator becomes aware of the circumstances. If
—-r-eque-sted a —written -submission shall be provided within 7-
--days of the event and will contain all pertinent
information including:
(1) period of noncompliance and the cause,
(2) corrective actions taken or planned, and
(3) if not corrected, the anticipated time it will
continue.
F. An annual report shall be submitted to the Solid Waste
Section discussing system performance, compliance, and
proposed modifications to the plan. System performance can
be described using the methodology referenced in 02.D.,
including data on gas quality and corresponding rates of
gas extraction. These discussions will substantiate any
proposed plan modifications.
The Solid Waste Section finds these -requirements practicable and
necessary to effectively manage landfill gas migration at the
Cherokee County Landfill. If you have any questions, please contact

The county must locate a new borrow site or expand the existing
site within this 1 1/2 year period in order to maintain continuous
service from the landfill.
3(c) The extension should be implemented by building a compacted toe
dike of earth as needed for a particular work area (approximately

The only means of compacting the trash is by utilizing a D-8 dozer
for spreading and compacting and due to the insufficient
compaction achieved by this method, it is recommended that trash
be compacted in 12" layers not to exceed 24" layers. The best
compaction would be realized by operating the dozer in such a
manner as to press the trash upgrade against the existing ground
surface, rather than operating parallel to the toe dike.
The equipment available at the site consists of the following:
1 - 7 Yard Pan
1 - D-8 Dozer
1 - 955 Loader
2 - Dump Trucks
There is one man (landfill operator) at the landfill, six days a
week.
Any landfill needs a compactor to fully utilize the available
space, and it is recommended that the County purchase a
reconditioned compactor to improve the operation of the landfill.

Cherokee County Landfill, Permit #20-01, on September 25, 1990
I conducted a Notice of Violation compliance inspection at the Cherokee
County landfill, permit #20-01, located in Cherokee County on state road 1515
near Marble, North Carolina on September 25, 1990. All violations noted on the
April 12, 1990, Notice of Violation letter to Cherokee County, except development
of a landfill gas monitoring plan, have been addressed/corrected. The landfill
gas monitoring plan is due October 14, 1990.
The methane gas migration control system is operational and working
effectively. The flare is being fueled exclusively be methane being generated
at the landfill.

Re: Methane Gas Migrations Control
for Cherokee County
Dear Mr. Patterson:
I am writing to request an extension of one month which will be July 31st,
for the gas control system for Cherokee County. The reason for the delay is
that the pump flare, and condensate collection tanks have not been delivered,
and we do not expect them to be delivered for two or three weeks. We do have
the wells and header system built along with the blower building, flare pad
and condensate structure. The electricity has been installed in the building
so that when the equipment does arrive it will just be a matter of
installation.
We would appreciate any consideration that can be given this matter. If you
have any questions, please do not hesitate to call.
