The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On March 12, 2020, Chuck Kirchner conducted a comprehensive inspection of the Town of Elon – Kernodle Property YWN facility located on Elon-Ossipee Road across from Springfield Road, in Elon, Alamance County.
1. The yard waste notification (YWN) is located on an undeveloped parcel of land owned by the Town of Elon. 2. The YWN site is located across from the intersection of Springfield Drive and Elon-Ossipee Road. 3. The area available for the YWN is ~ 1.3 acres. 4. This site is used exclusively by the Town of Elon and is not open to the public.
5. Town of Elon may use alternate approved composting sites. Recommend reviewing any proposed site(s) YWN or Solid Waste permit prior to taking leaves to other facilities. Town may be required to remove any leaves from unpermitted facilities. 6. Mr. Murphy stated this site has not been used in about 4 years but the town would like to keep it available. 7. The Town of Elon receives ~ 2000 yd3 of leaves annually. 8. Ensure processed and unprocessed material on site is less than 6000 yd3 quarterly. Records
should be maintained of the amount of leaves accepted. 9. Certain pathogens have commonly been found in leaf waste. Any leaf compost that will be re-distributed to the public or used in a public area shall maintain monitoring requirements:
(a) Temperature monitoring shall be maintained at or above 55 degrees Celsius (131 degrees F) for three days and aerated to maintain elevated temperatures. (b) The temperature of all compost produced shall be monitored sufficiently to ensure that the pathogen reduction criteria are met. Onsite thermometers shall be calibrated annually and records of calibration shall be maintained. 10. The facility has been stabilized with a recycled asphalt base. Exterior areas have a good grass cover. 11. Open burning of waste is prohibited. 12. Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the
incident. 13. The Town of Elon has conditional approval to use the site as a temporary disaster debris staging site (TDDSS). The TDDSS number is: DS01-011. 14. Access roads are of all-weather construction. 15. The facility is secured by a locked gate. 16. The facility has a proper sign.
17. The Yard Waste Notification expires on June 1st each year. A YWN application shall be submitted annually prior to June 1st to keep site active.
