The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS: 01 – It was noted on the last inspection that all trees and the woody growth was in need of cutting. All the trees are gone. Some small saplings coming up and need to be cut. Woody growth had been mowed down. 02 – Keep the broom straw cut down so the landfill can be inspected by State & County Staff to ensure no issues arise.
03 – It was also noted on the last inspection to keep low areas repaired where there is standing water. 04 – During this inspection there was an area on the West side landfill that has ponded water on top of the landfill. This will need to be addressed by filling with soil to prevent head pressure from causing a leachate breakout. 05 – During this inspection it was noted on the East side landfill there is bad erosion at a swale to shed off surface water from the landfill. 06 – Further inspection of this area it was noted that the surface water has undercut an area on the outside toe of the landfill. This needs to be repaired before a leachate breakout occurs. 07 – This undercut area has some large pine trees over the area in which if they fall could also pull up the roots and possibly cause an issue at the toe of the landfill.
08 – Upon close inspection of this undercut area, there was lumber and rip-rap (rock) inside of this undercut area. 09 – At the next swale there was corrugated pipe found that had been hit by a mower. There may be pipes at the ends of all the swales that we looked for by using a probe but didn’t find. 10 – County Staff will be looking for the closure plans/drawings to see if drainage pipes were placed on/under the toe of the landfill. If they were, this could be why the undercutting is taking place at the one area. 11 – John College will keep in contact with County Staff to see if closure plans/drawings are found. 12 – No leachate breakouts were noted at this time. There was Iron rich water draining from the undercut area at a steady drip/flow. 13 – Edge of waste markers are up. There is one that needs to be replaced on the East side landfill. 14 – Monitoring wells have locks and are tagged. Some tags are in need of getting faded information re-stamped. There were also some of the wells that had holes drilled into to cap with access for contamination potential.
