The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On February 27, 2020 Chuck Kirchner met with W.R. Foushee to conduct a comprehensive inspection of the Foushee Grading LLC LCID Landfill on Moncure Pittsboro Road in Moncure, Chatham County.
1. The Foushee Grading LLC LCID Landfill is a notified land clearing and inert debris (LCID) landfill.
2. The LCID landfill is < 2 acres.
3. The landfill boundary is required to be designated. EOW is designated by white PVC [vertical] pipe. Ensure boundary markers are maintained as needed.
4. The LCID landfill is not open to the general public. Foushee Grading LLC personnel access the site.
5. Mr. Foushee stated that topsoil is currently being received on site. Three dump trucks were observed off-loading topsoil on site today.
6. The facility operates a narrow working face along the side slope. Material atop the landfill is covered with soil.
7. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.”
8. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area
reaches one acre in size, whichever occurs first.”
9. Broken up concrete and used asphalt was observed on the outer slope of the lower access road below the LCID Landfill. Concrete and used asphalts are a regulated solid waste. If this area is within 100’ of the property line this material must be returned to the landfill and covered. If this material does have the proper siting requirements than this waste will need to be covered
with one foot of soil and the edge of waste markers will need to be moved to the outer limits of this waste.
10. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed.
11. There was no indication of erosion or runoff.
12. Northward of the landfill is a soil borrow pit/soil storage area.
13. The facility has two sediment basins on the eastside of the disposal area.
14. The facility has an all-weather access road.
15. The facility is secured by a mechanical/electronic gate [passcode needed].
16. The entrance drive to the facility is at [mailbox] 4900 Moncure Pittsboro Road.
17. The facility has a sign.
