Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Proper signage was observed at the entrance of the facility. 2. The facility is permitted to receive solid waste generated within Gaston County and the area encompassed by a radius of 100 miles extending from the Gaston County line. 3. The facility has accepted an average of 625 tons per day from July 1, 2019 — Dec. 31, 2019 at the MSW LF. 4. The facility has accepted an average of 248 tons per day from July 1, 2019 — Dec. 31, 2019 at the C&D LF. 5. The facility is currently working in Unit 2, Phase 2. 6. Three unpainted wooden pallets were observed on the working face and pointed out to Mr. Cloninger. Mr. Cloninger radioed to the staff running the compactors to stop and the pallets were pulled out and set aside to be taken to the composting area. Ms. Sue explained G.S. 130A-309.10 (12) states: "Wooden pallets are banned in landfills, except that wooden pallets may be disposed of in a landfill that is permitted to only accept construction and demolition debris ". 7. A Waste Management truck was observed backing up to the working face to dump a load of pallets from Red Valve. Ms. Sue and Mr. Cloninger observed the load was pallets with paint on them. Mr. Cloninger instructed the driver the pallets could not be disposed of on the working face. The driver was instructed to return the load to Red Valve since the pallets had paint on them and could not be disposed of at the landfill. 8. Edge of liner markers were observed. 9. The working face was small and manageable. 10. The facility utilizes soil and spray -applied mortar coating (SMC) as alternative cover. Soil cover is applied at least once a week and more often when deemed appropriate. 11. Windblown waste was being collected during the inspection. C&D Landfill Unit 12. Edge of waste markers were observed. 13. Working face less than'/2 acre in size. 14. The facility utilizes soil for cover which, is applied weekly. 15. No ponding of water on the landfill was observed. 16. Windblown waste was observed along the roadway into the landfill. Waste observed appeared to be no more than from daily activities. White Goods & Scrap Metal Collection Area 17. Area is well maintained. 18. White goods are staged upright on a concrete pad. 19. CFC's are removed from all white goods by Rapid Recovery of Monroe, NC. 20. Scrap metal is collected by Web Metal for recycling. Scrap Tires 21. Scrap tires are collected and stored in US Tire semi -trailers. 22. Area is well maintained. Electronics Recycling 23. All electronics are staged by county staff prior to being taken for recycling by ERL Page 2 of 3 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Small Type 1 Composting 24. Attendant on duty checks all incoming loads. 25. Only yard waste, silvicultural waste, untreated and unpainted wood waste is accepted and ground into mulch. 26.
