March 2, 2020 Sent via email: [e-mail] Mr. Mike Griffin Greenway Waste Solutions, LLC 19109 West Catawba Avenue, Suite 200 Cornelius, NC 28031 Re: Notice of Violation Resolution North Mecklenburg C&D Landfill - Closed Phase I Mecklenburg County Solid Waste Permit Number 60-13 Dear Mr. Griffin, On September 16, 2014, the Solid Waste Section (Section) issued a Notice of Violation (NOV) letter to Greenway Waste Solution, LLC (Greenway) for a violation of 15A NCAC 13B .0503(2)(f) due to the encroachment of waste into the permitted 50 ft buffer to a property boundary as determined in an edge of waste investigation of the closed landfill area. The Section requested at that time that the buffer be re-established by whatever means necessary. Through a series of transactions related to the properties surrounding the landfill, Greenway was able to secure a 1 acre tract of property to re-establish the buffer. The property is recorded in the Mecklenburg County Register of Deeds, as deed book 34140, Page 98. A copy of the new deed was submitted to the Section on January 30, 2020 and as such meets the requirements to resolve the outstanding NOV. This property shall be incorporated into the facility’s permit and shall be maintained as a property line buffer in perpetuity, being subject to any restrictions set forth by the facility permit, unless otherwise approved by the Section.
