PART I: GENERAL FACILITY 1. This permit is issued by the North Carolina Department of Environmental Quality, Division of Waste Management (Division), Solid Waste Section (Section). In accordance with North Carolina Solid Waste Management Rule (Rule) 15A NCAC 13B .0201(d), a solid waste management facility permit shall have two parts: a Permit Approval to Construct and a Permit Approval to Operate. The Permit Approval to Construct must be implemented in accordance with Attachment 2 of this permit. The Permit Approval to Operate must be implemented in accordance with Attachment 3 of this permit. 2. The persons to whom this permit is issued (“permittee”) are the owners and operators of the solid waste management facility. 3. (Intentionally blank) 4. (Intentionally blank) 5. By receiving waste at the facility, the permittee shall be considered to have accepted the terms and conditions of this permit in accordance with Rule 15A NCAC 13B .0203(d). 6. Construction or operation of this solid waste management facility must be in accordance with the Rules 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (N.C.G.S. 130A-290, et seq.), the conditions contained in this permit; and the approved plan. Should the approved plan and the rules conflict, the rules shall take precedence unless specifically addressed by a permit condition. Failure to comply may result in compliance action or permit revocation. 7. This permit is issued based on the documents submitted in support of the application for permitting the facility including those identified in the “List of Documents for the Approved Plan” which constitute the approved plan for the facility. Where discrepancies exist, the most recent submittals and the Conditions of Permit shall govern. Per N.C.G.S.130A-294(a1) this permit may be transferred only with the approval of the Section, through the issuance of a new permit in accordance with N.C.G.S.130A-294(a3). 9. In accordance with N.C.G.S. 130A-295.2(g) the permittee shall notify the Section thirty (30) days prior to any significant change in the identity or business structure of either the owner or the operator, including but not limited to a proposed transfer of ownership of the facility or a change in the parent company of the owner or a change in the operator of the facility or parent company of the operator. 10. The permittee is responsible for obtaining all permits and approvals necessary for the development of this project including, but not limited to, approval from appropriate agencies for a General or Individual National Pollutant Discharge Elimination System (NPDES) Stormwater Discharge Permit, if applicable and a sedimentation and erosion control permit. Issuance of this permit does not remove the permittee’s responsibilities for compliance with any other local, state or federal rule, regulation or statute. Submitted by Moore County including zoning approval document. Dated June 17, 2019 and revised through XX, 2020. - End of Section – ATTACHMENT 2 CONDITIONS OF PERMIT APPROVAL TO CONSTRUCT 1. The household hazardous waste facility muse be designed and constructed in accordance with the approved plan (FIDXXX) and all applicable state, local construction codes including a certificate of occupancy and fire codes which address hazardous material, waste, and/or substance. 2. Construction of any new addition to the approved household hazardous waste (HHW) facility requires written approval of the Section. An Application for Permit to Construct must be prepared in accordance with applicable statutes and rules in effect on that date. 3. Ten (10) calendar days prior to the beginning of waste operations according to Attachment 3 of this permit, permittee must conduct a pre-operative meeting at the HHW facility with key facility personnel and representatives of the Section including the Regional Environmental Specialist. - End of Section ATTACHMENT 3 CONDITIONS OF PERMIT APPROVAL TO OPERATE PART I: GENERAL FACILITY OPERATION CONDITIONS 1. The Permit Approval to Operate shall expire ##, 2025. To continue operating the facility, the permittee must submit a request to the Section for permit review and must update pertinent facility plans including, but not limited to, the facility operation plan, contingency plan, and/or closure plan. 2. Copies of this permit, the approved plans, and all records required to be maintained by the permittee as specified in the approved plan (FID XXX) must be maintained at the Permit No.: 6303-HHW-2020 Generator ID: NCPH06319001 Moore County Eagle Spring Road Household Hazardous Collection Facility Permit Approval to Construct and Operate ##, 2020 FIDXXX Page 5 of 9 facility, unless otherwise approved by the Section, and made available to the Section upon request during normal business hours. 3. The permittee must maintain a record of the amount of solid waste received at the facility including daily records of wastes received and origins of the loads. The daily records are to be summarized into a monthly report for use in the required annual reports. 4. On or before August 1 annually, the permittee must submit an annual facility report to the Section, on forms prescribed by the Section. a. The reporting period shall be for the previous year beginning July 1 and ending June 30. b. The annual report must list the amount of waste received in pounds or gallons and be compiled: i. On a monthly basis. ii. By county, city of origin. iii. By specific waste type. iv. By receiving disposal facility. v. By diversion to alternative management facilities. c. The completed report must be forwarded to the Regional Environmental Specialist for the facility by the date due on the prescribed annual facility report form. d. A copy of the completed report must be forwarded to each county manager for each county from which waste was received at the facility. Documentation that a copy of the report has been forwarded to the county managers must be sent to the Regional Environmental Specialist by the date due on the prescribed annual facility report form. 5. The facility shall be adequately secured by means of gates, chains, berms, fences, or other security measures approved by the Division to prevent unauthorized entry. Signs shall be clearly posted at the facility entrance stating the hours of operation and other pertinent information. PART II: MUNICIPAL SOLID WASTE LANDFILL UNIT(S) Not Applicable. PART VI: TRANSFER STATION/TREATMENT & PROCESSING UNIT(S) Not Applicable. PART V: MISCELLANEOUS SOLID WASTE MANGEMENT UNIT SPECIFIC CONDITIONS 6303-HHW-2019, EAGLE SPRINGS ROAD HOUSEHOLD HAZARDOUS WASTE COLLECTION FACILITY 1. This facility is permitted to receive household hazardous waste (HHW) generated by the residents within the Moore County. To be defined as “household” waste, the waste must be: a. Generated by individuals on the premises of a residence for individuals (a household), and b. Composed primarily of materials found in the wastes generated by consumers in their homes. c. The waste streams that listed in the approved Operational Plan (FID XXX). 2. Unacceptable and prohibited wastes that shall not be collected at the HHW facility per approved plan (FID XXX) include the following: a. Radioactive materials. b. Infectious or biological wastes and pharmaceutical/medical wastes. c. Explosives/shock sensitive material, organic peroxides, ammunition. d. Polychlorinated biphenyls (PCB) waste as defined in 40 CFR 761. e. Friable asbestos wastes or material as defined in 40 CFR 61.141. f. Batteries (lead acid, alkaline, NiCad, lithium, etc.), cylinders (propane, helium, oxygen, fire extinguishers, aerosols, etc.), devices containing mercury (thermometers, light bulbs except fluorescent bulbs), spent acidic or alkaline cleaners, non-hazardous solid and liquid waste (putty, caulk, tec.), oils, oil filters, fertilizers, and unknown wastes. 3. Household Hazardous Waste Generator Identification Number NCPH06319001 shall be used to ship wastes off site for recycling, treatment, and/or disposal. 4. This facility shall conform to all operating procedures in the approved Operational Plan (FID XXX). Any proposed modification to an approved plan must be submitted to the Section and approved prior to implementation. The permittee must develop and use training and waste screening programs at the facility for detecting and preventing unauthorized wastes from being accepted at the facility. The approved plan (FID XXX) must be used to identify the user eligibility and screen out unauthorized wastes from being accepted at the facility 6. Responsible individuals trained and certified in facility operations must be on-site at all times during all operating hours of the facility in accordance with N.C.G.S. 130A-309.25 and the approved Operational Plan (FID XXX). 7. Only personnel who have been trained in accordance with the permittee-approved training program of collection, sorting, and/or storage procedures for hazardous wastes or substances shall participate in collection, sorting, and storage activities. Lab packing, over-packing, bulk packaging, and labeling of the collected HHW shall be performed by a licensed contractor or a trained and competent employee as specified in the approved Operational Plan (FID XXX). 8. Permittee must ensure that all on-site equipment, tools, and supplies for communication, fire prevention and fighting, personal protection, spill control, and decontamination are properly inspected and maintained to ensure their presence, adequate amount or quantity, and proper function in case of emergency. The emergency equipment shall be tested according to manufacturer specifications. 9. The facility shall have adequate secondary containment system in the waste storage area that can contain any HHW discharges, leaks, or spills before detection and removal. Sump outlets in the HHW storage buildings at the facility shall remain plugged and closed. 10. The permittee must clearly, constantly post the accurate placards which are approved by the National Fire Protection Association (NFPA) outside the waste storage building and inside the storage units and working areas. 11. The permittee shall inspect and document at least twice per month that the temporarily stored HHW inside the designated storage buildings, in receiving/unloading areas, and/or in the collection facility in a way that adequate aisle space can be constantly maintained at all times to allow the unobstructed movement of personnel, fire protection equipment, and spill control equipment, and decontamination equipment in the event of an emergency. 12. The date upon which each period of accumulation begins shall be clearly marked and visible on each container and be checked by permittee at least weekly. a. Each container shall be labeled or marked clearly with the words “Household Hazardous Waste” unless the container separately holds recyclable material such as “Used Oil, Universal Waste, or Battery, etc.” Permit No.: 6303-HHW-2020 Generator ID: NCPH06319001 Moore County Eagle Spring Road Household Hazardous Collection Facility Permit Approval to Construct and Operate ##, 2020 FIDXXX Page 8 of 9 b. The maximum period of accumulation for all HHW stored at the facility shall be no more than one year after initial receipt. c. Before the end of a waste accumulation period, the permittee must ensure that HHW is transported by a hazardous waste transporter licensed/permitted by department of transportation (DOT), to a permitted off-site facility for recycling, treatment, and/or disposal. 13. In the event of an incident which has the potential to threaten public health or the environment, the Emergency Coordinator must follow the emergency procedures in the approved Operational Plan (FID XXX) and, at a minimum: a. Immediately notify Moore County Emergency Management Services. b. Identify the character, source, and amount of all released hazardous materials. c. Access the possible hazards to public health or the environment that may result from the incident. d. Notify the Solid Waste Environmental Specialist in the Fayetteville Regional office at (910) 443-3350 or (910) 443-3349 within 24 hours of the incident. e. Ensure that in the affected areas of the facility: i. No incompatible waste is stored with the released material until cleanup procedures are completed: and ii. All emergency equipment is cleaned and fit for its intended use before operations are resumed. f. Note in the operating record the time, date, and details of the incident. g. Submit a written report detailing the incident to the Solid Waste Section within 15 days of the incident; the report must include the contents described in the approved Contingency Plan (FID XXX). 14. According to approved Operational Plan (FID XXX), after an incident occurs, the permittee shall not resume waste operations at this facility until the Section’s Environmental Specialist in the Fayetteville Regional Office, the Moore County Emergency Management Department or County Sheriff’s Office is notified by writing when the facility has completely cleanup and restored and ready to resume operations. 15. The permittee shall inform the Section of the decision to close the HHW Facility in writing including a detailed schedule, 30 calendar days prior to starting the closure activities according to the approved Closure Plan (FID XXX).
