A dark stained area (approx. 10 feet x 10 feet) was noted to the left side of the storage tanks, adjacent to nearby vegetation. Septage debris was on the ground & tire marks were observed. Contacted Mr. Hardee by phone & informed him that it appeared that a septage discharge had occurred in this area. He stated that his driver had an issue with a clogged hose & had caused this discharge without Mr. Hardee’s knowledge. Mr. Hardee stated that there had been similar issues in the past with this driver. I informed Mr. Hardee that this was a violation. Implement procedural changes to handle “clogs”. Intentional discharge of septage onto the ground surface (which is not an active permitted septage land application site & when the septage is not at a pH 12) is a violation and shall not be a course of action to handle issues. Per Permit Condition 2 “Leaks and spills are the responsibility of the Permittee and shall be immediately contained, cleaned up, and treated to prevent any contamination of the surrounding area. Any solids from leaks or spills shall be disposed of in a manner consistent with the NC Solid Waste Management Rules. During the phone conversation Mr. Hardee stated that the area had already been cleaned up. I asked him to visit the site & verify that it was a complete cleanup of the area. ADDITIONAL COMMENTS 1. The nine tanks appear structurally sound. 2. The approved setbacks are being met. No physical change in the facility. 3. The required “No Trespassing” sign is posted and the access road is adequate. 4. The required 5 foot cleared radius (free of excess vegetation or debris) is present around the tanks at this time. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
