Box 249 Tarboro, North Carolina 27886 SUBJECT: Structural Fill Cap Maintenance Brandywine Industrial Park Structural Fill Coal Combustion By -Products Structural Fill CCB0056 Nash County Dear Ms. Holderness: On July 11, 2019, Elizabeth Werner, Davy Conners and Larry Frost, and on November 13, 2019, Elizabeth Werner, representing the Division of Waste Management, inspected property containing the closed Brandywine Industrial Park Structural Fill site, CCB0056, located off NC Hwy 4, Battleboro, NC in Nash County. Overall, the closed structural fill was being maintained in good condition, however, it was observed that two small areas of the soil cap covering the fill had eroded exposing a very small amount, approximately 12 inches in diameter, of ash. Based on observations, no coal ash material had migrated off -site. The exposed areas need to be recovered with soil in accordance with the rules. The specific rule is 15A NCAC 1313.1705, which states in part the following: (a) The structural fill facility must be designed, constructed, operated, closed, and maintained in such a manner as to minimize the potential for harmful release of constituents of coal combustion by-products to the environment or create a nuisance to the public. (j) All structural fills shall be covered with a minimum of 12 inches compacted earth, and an additional surface six inches of soil capable of supporting native plant growth. Please start this remedial action immediately in order to meet the rule requirement above. Failure to restore and maintain the cover as noted in the rule above will result in initiation of tiered enforcement.
