OBSERVED VIOLATIONS:
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. This facility was notified in 2005 for use as a less than 2 acre notified land clearing and inert debris landfill (NLCID). 2. The total disposal area for this facility will be under two acres in size.
3. The fill activity is not exempt from, and must comply with all other Federal, State, or local laws, ordinances, Rules, regulations or orders, including but not limited to zoning restrictions, flood plain restrictions, wetlands restrictions, sedimentation and erosion control requirements and mining regulations.
4. This facility shall only accept land clearing waste, inert debris, untreated wood and yard trash. 5. At the time of the inspection, this facility had not been constructed in accordance with the design and plans submitted to the Section along with the notification.
6. Identify the site property lines with flagging, stakes or paint indicating lines on trees that represent the property boundary for visual inspection. 7. Place permanent markers at the 100-foot buffer line for the limits of the NLCID waste disposal from property lines. 8. Place permanent edge of waste markers, visible one to the next around the limits of the less than 2 acre NLCID. 9. The operator and his staff were dumping land clearing waste outside the limits of the NLCID. The facility roads were not constructed and vehicles were getting stuck and unable to dump in the limits of the NLCID.
Waste dumped outside of the NLCID limits must be disposed of properly within the limits of the NLCID. 10. Access roads shall be of all-weather construction and properly maintained. 11. The site is still mostly heavily vegetated with a small area pushed up with equipment reportedly to be the initial disposal area. There were no markers indicating the limits of the NLCID or the buffers as required. 12. The site should be constructed in accordance to the drawings submitted to the Section to manage the site properly to
include the necessary sedimentation and erosion control measures. 13. Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.
14. Slopes should be maintained at 3:1 during grading, filling and excavation. 15. Adequate erosion control measures, structures or devices shall be utilized to prevent silt from leaving the site and to prevent excessive on site erosion.
16. Corrective measures are necessary at this facility and should be under way correct issues noted in the comments above.
