Wyers PO Box 560 Red Oak, NC 27868-0560 AUDIT PARTICIPANTS: Mary Whaley, NCDENR, Solid Waste Ben Barnes, NCDENR, Solid Waste Jeff A Wyers, Vice President of Production, Nash Brick Company STATUS OF PERMIT: Notification issued July 14, 2005 PURPOSE OF AUDIT: Comprehensive Audit NOTICE OF VIOLATION(S): NONE You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. STATUS OF PAST NOTED VIOLATIONS: NONE AREAS OF CONCERN AND COMMENTS: 1. The side walls shall not exceed a 3:1 slope. Some of the slope is at greater then 3:1. 2. The site appears to be very well managed. There was not any visible land clearing debris except a very small area approximately 10' x 5' on the side slope, that needed more cover. 4. The edge of waste markings are the tree lines. 3. Mr. Wyre stated that at this time, Nash Brick Company is the main user of the site. Land clearing debris from the areas to be mined are put in this site. Mr. Wyre stated that land clearing debris from potential building sites may be brought to the site, but this is not occuring at this time. Mr. Wyre also stated that there is a possibility of using the site for vegetative disaster debris if the site was needed. It was explained to him that in order to receive FEMA money, the site would have to be approved by the Solid Waste Section. The site would have to be approved for use by the local government, as FEMA money is only reimbursed to local governments. Mr. Wyre started that he did not want to go through any approval process at this time. Please contact me if you have any questions or concerns regarding this audit report.
