(see comments page #2) PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS: 01 – Permit expired on January 12, 2016 and still has not been reissued. It was noted on the July 30, 2019 inspection to have corporate office (Guenter M. Burkhardt – gmb@goodearth.org – 716-684-8111) contact permitting staff (Donna Wilson – Permitting Engineer donna.wilson@ncdenr.gov – or Sherri Stanley – Permitting Branch Head – Sherri.Stanley@ncdenr.gov ) (919-707-8200) to check on the status of the expired permit. Several phone calls have been made in the past so I recommend sending emails for documentation. Please copy john.college@ncdenr.gov and andrew.hammonds@ncdenr.gov on any emails sent. 02 – Temperature readings are being kept and now are meeting required temperatures of 131 or higher. 03 – Compost Windrow sizes does not exceed maximum size of 10ft high and 22ft wide. 04 – Stockpiled feedstock windrows do not exceed maximum size of 30ft high and 50ft wide. 05 – Facility has required signage. 06 – Facility is secured by fencing and locking gates. 07 – Interior roadways are constructed off all-weather materials. 08 – Fire lanes are present. 09 – Facility has fire extinguishers available in working areas and the office to fight fires. 10 – Local Fire Department has keys to facility entrance gate to enable quick entry for any fire that may occur after work hours. 11 – All feedstock materials were of the permitted types. 12 – Facility is currently operating under the expired permit and appears to be in compliance. 13 – The facility has removed 50% or more of the Closed Sun Gro (7004-COMPOST) facility that was in Pasquotank County. This removal is letting this facility manage better. 14 – Facility has documentation of temperature probe calibration dated August 23, 2019. 15 – Incoming and outgoing products are recorded in the facility computer. Several were entered during this inspection. 16 – Overall conditions at this facility were good even though this area has had abnormal wet weather for several months.
