The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. During the July 11, 2019 inspection, several patches of exposed waste/cover that did not have vegetation were
observed. During the February 13, 2020 inspection, those areas had been patched with mulch, seeded, and had
grass beginning to grow (Figure 1). Good job. Please continue to inspect and maintain the vegetative layer of
the cap.
2. The landfill had been mowed recently (Figure 2).
3. There are signs marking "Asbestos Disposal Area."
4. Historical Information:
a. The 23.5-acre Champion Industrial Landfill closed prior to January 1, 1998 (final waste placements and
grading improvement occurred in May 1997).
b. The site was permitted on May 6, 1981. The site was permitted for flyash, sawdust, bark, concrete,
asbestos and wood pallets. In March 1997, Champion generated and disposed of a large headbox and
lengths of pipe containing Naturally Occurring Radioactive Material (NORM) with approval by the
Solid Waste Section.
c. According to the August 1997 Operational and Closure Plan for Flyash Disposal Area Update (1997
Plan) submitted by Rust Environment & Infrastructure, on behalf of Champion International
Corporation, during a previous meeting on August 20, 1996, the Solid Waste Section had given
Champion permission to use dewatered sludge mixed with flyash for the final cover material. A
minimum of 2.5 feet of the mix was applied for final cover.
d. During the inspection, the side slopes were heavily vegetated with woody trees and were steeper than a
3:1 ratio. According to the 1996 Plan, on August 18, 1990, Champion, Rust, and Solid Waste Section
representatives agreed that it would not be appropriate to disturb the heavily vegetated side slopes,
therefore the placement of final cover material and vegetative cover does not apply to areas with
existing dense vegetation.
