Caldwell Street Charlotte, North Carolina H&H Job No. CCR-003 1.0 Introduction In accordance with our authorized scope of work, Hart & Hickman, PC (H&H) has performed a Phase II Environmental Site Assessment (ESA) of the commercial property located at 1138 N. Caldwell Street and 510-516 E. 151h Street in Charlotte, Mecklenburg County, North Carolina (Site or subject Site). A Site location map is provided as Figure 1. The Site consists of two contiguous parcels of land (Parcel Identification Numbers 08106504 and 08106505) that total approximately 1.32 acres. The northwestern parcel is developed with an approximate 1,380-square foot (sq ft) former residence and an approximate 26,237-sq ft multi - tenant retail building. The former residence is undergoing renovations for a proposed restaurant. Tenants of the retail building include a food market, art studios, a bicycle repair shop, a dance studio, and a distillery. The southeastern parcel consists primarily of a gravel parking lot. H&H recently conducted Phase I ESA activities at the Site and identified the following Recognized Environmental Condition (REC): • A heating oil underground storage tank (UST) is located on the northwest side of the retail building. The Site owner, Mr. Carlos Espin, stated that in 2006/2007, the UST was filled in place with sand. No closure soil samples were collected during closure of the UST. Based on the lack of closure soil sampling, H&H identified the heating oil UST as a REC. In November 2019, H&H performed soil sampling activities at the Site to evaluate potential impacts from the heating oil UST. The methods and results of the assessment activities are detailed in the following sections. 1 SAAAA-Master Projects\Carolina Capital Real Estate Partners (CCR)\CCR-003 E. 15th Street\Report\Phase II ESA - Area 15 Property (2-13-20).docx ■ hart hckman SMARTER ENVIRONMENTAL 56L UTION5 2.0 Phase 11 ESA Sampling Activities 2.1 Utility Locating/Geophysical Survey Prior to conducting Phase II ESA sampling activities, H&H contacted North Carolina 811 One - Call, the public utility locating service, to mark subsurface utilities at the Site. H&H also contracted Probe Utility Locating, Inc. (PUL), a private utility locator, to screen the proposed boring locations for subgrade utilities using ground -penetrating radar (GPR) and electromagnetic methods. PUL also utilized GPR to mark the approximate extent of the heating oil UST. Based on the results of the GPR survey, the closed -in -place heating oil UST appears to be approximately 500 gallons in capacity. 2.2 Soil Sampling On November 7, 2019, H&H contracted Mid South Environmental (Mid South) to advance two borings (SB-1 and SB-2) adjacent to each end of the UST using direct -push technology (DPT) methods. Soil boring locations are depicted on Figure 2. A decontaminated stainless -steel hand auger was used to advance each boring to a depth of approximately 5 ft below ground surface (bgs) to clear the boring of potential subsurface utilities. Soil borings were then advanced beyond 5 ft bgs using DPT methods. Continuous soil samples were collected from each boring, logged for lithological description, and field screened for the presence of staining, odors, and volatile organic vapors using a calibrated photoionization detector (PID). Based on field screening results, one soil sample was collected for laboratory analysis from the 6-8 ft depth interval (estimated depth below the UST) in each boring. Soil boring logs including PID screening results are included in Appendix A. Soil samples were placed directly into laboratory -supplied glassware, labeled, and placed on ice in a laboratory -supplied cooler. The cooler was shipped under standard chain of custody protocols to Pace Analytical Laboratory (Pace) in Huntersville, North Carolina. Soil samples SB-1 (6-8 ft) and SB-2 (6-8 ft) were analyzed for Total Petroleum Hydrocarbons -Diesel Range Organics (TPH- 2 SAAAA-Master Projects\Carolina Capital Real Estate Partners (CCR)\CCR-003 E. 15th Street\Report\Phase II ESA - Area 15 Property (2-13-20).docx ■ hart hickman SMARTER ENVIRONMENTAL 56L UTION5 DRO) and TPH-Gasoline Range Organics (TPH-GRO) by EPA Method 8015C. H&H submitted additional soil from SB-1 and SB-2 for "risk -based" analyses in the event that TPH-DRO or TPH-GRO concentrations exceeded the North Carolina Department of Environmental Quality (DEQ) Action Levels of 100 mg/kg and 50 mg/kg, respectively. Risk -based analyses for samples SB-1 and SB-2 included volatile organic compounds (VOCs) by EPA Method 8260D, semi-VOCs (SVOCs) by EPA Method 8270E, and volatile petroleum hydrocarbons (VPH) and extractable petroleum hydrocarbons (EPH) by the Massachusetts Department of Environmental Protection (MADEP) method. Based on the TPH results, only SB-2 was analyzed by the laboratory for risk - based parameters. Due to shallow drill rig refusal at depths of 15.5 to 16 ft bgs, Mid South was unable to install temporary monitoring wells within the borings advanced adjacent to the heating oil UST Upon completion of soil sampling, the soil borings were properly abandoned with hydrated bentonite, and the surfaces were restored to approximately match pre -drilling conditions. Because H&H did not identify evidence of significant soil impacts (i.e., free product) during field activities, soil cuttings were thin -spread on -Site. 2.3 Water Supply Well Survey H&H performed a walking and driving reconnaissance within an approximate 500 ft radius of the UST basin. Properties within 500 ft of the source area appear to be connected to the municipal water supply (i.e., water meters and fire hydrants observed), and no obvious evidence of water supply wells was observed. In addition, according to the Mecklenburg County Land Use and Environmental Services Agency (LUESA) Well Information System, no water supply wells are depicted on the subject Site or on properties within 500 ft of the UST basin. 3 SAAAA-Master Projects\Carolina Capital Real Estate Partners (CCR)\CCR-003 E. 15th Street\Report\Phase II ESA - Area 15 Property (2-13-20).docx ■ hart hickman SMARTER ENVIRONMENTAL 56L UTION5 2.4 Analytical Results Soil data were compared to the DEQ UST Section Action Levels for TPH and the Maximum Soil Contaminant Concentrations (MSCCs) for VOCs, SVOCs, EPH, and VPH. Soil analytical data are summarized in Table 1. The laboratory analytical report is provided in Appendix B. Soil analytical data indicate the presence of TPH-DRO in sample SB-2 (6-8 ft) at a concentration of 1,560 mg/kg, which exceeds the DEQ Action Level of 100 mg/kg. Neither TPH-DRO nor TPH-GRO were detected in sample SB-1 (6-8 ft) at concentrations above the laboratory method detection limits (MDLs). Based on the presence of TPH-DRO in sample SB-2 (6-8 ft) at a concentration above the DEQ Action Level, the sample was analyzed for VOCs, SVOCs, EPH, and VPH. Analytical data indicate the presence of naphthalene (9.0 mg/kg), total C9-C22 aromatics (349 mg/kg), 1-methylnaphthalene (8.0 mg/kg), and 2-methylnaphthalene (11.3 mg/kg) at concentrations above the soil -to -groundwater MSCCs of 0.16 mg/kg, 31 mg/kg, 0.004 mg/kg, and 3.6 mg/kg, respectively. Total C9-C18 aliphatics (2,358 mg/kg) were detected above the residential MSCC of 1,500 mg/kg. Caldwell Street and 510-516 E. 15th Street in Charlotte, Mecklenburg County, North Carolina. A summary of the results of the Phase II ESA is provided below. • Soil borings SB-1 and SB-2 were advanced adjacent to each end of an approximate 500- gallon heating oil UST that was previously closed in place. • Soil analytical data indicate the presence of TPH-DRO in sample SB-2 (6-8 ft) at a concentration of 1,560 mg/kg, which exceeds the DEQ Action Level of 100 mg/kg. • Naphthalene (9.0 mg/kg), total C9-C22 aromatics (349 mg/kg), 1-methylnaphthalene (8.0 mg/kg), and 2-methylnaphthalene (11.3 mg/kg) were detected in sample SB-2 (6-8 ft) at concentrations above the soil -to -groundwater MSCCs. Total C9-C18 aliphatics (2,358 mg/kg) were detected in sample SB-2 (6-8 ft) above the residential MSCC of 1,500 mg/kg. • No water supply wells were identified within 500 ft of the UST basin during a field survey or on the Mecklenburg County LUESA Well Information System. Recommendations H&H recommends that a risk -based No Further Action be pursued through the DEQ UST Section in accordance with guidelines for non-commercial, non -regulated USTs. Caldwell Street in Charlotte. Property ownership was recently transferred to CCRP Area 15 LLC, which intends to seek risk -based regulatory closure through filing an alternate Notice of Residual Petroleum that will establish a soil restriction area and prohibit groundwater use at the property. Municipal water supply is available in the site area, and no water supply wells have been identified within at least 200 ft of the heating oil UST. A formal report that documents the soil sampling is forthcoming. Please let me know if you have any questions or see any issues with the plan to achieve regulatory closure.
