The Section received a Notice of Ceased Operation of a Facility form for YWN-11-034, signed on January 3, 2020. PURPOSE OF SITE VISIT: Closure Inspection. STATUS OF PAST NOTED VIOLATIONS: 1. 15A NCAC 13B .1404(a)(2): RESOLVED. As discussed with facility owner, Mrs. Clara Ray, on August 14, 2019, the required facility buffers/setbacks had been maintained at the site since the previous inspection. (The discussion occurred during the 8/14/19 facility inspection of Riverside Stump Dump, Inc.'s #I I I I-TP site.) OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. On -site to determine YWN-11-034 status. The Section received a Notice of Ceased Operation of a Facility form for the site, signed on January 3, 2020. 2. The facility was permitted to receive land clearing debris and yard trash, which included: stumps, whole trees, tree limbs, branches, untreated wood, leaves, brush/shrubs, and yard trimmings. The facility also accepted/stored dirt, concrete, stone, and asphalt millings. 3. During this inspection, the facility was not operational and no processed or unprocessed materials were observed on - site. Additionally, no unpermitted waste was observed at the site. 4. The facility appeared to be closed and will be removed from the Section's active YWN facility list. If the Owner/Operator intends to re -start operations, please submit a new YWN form to the Section. 5. Per Buncombe County Property Records, the property was sold/transferred in November 2019. During this inspection, grading equipment and activity were observed on the parcel. Please contact me if you have any questions or concerns regarding this inspection report.
