Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On February 4, 2020, Chuck Kirchner met with Robbie Stone and Wayne Hunt to conduct a comprehensive inspection of the Kersey Valley MSW Landfill located off E. Kivett Road in High Point, Guilford County. Facility Information
1. The municipal solid waste (MSW) landfill is located on property owned by the City of High Point.
The property also contains a treatment and processing (T&P) operation, a convenience center, and
a temporary disaster debris staging site (TDDSS).
2. The landfill is in operation Monday through Friday 7:30 am to 4:30 pm. The convenience center near the entrance is open on Saturday from 7:00 am to 1:00 pm.
3. The MSW landfill consists of two lined fill areas: Area 1, Phases 1 – 3A and Area 2, Phases 4 and 5A and 5B.
4. The MSW landfill Area 1 is inactive. It is capped. A partial closure letter, dated December 19, 2016, was issued by the SWS for approximately 23.8 acres (of the approximately 39.1-acre area).
5. The facility permit approves the operation of Phases 1 through 5B and construction of Phase 5C. 6. The facility has not begun physical construction on landfill Area 2, Phase 5C.
7. Ensure the requirements of attachment 2 – conditions of permit to construct are met prior to beginning construction of Phase 5C.
8. In the future, the facility plans to reroute a portion of Kersey Valley Road that runs between landfill Areas 1 and 2 and adjoin the landfill areas. The landfill area between the two phases will be Phase 5C.
9. The facility address for landfill Area 1 is 3854 E. Kivett Drive, High Point. 10. The facility address for landfill Area 2 is 3940 E. Kivett Drive, High Point.
11. The facility does not accept scrap tires.
12. White goods are placed in a roll-off container at the convenience center. The white goods are managed by the City of High Point Material Recovery Facility (MRF) and are hauled off once a week.
13. The facility is permitted to co-dispose of wastewater treatment sludge. Mr. Stone stated that the facility has not received wastewater treatment sludge and that the City of High Point is still hauling it to Uwharrie Environmental Regional Landfill (62-04) in Montgomery County.
14. The facility has installed a landfill gas extraction network in Area 1 for expected future use. Landfill gas extraction wellheads have not been installed and a landfill gas collection station has
not been constructed. Currently not enough methane is produced to make recovery economical according to Mr. Stone.
15. The facility has installed four candlestick flares atop Area 1. The flares are used for the combustion of passive landfill gas. The flares automatically ignite when needed. If the flares malfunction, landfill gas will vent via the unfinished landfill gas extraction wellhead caps. The
wellhead caps are designed to pop off to vent landfill gas.

18. The facility is permitted to receive solid waste from Davidson, Forsyth, Guilford, and Randolph
Counties.
19. The facility maintains records of the amount of solid waste received. The amount of solid waste received from July 1, 2019 through February 3, 2020 is 94,457.89 tons.
20. The facility annual report (FAR) was received by the SWS dated July 16, 2019. Facility throughput for July 2018 through June 2019 is 135,807.36 tons.
21. The facility maintains waste screening reports. At least one vehicle per week but not less than one percent by weight of the waste stream shall be screened. Records for April 13, 2018 through January 23, 2019 were observed.
22. The facility maintains semiannual groundwater and surface water monitoring and leachate test records submitted by Babb & Associates, P.A., analyzed by Environmental Conservation
Laboratories, Inc. (ENCO). Records for groundwater, surface water monitoring and leachate testing conducted on April 25-26, 2018, October 23-24, 2018, November 16, 2018 and November 19-21, 2019 were observed. Sampling was not conducted in the first half of 2019 in agreement with the Solid Waste Section Hydrologist as part of the remediation planning. An exceedance is noted for each event.
23. The facility maintains quarterly methane monitoring records. Monitoring is conducted by Smith+Gardner, Inc. Records for methane monitoring conducted March 4, 2018 (1st quarter), June 26, 2018 (2nd quarter), September 28, 2018 (3rd quarter), December 12, 2018 (4th quarter), February 15, 2019, (1st quarter), July 16, 2019 (2nd quarter), September 3, 2019 (3rd quarter) were observed. Monitoring results do not indicate an exceedance of the methane lower explosive
limit (LEL).
24. The facility has a stormwater National Pollutant Discharge Elimination System (NPDES) permit, General Permit No. NCG120000. The NPDES permit was issued November 1, 2018 and will expire on May 31, 2021.
25. The facility has four open erosion and sedimentation control plans listed with NCDEMLR.

26. The leachate collection lines are required to be flushed and camera inspected once every five years. The leachate collection lines were flushed and camera inspected by Jetclean America in November 2015 (Areas 1 and 2, Phases 4 and 5A). Area 2, Phase 5B was camera inspected on
July 20-25, 2016. The new leachate collection lines that have been installed were flushed upon installation in March of 2019 and the entire system is scheduled to be flushed and camera inspected the fall of 2020 according to Mr. Stone. Site Inspection
27. The facility is operating in Area 2, Phase 5B.
28. The facility is permitted to use tarps. Two tarps are commonly used to cover the working face Monday through Thursday and soil cover is used on Friday according to Mr. Hunt. Six inches of earthen material shall be applied at a minimum of one time per week or more frequently to
control disease vectors, fires, odors, blowing litter, and scavenging.
29. The facility is no longer looking into alternative daily covers as noted in the April 9, 2018 inspection report.
30. Groundwater monitoring well MW4 was previously noted in the April 9, 2018 inspection report to be installed below grade. This caused water to accumulate around the well casing. MW4 has
been repaired and water is no longer accumulating around the well.
31. The facility has a leachate pump station that is connected to a pump station located on the south side of the landfill, east of Kersey Valley Road. The municipal sewer system collects leachate from Areas 1 and 2.
32. The facility has a 340,000-gallon leachate storage tank with secondary containment that is no
longer used. Mr. Stone stated that the facility recently maintained the storage tank and it will be kept in good order in case it is needed in the event the pump station fails. 33. The facility had a leachate storage pond that is no longer used and has been removed. All leachate has been directed to the pump station and does not go to the pond area. Continue to stabilize pond area as discussed in the field. Recommend adding small pipe inlet protection at the inlet to the pipe (e.g. filter fiber log).
34. The working face was small and compact. 35. All waste shall be covered at the end of each working day. Ensure any exposed waste just outside the working face is returned to the working face or covered with a minimum six inches of soil as discussed in the field.
36. Phase I has a temporary cap. No eroded rills and a good grass cover were noted in this area. Continue to maintain this area as needed.
37. The facility has white edge of waste markers along Areas 1 and 2.
38. During the inspection, no odor off site was detected.
39. During the inspection, no windblown material was observed.
40. Mr. Stone stated that the landfill cap is mowed when needed, however, the phase I capped area was
intentionally not mowed this past year to allow the new grass cover to go to seed and obtain a more vigorous grass cover. Grass cover has germinated well in this capped area. General Comments
41. The facility has a wood waste treatment and processing (T&P) operation. Land clearing debris, high carbon to nitrogen ratio material, pallets, treated wood, lumber scraps, engineered wood, and furniture manufacturing waste is ground for use only on the landfill working face access road in lined areas during inclement weather.

42. Mr. Stone stated that when the material is ground, it is directly off-loaded into roll-off containers or dump trucks and brought to the landfill operations area. Ground treated and engineered wood shall not be stored on the ground outside of the lined landfill and leachate control areas. 43. Mr. Stone stated that the facility grinds material ~ two times a year. 44. The area allotted for the wood waste T&P operation is ~ 2 acres. The area is also designated as a temporary disaster debris staging site (TDDSS), number DS41-004. 45. The City of High Point Fire Department can be contacted to respond to an emergency at the landfill.
46. Access roads are of all-weather construction.
47. The facility has proper signage.
48. The facility entrance is secured by a locked gate.
49. The PTO expiration date is July 20, 2020.
