REGAN Secretary MICHAEL SCOTT Director January 31, 2020 Henry Bourne Long 1501 Dellwood Dr. Raleigh, NC 27607 SUBJECT: Structural Fill Cap Maintenance Brandywine Industrial Park Structural Fill Coal Combustion By -Products Structural Fill CCB0064 Northampton County Dear Mr. Long: On July 11, 2019, Elizabeth Werner, Davy Conners and Larry Frost, and on November 13, 2019, Elizabeth Werner, representing the Division of Waste Management, inspected property containing the closed Arthur's Creek CCB Structural Fill site, CCB0064, located off NC Hwy 46, Garysburg, NC in Northampton County. Approximately 480,612 cubic yards of coal combustion products were utilized in the construction of the structural fill on 21.7 acres. The structural fill operation was performed by Plumbline Corp, P.A. The coal combustion products were generated by the Roanoke Valley Energy Facility in Weldon, NC. The stated purpose of the structural fill in the Notification received by the Solid Waste Section on April 22, 2004, was "to construct an Industrial/Commercial site for a private developer. The end -use of the site will be for office buildings..." As of the date of the inspections, no buildings have been constructed on the property and the current use was an open field. During the inspection, it was observed that the structural fill site was overgrown with vegetation. The soil cap appeared to be maintained in good condition, however, it was observed that in several areas fire ants had brought ash to the surface. Based on observations, no coal ash material had migrated off -site from these exposed areas. The exposed areas need to be recovered with soil in accordance with the rules. The specific rule is 15A NCAC 13B .1705, which states in part the following: (a) The structural fill facility must be designed, constructed, operated, closed, and maintained in such a manner as to minimize the potential for harmful release of constituents of coal combustion by-products to the environment or create a nuisance to the public. Please start this remedial action immediately in order to meet the rule requirement above. Please keep this office updated on your progress, and DEQ staff may conduct follow-up inspections to verify compliance. Failure to restore and maintain the cover as noted in the rule above will result in initiation of tiered enforcement. In addition, a brownish red liquid was observed flowing into the wetlands area. The Division of Water Resources is overseeing compliance issues related to this observation. Attached is a copy of the site inspection report providing additional information.
