PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. This partial inspection was performed to observe the active and inactive areas of the Phase 2 landfill. None of the other facility operations or the closed landfill areas were inspected, and no facility records were reviewed. 2. All photos included in this report were taken by Susan Heim on February 13, 2020 unless otherwise indicated. 3. The weather encountered included light rain and moderate winds. 4. Some windblown litter was observed throughout the Phase 2 area of the facility. Mr. Phelps stated that inmates are being used daily to collect windblown waste. No litter collection was observed during this inspection. 5. A few weeks prior to the inspection, the Solid Waste Section was notified that the level indicator on the leachate storage tank had stopped working, and that a contractor hired to handle repairs had found that the float had become inoperable. Mr. Brushwood had stated that the plan was to draw the tank down to empty, let it dry for a day or two, then have the company clean the tank and take care of the necessary repairs. Mr. Phelps stated that plans for the repairs had been postponed due to the extended period of rain over the past two weeks that required the use of the leachate storage tank. He added that another attempt at emptying and repairing the tank would be initiated as soon as the weather permitted. 6. Facility access roadways are of all-weather construction and were found to be navigable. Mr. Phelps stated that his staff had been working to keep stone and sawdust on the tipping area and the incoming access to the working face so that customers wouldn't get mired in the mud. No problems of this nature were observed during the inspection. 7. Vehicles leaving the tipping area were directed to a roadway that followed the entire perimeter of the inactive landfill where the roadway was well -established with a stable rock base that would hold up to truck traffic. Mr. Phelps stated that this longer route was eliminating a large traffic volume in the operations area where mud had become deep and unnavigable. He added that he felt this to be a safer way to manage traffic. 8. The working face was located on the eastern edge of the active cell and appeared to be small and well compacted. Mr. Phelps remarked that the new, larger compactor was making a big difference in compaction rates and also in the amount of time required to achieve adequate compaction. He added that his operators had been instructed to keep the equipment operating within the working face itself if possible, so that the surrounding operations area would not be damaged by the heavy equipment any more than absolutely necessary. 9. A tire was spotted at the edge of the working face, and Mr. Phelps stated that he would be sure the operator had spotted it for removal. No other prohibited waste was observed in the working face. 10. Wind screens were set at the toe of the slope on the east side of the working face to catch any waste that escaped the operations area. This strategy appeared to be working in the operations area surrounding the working face. 11. An area just south of the working face was covered with a tarp. Mr. Phelps explained that the rain was washing away soil cover in the area, and that the tarp had been applied to ensure that as much cover as possible was preserved until dry soil could be tracked in to stabilize the area. 12. Areas of the inactive Phase 2 landfill that had not yet established a vegetative cover were showing signs of erosion. Small rills had formed along the eastern slope. Along the southern slope, several large rills were noted with waste visible in and around them. Because close access to the slope was not possible during the inspection, it was difficult to determine whether the waste seen was windblown litter or uncovered waste. Mr. Phelps stated that repairs were ongoing in this and several other areas of the landfill where seeding had either not yet taken place or had so far been unsuccessful. He added that he would have inmates concentrate on collecting litter around the eroded areas. 13. The western end of the inactive landfill was covered with well -established vegetation, and no erosion was evident in this area. 14. Heading east along the northern slope of the inactive landfill, vegetative cover became sparse. Some washing was beginning to occur. Mr. Phelps stated that this is an area that he'd planned to do some preventive maintenance on when weather conditions permit. 15. The northern slope just west of the working face was badly washed in some areas, and sediment could be seen moving downhill in the erosion rills. Trash was noted in and around the larger rills, and Mr. Phelps stated that he would continue to cover and clean up these areas as effectively as possible every day as required.
